4. Subscquent tll the ACCld 11687212911 being issucd and Defenant receiving the
terms and condilions of said account, Defendant madc vmious purchases, in which
transactions Defendant made use of said charge account.
5. For valuc rcccived, Montgomcry Ward Credit Corporation (hereinafter
MWeC) assigned, transferred and set over to Unifund eeR Partners all its rights, title and
intercst said claim. Thercafter. for valuc receivl~d, Unifund eeR Partners, assigned,
transferred and set ovcr to Plaintiff all its rights. title and interest in said claim to Plaintiff.
6. By virtue of said assignmcnt, Plaintiff acquired legallitle to said Account, and
became the legal holder of the claim against the Defendant.
7. Defendant has not adhercd to thc agreed repayment obligations that govern the
aforesaid credit card account, by reason of which Dcfendant is in default thereof.
8. The Defendant received, accepted and made various purchases using the crcdit
card as described above, and a total principal amount which became due as a resuil thercof,
after allowance for all proper credits for payments and/or adjustments. if any. was $517.64.
9. Plaintiff is entitled to receive intcrest on the above amount determined by
applying the contractual interest rate of 18 % per annum to the past due balance. As of April
24, 1998 the total amount of interest due to plaintiff is $648.99.
10. Plaintiff is entitled to have the agrced interest charge continue to accrue as set
forth above, from April 24, 1998 on down to the date of judgment in this matter.
II. In accordance with the terms and conditions of the charge account, (Exhibit
"A" attached), Defendant further agreed to pay Plaintiff's reasonalbe attol'l1eys' fees incurred
in the collection of any balance due, which total $291.66.
12. The Plaintiff has madc demand against the Defcndant for the aforesaid sum,
but. Defendant failed or refused to pay the same 01' any part thcreof.
WHEREFORE, Plaintiff dcmands judgment against the Defendant for $1,458.29
together with the continually accruing interest charge at the agreed rate of 18 % per annum
from April 24, 1998, and cost of suit.
COUNT II
(Alternative to Count I - Unjust Enrichment)
13. Plaintiff incorporates the allegations of every paragraph enumerated above of
this Complaint as if said paragraphs were fully set forth here at length.
14. The goods, wares, merchandise, and/or services purchased by the Defedant,
with the credit supplied by MWCC, were received and acceptcd by thc Defcndant. The
Defendant received the benefit of such goods, wares, merchandise, and/or services without
full compensation to MWCC and/or Plaintiff.
15. At all times material herefo, Defendant was aware that MWCC was providing
the credit for the Defendant to purchase the aforesaid goods, wares, merchandise, and/or
services to Defendant, and that MWCC and/or Plaintiff expected to be paid for such.
16. At all times material hereto, D::fendant, with the aforesaid knowledge,
permitted MWCC to provide and/or extend further credit to permit Defendant to pruehase
said goods, wares, merchandise, and/or services, and to ineur damages.
17. At all times material hereto, the Defendant was unjustly enriched hy retaininu
the benefit of reeeiving said credit, goods, wares, merchandise, and/or services without
paying MWCC and/or Plaintiff fair and reasonable compensation.
18. By reason of the aforesaid unjust enrichment of Defendant at MWCC and
Plaintiff's expense, an implied contract exists between the Plaintiff and the Dcfl\lldanl, nnd
the Defendant is obligated to pay Plaintiff the Qlilll\!l!JJl ll1ffi.ili value of thl' vahw of the
credit, goods, wares, merchandise, and/or services purchascd, in the amount of $\ ,4~HJ9.
