Hoover ucquired title to the premises by virtue of u deed from the Commissioners of Cumberlund County duted January 23, 1943, and recorded in Cumberhmd County Deed Book "X", Volume 14. Puge 292. purporting to convey the properly of the New Custle Hunt Club (c/o Luwrence Huwlhorne. Newcustle RD 7). Alluched hereto und incorporated herein us Exhibit "B" Is a true und COITect copy of the Cumhel'land County Tl'ClIsurer's D\1\1d Book entry for the sllle. 5. At thc time hI' the uhovc-referenced sllle hy the Cumherlllnd County Commissioners, the record owner of the premises was not "New Castle Hunt Cluh (c/o Luwrence Huwthorlle, Newcastle RD 7)", hut was Louis II. HlIwthol'llc, 6. Louis H. Hawthol'lle was living at the time of the ahovc"referenccd sale by the Cumberlllnd County Commissioncrs, bllt subscquently died on March 25, 1952, having firsl mllde his Lust Willund Testllment, dated Septcmher 2!!, 1951. Lellers Testamentary were issucd hy the Rt\gister of Wills for Lawrence COUllty, Pennsylvania to his SOil. Samucl Phillip Hawthol'lle. of PillsbUl'gh, Allegheny County, Pennsylvania. A true and cOl'l'ect copy of the Last Will and Testament and Letters Testamentary are allached hereto and incorporated herein as Exhibit "C". 7. The ahove-deseribed rcal estate, 01' any intcrest therein, wus not specifically dcvised lind, therefore, was devised with all of the rcst, residue and remainder of the estate to Smlluel Phillip lIawth6l'1le, son of Louis 11, Hawthol'lle. 8. The whereabouts of Samuel Phillip Hawthorne lire unknown. No Samuel Hawthol'lle's are listed in the telephone directories for the Pittshurgh area. The Register of Wills of Allegheny County has no record of the prohating of an estate for Samuel Hawthorne. A true and correct copy of notification from the Register of Wills of Allegheny County is allachcd hereto and incorpomted herein as Exhibit "D". 9. David Louis Hawthol'lle, Defendant herein, is named in the Will of Louis H. Hawthol'lle as a grandson of Louis 11. Hawthol'lle, and may have been a son of Defendant Samuel Phillip Hawthorne, thereby being an heir if the said Samuel Phillip Hawthorne is now deceased. 10. Defendants claim an interest and estate in said property hy virtue of the possible fllilure of the uhove-deseribed sale of the Cumberland County Commissioners to give adequate and full notice to the record owner at thc time of the sale. This interest is adverse to Plaintiffs. Defendllnts' clllimis without any right whatever, und defendant has no right, estllte, title, lien, 01' interest in or to the property, 01' any pmt thereof. 11, Defendants, and euch of them, claim some estate, right, titlc, lien, or intcrcst in or to suid property advcrse to Pluintift's title, und said claim 01' c1uims constitute a cloud on Pluintiffs title to WHEREl<'ORE, Pluintiffs Pl'uy: I.
