letter (on May 3, 1999), warning that this ourrent Motion would be
forthooming if she did not reply to the discovery. (A copy of the
letter ill attached hereto as "Exhibit A."
4. As of the date of this Motion, Defendant has yet to
respond to the disoovery as required by law.
5. Defendant has willfully disregarded her obligation to
provide answers to discovery pursuant to the Pennsylvania Rules of
Civil Procedure. Thus, sanctions are appropriate in this case.
6. The purpose of Pa.R.C.P. 4019, which gives this Court
the power to award sanctions, "is to ensure adequate and prompt
discovery of matters allowed by the rules of civil procedure..."
Poulos v. Com.. DeDt. Qf TransDortation, 133 Pa.Commw. 322, ___,
575 A.2d 967, 969 (1990).
7. Defendant's refusal to provide any answers to
Plaintiff's discovery frustrates t.his purpose and is frivolous,
arbitrary and dilatory.
8. In the preparation and arguing of this Motion,
Plaintiff has incurred, and will further incur, attorney's fees
for which Defendant should be responsible due to her refusal to
answer the discovery.
9. As a sanction for Defendant's unreasonable and
unjustifiable conduct, and pursuant to Pa.R.C.P. 4019(a) (1) (i),
Defendant should be ordered to pay Plaintiff's reasonable
attorney's fees incurred in preparing and arguing this Motion.
10. In the alternative, plaintiff is entitled to recover
his attorney's foes incurred in the preparation and arguing of this
Motion from Defendant. pursuant to 42 Pa.C.S.A. S2503, whioh allows
the awarding of attorneys' fees against a party for "dilatory,
obdurate or vexatious conduot during the pendency of a matter." S
2503(6) and (7).
