WAIVER OF RIGH'!' TO [<'l1,E MECHANICS' limNS
WHEREAS, RICK P. GOODHART AND JOANN C. GOODBAR'!', Husband and
Wife, Owner (a) , of 13 Shagbark Lane, Carlisle, Pennsylvania
17013, entered into a contract with D Cully, Inc., tIn/d/b/a
C&C Construction of 509 Kedron Ave., Folsom, PA 19033 and 5"/45
Spring Road, Shermans Dale, PA 17090, to provide materials and
perform labor necessary for the construction of a dwelling house
upon a tract of. land situate in South Middleton Township,
Cumberland County, Pennsylvania, more particularly bounded and
described as follows:
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for
the consideration therein Bet forth, that neither the undersigned
Contractor, any subcontractor or material man, nor any other
person furnishing labor or materials to the said Contractor under
his contract, shall file a lien, commonly oalled a mechanics'
lien, for work done or materials furnished to the said building,
improvements or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County Prothonotary within ten (10) days after date,
in accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.
IN WITNESS WHEREOF, the said parties hereto, intending to be
legally bound hereby, have hereunto set their hands and seals

ALL THAT CER'!'AIN lot of land situate in South Middleton Township,
Cumberland County, Pennsylvania, bounded and described in
accordance with Final Subdivision plan for Phase No.3 of Plan
No. 3 of Joseph Manor, consisting of 2 sheets prepared by Fisher,
Mowery, Rosendale & Associates, Inc. dated June 28, 1995, revised
July 31, 1995, a copy of which is recorded in the hereinafter
named Recorder's Office in Plan Book 71, Page 128, as follows:
BEGINNING at an iron pin in t.he southwest.ern right-of-way of
cToseph Drive and the east.e/.1 corner of IJot 38 on the above-
described Plan; thence along said Lot 38 North 55 Degrees, 45
Minutes, 29 Seconds West 283.11 feet to an iron pin; thence along
lands now or formerly of Danny Z. Nehring and Jane E. Nehring,
North 45 deg'rees 13 minutes 33 seconds East 205.41 feet to;\n
iron pin; thence along the southern right-of-way line of Jenny
Drive on a line curving to the left having a radius of 1025.00
feet and an arc distance of 210.15 feet to an iron pin; thence
along the southern right-of-way line of Jenny Drive at the
intersection of Joseph Drive, on a line curving to the right
having a radius of 25.00 feet and an arc distance of 38.08 feet
to an iron pin; thence along the western right"of-way line of
said Joseph Drive South 30 degrees 44 minutes 57 seconds West
159.70 feet to an iron pin, the place of BEGINNING.
BEING Lot No. 37 on the above mentioned Final Subdivision plan
for Phase No. 3 of Plan No. 3 of Joseph Manor and containing 1.11
acres, more or less.
BEING the same premises which Raymond E. Diehl, et al. by deed
dated July 5, 1996 and recorded in the Office of the Recorder
of Deeds in and for cumberland County, Pennsylvnaia in Deed
Book 143, Page 949, granted and conveyed to Rick P. Goodhart and
JoAnn C. Goodhart, husband and wife.
