3, On November 17, 1986, Defendants executed and delivered
to Plaintiff's predeoessor in interest a Promissory Note ("Note")
whereby Defendants promised to pay $600,000,00 plus interest and
upon the other terms set forth in the Note. A true" and correct
copy of the Note is attached hereto, incorporated herein by
reference, and marked as Exhibit "A".
4 . As securi t.y for the Note, Defendants executed and
delivered to Plaintiff's predecessor in interest a Mortgage on the
property located at 3780 E. Trindle Road, Camp Hill, PA 17011 (the
"Property"). A true and correct copy of the Mortgage is attached
hereto, incorporated herein by reference, and marked as Exhibj,t
"B",
5. The Note was endorsed to Plaintiff, and the Mortgage was
assigned to Plaintiff,
6, Defendants defaulted on their loan obligations under the
Note and Mortgage by failing to pay principal and interest as they
became due.
7, Due to Defendants' default, Plaintiff filed a Complaint
in Mortgage Foreclosure on April 4, 1996 in the Cumberland County
Court of Common Pleas against George J. Adams, Charles W. Junkins,
David J'. Remmel T/A Fallowffeld Associates C/O Investors
Development Group. A true and correct copy of the Mortgage
Foreclosure Complaint is attached hereto, incorporated herein by
reference, and marked as Exhibit "C". (without exhibJ.ts)

8, On July 18, 1996, the, Court entered an in f:gm judgment
against Defendant, David J. Remmel tl a Fallowfield Associates and
in favor of Plaintiff, in the amount of $783,370.75 in the Mortgage
Foreclosure Act.ion. A t.rue and correct copy of t.he in 1:\'Jll judgment
is attached hereto, incorporated herein by reference, and marked as
Exhibit "0".
9. On August. 19, 1996, the Court entered an .in, rem judgment
against Defendant, Charles W, Junkins tla Fallowfield Associates,
and in favor of Plaintiff, in the amount of $783,370.75 in the
Mortgage Foreclosure Act.ion. A true and correct copy of the in 1'~l1J
judgment is att.ached her'eto, incorporated herein by reference, and
marked as Exhibit "E",
10, On June 5, 1997, the Court entered an in nilll judgment
against Defendant, George J. Adams, and in favor of Plaintiff, in
the amount of $783,370.75 in the Mot"tgage Foreclosure Action, A
true and correct copy of t.he in reI!! judgment is attached hereto,
incorporated herein by reference, and marked as Exhibit "F".
11, On or about June 5, 1997, Plaintiff filed a Writ of
Execution directing the Sheriff of Cumberland County to levy on the
Property pursuant to the in rem judgment.
12, On November 5, 1998, the Cumberland County Sheriff held
a public sale of the Property, and Plaintiff purchased the Property
as judgment creditor at the sale.

16, Because the requested value of the Property is less
than pla:lntiff's in rem jUdgment, a deficiency jUdgment should be
entered as follows:

3. On 11./17/86, Defendants executed and delivered to
Plaintiff.'. predeceBlor in interest a Promissory Note ("Note")
whereby Defendants promised to pay $600,000.00 plus interest and
upon the other terms set forth in the Note. A true and correct
copy of the Note is attached hereto, incorporated herein by
reference, and marked as Exhibit "A".
4. As security for the Note, Defendants executed and
delivered to Plaintiff's predecessor in interest a Mortgage on the
property located at 3780 E. Trinnle Road, Camp Hill, PA 17011 (the
"Property"), A true and correct copy of the Mortgage is attached
hereto, incorporated herein bY reference, and marked as Exhibit
IIBlI,
5. The Note was endorsed to Plaintiff, as evidenced by the
endorsement which appears on the Note; the Mortgage was assigned
to Plaintiff,
6. Defendants defaulted on their loan obligations under the
Note and Mortgage by failing to pay principal and interest as they
became due,
7. Due to Defendants' default, Plaintiff filed a Complaint
in Mortgage Foreclosure on April 4, 1996 in the Cumberland County
Court of Common Pleas against George J. Adams, Charles W, Junkins,
David J. Remmel t/a Fallowfield Associates c/o Investors
Development Group. A true and correct copy of the Mortgage
Foreclosure Complaint is attached hereto, incorporated herein by
reference, and marked as Exhibit "C". (without exhibits)

8. On LTuly 18,1996, the Court entered an in rem judgment
against Defendant, David J. Remmel t/a Fallowfield Associates and
in favor of Plaintiff, in the amount of $783,370,75 in the Mortgage
Foreclosure Action. A true and correct copy of the ill r~ judgment
is attached hereto, incorporated herein by reference, and marked as
Exhibit "D".
9. On August 19, 1996, the Court entered an in rem
j udgmsnt against Defendant, Charles W. Junkins t/ a Fallowfield
Associates, and in favor of Plaintiff, in the amount of $783,370.75
in the Mortgage Foreclosure Action. A true and correct copy of t.he
in :ullil judgment is attached heret.o, incorporated herein by
reference, and marked as Exhibit "E",
10, On June 5, 1997, the Court entered an in rem judgment
against Defendant, George J. Adams, and in favor of Plaintiff, in
the amount of $783,370.75 in the Mortgage Foreclosure Action, A
true and correct copy of the in ~~ judgment is attached hereto,
incorporated herein by reference, and marked as Exhibi t "F",
11. On or about June 5, 1997, Plaintiff filed a Writ of
Execution directing the Sheriff of Cumberland County to levy on the
Property pursuant to the in ~em judgment,
12. On November 5, 1997, the Cumberland County Sheriff held
a public sale of the Property, and Plaintiff purchased the Property
as judgment creditor at the sale.
13. On December 23, 1997 the Sheriff executed a Deed of the

As indicated in Plaintiff's Petition to Fix Fair Market Value,
Defendants default.ed on their obligation under the Not.e and
Mortgage by failing to pay principal and interest as they became
due. Due t.o Defendants' default, Plaintiff filed a Complaint. in
Mortgage Foreclosure on April 4, 1996 against Defendant.s. The
Court ent.ered an in rem judgment in favor of Plainti f f, and
Plaintiff filed a Writ. of Execution directing t.he Cumberland County
Sheriff to levy upon the Property pursuant to Plaint.iff's in ~
judgment. The Sheriff held a public sale of the Property on
November 5, 1997, and Plaintiff purchased the Property as judgment
creditor at the sale. As the fair market value of the Propert.y
($440,000.00) is less than the amount of Plaintiff's il1 rem
judgment ($783,370.75), Plaintiff is pursuing Defendants under the
Deficiency Judgment Act.
The Pennsylvania Supreme Court enacted Rules of Civil
Procedure ef fecti ve January 1, 1997 to clarify the Def iciency
Judgment Act. 42 Pa.C.S.A, ~3276 et seq. Rule 3279 requires the
deficiency judgment proceeding to be comrilenced by filing a petition
under the docket number of the mortgage foreclosure aetion,

Defendant, David J. Remmel. In favor of Plaintiff In the amount of $783,370.75 in the
mortgage foreclosure action.
On June 5, 1997, having obtained judgments against all the named partners, Plaintiff
filed a Writ of Execution directing the Sheriff of Cumberland County to levy upon the
property pursuant to the in..!.!m! judgments entered against the Plaintiff. On November 5,
1997, the Cumberland County Sheriff held a public sale of the property, and Plaintiff
purchased the property as a judgment creditor for the sum of $450,000, On April 8, 1998,
Plaintiff then flied a Petition to Fix Fair Market Value pursuant to 42 Pa, C.S,A, fi8103,
which was docketed to the mortgage foreclosure action. That Petition has not yet been ruled
upon by the Court in the foreclosure action,
On the sarne day it filed the petition to fix fair market value, Plaintiff also filed a new
action enti(led "Complaint for Deficiency Judgment Pursuant to 42 Pa, C.S.A. fi8103"
against the Defendants named In the original foreclosure action apparently as an effort to
obtain an In personam judgment against the various defendants,
This action should be dismissed for multiple reasons as outlined in Defendant
Remmel's Preliminary Objections to the Complaint. Specifically, the amendment to the
Pennsylvania Rules of Civil Procedure which now allows a supplemental in Ilersonam action
against a judgment debtor in an ilu:\ml action to be prosecuted was not effective, or even
pending, at the time the Complaint was flied, or judgment entered, against Defendant
Remmel. Plaintiff cannot supplement his claim for relief based on a fortuitous rule change
that occurred after the action was filed and completed.

foreclosure proceeding; a petition for deficiency judgment pursuant to Section 8103 cannot be
brought In a mortgage foreclosure action because the judgment obtained in a mortgage
foreclosure action Is a judgment in...rm1).
The new procedural rules governing deficiency judgments, Pa,R.Civ.P, 3276 el seq.,
which became effective on January I, 1997, ostensibly did away with the so-called "Personal
Judgment Rule." The Committee's Explanatory Comment to the new rules states that they
"remove the Impediment to bringing a deficiency judgment proceeding supplementary to an
action In mortgage foreclosure." However, the new procedural rules did not go Into effect
until January I, J22:I., well after the commencement of the foreclosure action and entry of
judgment against Defendant Remmel. Accordingly, Defendant Remmel ShOllld be subject to
the state of the law at the time of entry of judgment against him, i.e., a deficiency judgment
could only be filed as a supplementary proceeding to an in personam judgment, not an in
wn judgment, such as Is present here.

of the time the cause arises, rights in procedural matters are determined by ilie laws In force
at the time of the Institution of the action." ~hladensk.Lv. Ellis, 442 Pa. 471, 275 A.2d
663, 664 (1971), The Superior Court came to the same conclusion, relying In part on
Pa.R.Civ.P. 152. ~ Duquesne L1iht Co, v. U.S. I~abrlcators, 334 Pa, Super, 444,
483 A.2d 534 (1984), In Duquesne Ll&h!, the appellant sought to have an amendment to a
rule removing certain constraints In pleading a counterclaim applicable to the pending case,

because the Court has not yet entered an order setting the fair market value of the property,
As Plaintiff itself has acknowledged in Exhibit I to. the Complaint, at pages 9.10, the action
cannot proceed until the Court fixes the fair market value of the property sold at foreclosure:
Rule 3286 prohibits the entry of an order pursuant to these rules which would
determine the personal liability of the respondent. Accordingly, once tile
Court fixes tile fair market value of tile property In tills proceeding (the action
docketed to 96-1823), Plaintiff will seck an .in oersonam deficiency jUdgment
against the Defendants in a separate action based on the Promissory Note,
Ripeness is defined as the presence of an actual controversy. See Bo.rough of
Centralla v. C.!!illmonwealth of Pennsylvania, 658 A,2d 840, 842 (Pa, Commw, 1995),
allocatur denied. It requires the Court to evaluate the fitness o.f the Issues for jUdicial
determination, as well as the hardship to the parties of withho.ldlng court consideration. ~
h!.., 658 A.2d at 842. Defendant Remmel has filed an answer to the Petition to. Fix Fair
Market Valne contending that the value of the real property as assigned by Plaintiff
($440,000,00) was based upon an appraisal which was inadequate and inco.mplete. The

3. On November 17, 1986, Defendants executed and delivered
to Pl~intitt's predecessor in interest a Promissory Note ("Note")
whereby Defendants promised c~ pay $600,000.00 plus interest and
upon the other terms set forch in the Note. A true and correct
copy of the Note is attached hereto, incorporated herein by
reference, and marked as Exhibit "A".
4. As security for the Note, Defendants executed and
delivered to Plaintiff's predecessor in interest a Mortgage on the
property located at 3780 E, Tcind~e Road, Camp Hill, PA 17011 (the
"Property"), A true and cocc8c: copy of the Mortgage is attached
hereto, incorporated herein by" ceference, and marked as Exhibit
IIBII,
5. The Note was endorsed to Plaintiff, and the Mortgage was
assigned to Plaintiff,
6. Defendants defaulted on their loan obligations under the
Note and Mortgage by failing to pay principal and interest as they
became due.
7. Due to Defendants' default, Plaintiff filed a Complaint
in Mortgage Foreclosure on April 4, 1996 in the Cumberland County
Court of Common pleas against George J. Adams, Charles W, Junkins,
David J. Remmel T /A Fallowfield Associates C/O Investors
Development Group. A true and correct copy of the Mortgage
Foreclosure Complaint is attached hereto, incorporated herein by
reference, and marked as Exhibit "C". (without exhibits)

8. On July 18, 1996, the Court. entered an in ~ judgment
against. Defendant, David J, Remmel tla Fallowfield AssQciates and
in favor of Plaintiff, in the amount of $783,370,75 in t,he Mortgage
Foreclosure Act.ion. A true and correct copy of the in ~ judgment
is at tached hereto, incorporated herein by reference, and marked as
Exhibit. "0".
9, On August 19, 1996, the Court entered an in rem judgment
against Defendant, Charles W. Junkins tla Fallowfield Associates,
and in favor of Plaintiff, in the amount of $783,370,75 in the
Mortgage Foreclosure Action, A true and correct copy of the in rem
judgment is at tached hereto, incorporated herein by refer'ence, and
marked as Exhibi t "E".
10. On June 5, 1997, the Court entered an in 1:.~l!! juC:gment
against Defendant, George J. Adams, and in favor of Plaintiff, in
the amount of $783,370.75 in the Mortgage Foreclosure Action. A
true and correct copy of the in rem judgment is attached hereto,
incorporated herein by reference, and marked as Exhibit "F".
11. On or about June 5, 1997, Plaintiff filed a Writ of
Execution directing the Sheriff of Cumberland County to levy on the
Prope1rty pursuant to the in rem judgment.
12. On November 5, 1998, the Cumberland County Sheriff held
a public sale of the Property, and Plaintiff purchased the Property
as Judgment creditor at the sale.

4. As security for t:'1e Note, Defendants executed and
delivered to Plaintiff's predecessor in interest a Mortgage on the
property located at 3780 E, Tri~dle Road, Camp Hill, PA 17011 (the
"Property"), A true and correct copy of the Mortgage is attached
hereto, incorporated herei:; by :::efe:::ence, and marked as Exhibit
"BII,
5 . The Note was endcrsed :0 ?IaintH f, as evidenced by the
endorsement which appears on the Note; the Mortgage was assigned
to Plaintiff.
6. Defendants defaulted on their loan obligations under the
Note and Mortgage by failing to pay principal and interest as they
became due.
7. Due to Defendants' de:ault, Plaintiff filed a Complaint
in Mortgage Foreclosure on April 4, 1996 in the Cumberland County
CoUrt of Common Pleas against George J. Adams, Charles W, Junkins,
David J. Remmel t/a Fallow:ield Associates c/o Investors
Development Group, A true and correct copy of the Mortgage
Foreclosure Complaint is attached hereto, incorporated herein by
reference, and marked as Exhibit "e". (without exhibits)

8. On July 18, 1.996, the Court Mtered an in nru judgment
~g~inat Defendant, David J. Remmel t/a Fallowfield Associates and
in favor of li'laIntifE, in the amount of $783,370,75 in the Mortgage
Foreclosure Action. A true and correct copy of the in ~rn judgment
is attached hereto, incorporated herein by reference, and marked as
Exhibit "D",
9. On August 19,1.996, the Court entered an 1n ~
judgment against Defendant, Charles W. Junkins tla Fallowfield
Associates, and in favor of Plaintiff, in the amount of $783,370.75
in the Mortgage Foreclosure Act ion. A true and correct copy of the
in rem judgment is attached hereto, i.ncorporated herein by
reference, and marked as Exhibi.t "E".
10. On June 5, 1997, the Court enter'ed an ill rem judgment
against Def.endant, George J. Adams, and in favor of Plaintiff, in
the amount of. $783,370.75 in the Mortgage Foreclosure Action. A
true and correct copy of the in rem judgment is at tached hereto,
incorporated herein by reference, and marked as EJI'..hibit "F".
11. On or about June 5, 1997, Plaintiff filed a Writ of
Execution directing the Sheriff of Cumberland County to levy on the
Property pursuant to the in rem judgment.
12. On November 5, 1997, the Cumberland County Sheriff held
a public sale of the Property, and PlaIntiff purchased the Property
as judgment creditor at the sale.
13. On December 23, 1997 the Sheriff executed a Deed of the
property to Plaintiff. A true and correct copy of the Deed is

The Pennsylvania Def iciency Judgment Act states, in pertinent
part, as follows:
Whenever any real property is sold, directly or
indirectly, to the judgment creditor in execut~on
proceedings and the price for which such property has
been sold is not sufficient to satisfy the amount of the
judgment, interest and costs and the judgment creditor
seeks to collect the balance due on said judgment,
interest and costs, the judgment creditor shall petition
the Court havi.ng jurisdiction to fix the fair market
value of the real property sold, The petition shall be
filed as a supplementary proceeding in the matter in
which the judgment was entered.

A petition to fix fair market value and set deficiency must be
filed within six months of the sale of mortgaged property. 42

The Pennsylvania Sup::-eme Court enacted Rules of Civil
proceciure effective January 1. 1997 to clarify the Deficiency
Judgment Act. 42 pa,C,S.A. 53276 et seq, Rule 3279 requires the
deficiency judgment proceeding to be commenced by filing a petition
under the docket number of the mortgage foreclosure a8tion.
Plaintiff's Petition contains all of the averments required by Rule
3282. Rule 3286 prohibits :~e entry of an order pursuant to these
rules which would determine the personal liability of the

the Defendants.1l
lliCUSSION
Plaintiff filed an action in mortgage forecl.osuro at 96-1823
Civil Term in April of 1996. It never pursued an action on the
note until the action currently before us. Plaintiff's failure
to bring a separate action upon the note before it obtained the
judgment in mortgage foreclosure and purchased the property at
Sheriff's sale has placed the parties in a procedural morass from
which we must now try to extricate them.
We first begin with a discussion of the difference between
an action J.n assumpsit based upon the note and an action in
mortgage foreclosure based upon the mortgage. An action in
assumpsit based upon the note is an in personam action which
seeks to impose personal Hability upon the makers of the note.
First Seneca Bank v. Greenville Distributina Co., 367 Pa. Super.
558/ 533 A.2d 157 (1987). An action in mortgage foreclosure
based upon the mortgage is an action in rem or de terris. The
sole purpose of an action in mortgage foreclosure is to obtain a
judgment upon which to effect a judicial sale of the mortgaged
property. Meco Realtv Co. Yi-Burns, 414 Pa. 495, 200 A.2d 869
(1964) .

If, as in the instant o&se, the jUdgment oreditor purchases
the mortgaged property at Sheriff's sale pursuant to a writ of
execution issued upon the 1n rem judgment in mortgage
foreclosure, the provisions of the Deficienoy Judgment Act, (42
fa. C.S.A. S B103) come into play. The Defioiency Judgment Act
provides in relevant part as follows:
S 8103. Deficiency judgment.
(a) General rule.-Whenever any real property is sold,
directly or indirectly, to the judgment creditor in
execution proceedings and the prioe for which such
property has been sold is not suffioient to satisfy the
amount of the jUdgment, interest and costs and the
judgment creditor seeks to colleot the balance due on
sald judgment, interest and costs, the jUdgment
creditor shall petition the court having jur:'isdiction
to fix the fair market v&lue of the real property sold.
The petition shall be filed as a supplementary
proceeding in the matter in which the judgment was
entered.
. . .
(d) Action in ab..nce of petition.-If the judgment
creditor shall fail to present a petition to fix the
fair market value of the real property sold within the
time after the sale of such real property provided by
section 5522 (relating to six months limitation), the
debtor... lRay file a petition, as a supplementary
proceeding in the matter .i.n which the judgment was
entered, in the court having jurisdiotion, sett.ing
forth the fact of the sale, and that no petition has
been filed within the time limited by statute after the
sale to fix the fair market value of the property sold,
whereupon the court, after notice as presoribed by
general rule, and being eatisfied of such facts, shall
direct the clerk to mark the judgment satisfied,
released and discharged.
42 Pa. C.S.A. S BI03(a)(d). The purpose of ths Defioiency
Judgment Act is to relieve a debtor from personal liability when
the real property taken by the judgment creditor has sufficient
value to allow the jUdgment oreditor to dispose of the property

3291.12 Those rules were speoifically adopted to "govern
prooeedings pursuant to Seotion 8103 of the Judioial Code, 42 Pa.
C.S.A. S BI03, relating to defioienoy jUdgments." Pa. R.C.P.
3276. The new rules define "judgment" to include "any jUdgment
whioh is subject to the provisions of Section BI03 of the
judioial code and inolude. a jUdgment de terris, a judgment in
rem and a judgment in per.onam." (emphasis added) Fa. R.C.P.
3277. The Note to Pa. R.C.P. 3277 speoifioally provides that:
This changes the practice under pri.or case law whioh
did not permit the filing of the proceeding
supplementary to a matter in which the jUdgment
obtained was not in personam.
Clearly under the new rules a peti.tion to fix fair market value
pursuant to S~otion B103(a) of the Judicial Code can now be filed
supplementary to an action in mortgage foreclosure.
Defendant's first preliminary objection attacks the validity
of the petition to fix fair market value filed to the action in
mortgage foreolosure at 96-1923 Civil Term. He argues that the
rules allowing euoh a petition to be filed were not adopted until
well after the Commencement of the foreclosure action. The
Defendant further argues that the procedural change effectuated
by the new rules applies only to actions filed after that date. 13

However, since the matter is not properly before us, we need not
address Defendant's arguments. No petition to fix fair market
value has been filed in the instant action. Any attack upon the
propriety of filing a petition to fix fair market value in the
fox'ealosure action must be made in that separate action.
Defendant further argues that even if the petition to fix
fair market value was appropriately filed in the mortgage
foreclosure action, it oannot impose personal liability upon him.
We agree with this position. The new rules specifically provide
that no order fixing the fair market value of property "shall
determine whether any respondent is personally liable to the
petitioner." Pa. R.C.P. 3286. Therefore, if the Plaintiff
wishes to impose personal liability upon any of the Defendants,
he must bring an action upon the note. See First Seneca Bank v.
Greenvi.lle Distributina Co., supra.
Plaintiff has titled his complaint as a "Complaint for
Deficiency Judgment Pursuant to 42 Pa. C.S.A. S 8103." While we
agree with Defendant that no such complaint may be brought under
Section BI03 of the Judicial Code,ll we must still deny his
preliminary objections.
14Section BI03(a) of the Judicial Code provides only for a
petition "to fJ.x the fair markat value of the real property
sold." The petition must be filed as a "supplementary proceeding
in the matter in which the judgment was enteJ:'ed." Obviously no
judgment has been entered in the instant action. Therefore,
nothing contemplated by Section 8103(a) can be filed to this term
and number at the current time.

A demurrer may be sustained only if, accepting as true all
well pleaded facts and reasonable inferences deducible therefrom,
it is clear and free from doubt that no recovery is possible.
McMahon v. Shjll\, 441 Pa. Super. 304, 657 A.2d 938 (1995). If the
faots as pleaded state a olaim for which relief may be granted
under any theory of law then the demurrer must be denied. County
of Alleahenv v. Commonwealth of ..1'1L.., 507 Pa. 360, 490 A.2d 402
(1985). The complaint need only state the material facts upon
which the cause of action is based i.n order to apprise the
Defendant of the nature and extent of Plaintiff's claim. Pa.
R.C.P. 1019(a). The Plaintiff is not required to identify the
legal theory upon which the complaint is based. Weiss v.
Eauibank, 313 Pa. Super. 446, 460 A.2d 271 (1983). Applying the
above standards to the oase at bar, we are satisfied that.
Plaintiff has alleged suffioient facts upon whioh to base an
aotion in assumpsit for nonpayment of the note. IS
