Bates, Defendant No. 03 - Civil Action - Law Jury Trial Demanded COMPLAINT AND NOW, TO WIT, this ~J~ day of_February, 2003, comes the Plaintiff, AllFirst Bank, f/d/b/a Dauphin Deposit Bank & Trust Company, by and through its attorneys, Kristi A. Gohn, Esquire, and Griffith, Strickler, Lerman, Solymos & Calkins, and does file this Complaint, a statement of which is as follows: 1. The Plaintiff, AllFirst Bank, is a federally chartered bank duly authorized to do business within the Commonwealth of Pennsylvania, whose business address is P.O. Box 17103, Baltimore, Maryland 21203. 2. The Defendant, Samuel L. Bates, is an adult individual residing at 306 Charles Road, Mechanicsburg, Cumberland County, Pennsylvania 17050-3003. 3. On or about September 15, 1994, Defendant executed a Note and Security Agreement for the principal sum of Twenty Two Thousand and 00/100 ($22,000.00) Dollars in order to purchase an undeveloped parcel of land, with interest accruing at the rate of 9.49%. (A true and correct copy of the Note and Security Agreement is attached hereto as Exhibit "A' and made a part hereof as though set forth at length.) 4. Since then, Defendant did tender certain payments to Plaintiff and Plaintiff did credit Defendant's account in the amount of any tendered payments. 5. On or about February 1, 1999, Defendant defaulted under the terms and conditions of the contract, by failing to remit his required monthly payment. 6. As of March 25, 1999, Defendant remained due and owing a principal balance of Sixteen Thousand Three Hundred Fifty-two and 93/100 ($16,352.93) Dollars to Plaintiff. 7. Pursuant to the terms and conditions of the Note and Security Agreement, Defendant remains due and owing to Plaintiff interest in the amount of nine and 49/100 percent (9.49%) or Five Thousand Seven Hundred Sixty-one and 14/100 as of December 9, 2002, and interest continues to accrue. 8. Pursuant to the terms and conditions of the Note and Security Agreement, Defendant remains due and owing to Plaintiff reasonable attorney's fees in the amount of $2,452.93. 9. Plaintiff has demanded payment of Defendant but said Defendant has refused and continues to refuse to pay the same or any part thereof. 10. The amount in controversy herein requires mandatory reference to Arbitration. WHEREFORE, Plaintiff, Allfirst Bank, prays that judgment be entered in its favor and against Defendant, Samuel L. Bates, for Twenty-Four Thousand Five Hundred Sixty-seven and 00/100 Dollars ($24,567.00) plus interest, attorney's fees, and costs of suit.
