manner which confonns to the criteria set forth in ~40 I of the Pennsylvania Divorce
Code, and taking into account the following considerations: Any prior marriages ofthe
parties; the age, health, station, amount and sources of income, vocational skills,
employability, estate, liabilities and needs of each ofthc parties; the contributions ofellch
party; the opportunity of each party for future acquisition of capital assets and income; the
sources oflncome of each party, including, but not limited to, medical, retirement,
insurance or other benefits; the contribution or dissipation of each party in the acquisition,
preservation, depreciation or appreciation of marital property, including the contribution
of each party as homemaker; the value of the property set apart to each party; the standard
of living of the parties established during the marriage; and the economic circumstances
of each party at the time the division of property is to become effective.
The division of existing marital property is not intended by the parties to constitute
in anyway a sale or exchange of assets, The division of property under this Agreement
shall be in full satisfaction of all rights of equitable distribution of the parties.
2,02 Incorporation aDC: Merger, This Agreement shall be incorporated but not
merged in the decree of divorce contemplated herein. This Agreement shall survive any
action for divorce and decree of divorce and, unless otherwise set forth herein and shall
forever be binding and conclusive on the parties; and any independent action may be
brought, either at law or in equity, to enforce the tenns of this Agreement by either
Husband or Wife until it shall have been fully satisfied and perfonned. Any provisions

herein concerning property rights, alimony and counsel fees shall not be modifiable. The
considerations for this Agreement arc the mutual benefits to be obtained by both of the
parties hereto and the covcnants and agreements of each of the parties to the other. The
adequacy of the consideration for all agreements herein contained is stipulated, confessed
and admitted by the parties, and the parties intend to be legally bound hereby.
2,03 Agreement Predicated on Divorce. It is specifically understood and
agreed, by and between the parties hereto and each of the said parties does hereby Wi\fl'Uut
and represent to the other, that the execution and delivery of this Agreement is predicated
upon an agreement for prosecution to conclusion of thl;: pending action for divorce.
Nothing contained in this Agreement shall prevent or preclude either of the parties hereto
from commencing, instituting or prosecuting any action or actions for divorce, either
absolute or otherwise, upon just, legal and proper grounds; nor to prevent either party
from defending any such action which has been, mayor shall be instituted by the other
party, nor from making any just or proper defense thereto. It is warranted, covenanted
and rt.presented by Husband and Wife, each to the other, that this Agreement is lawful
and enforceable and this warranty, covenant and representation is made for the specific
purpose ofinducing Husband and Wife to execute the Agreement. Husband and Wife
each knowingly and understandingly hereby waive any and all possible claims that this
Agreement is, for any reason, illegal or for any reason whatsoever of public policy,
unenforceable in whole or in part. Husband and Wife do each hereby warrant, covenant

(d) The furniture, household goods and all other similar untitled personal property
have been divided to the mutual satisfaction of the parties hereto, and each of the parties
retains absolute ownership of such items in his or hcr possesnion or control at the: date of
this Agreement. The property shall be deemed to be in the possession or under the
control of either party if, in the case of tangible personal property, the item is physically
in the possession or control of the party at the time of the signing of this Agreement and,
in the case of intangible personal property, if any physical or written evidence of
ownership, such as passbook, checkbook, poHzy or certi ficate of insurance or other
similar writing is in the possession or control of the party, unless provided otherwise in
this Agreement;
(e) The parties will execute and deliver any documents necessary to fomlally
release their rights in or claims to the employee benefits, including without limitation,
employee pension and savings plans of the other. Specifically, Husband and Wife are
owners of pension plans and Thrift Savings Plans through their employment with the
Federal Government. Husband hereby waives any right, title or interest which he may
have in Wife's benefits, including any entitlement to survivor benefits. Wife hereby
waives any right, title or interest which she may have in Husband's benefits, including
any entitlement to survivor benefits. Each pnrty specifically waives any interest in post-
sepal'ation retirement benefits which were accrued by any means. Husband and Wife

agree to execute any documentation necessary to effectuate the terms of this provision
within len (10) days of a request to do so;
(I) The parties will executc and delivcr any documents nccessary to formally
release their rights and all claims to the life insurance of the other; and
(g) Within sixty (60) days of the date of closing on the sale of the marital
dwelling, the parties will execute and deliver any documents necessary to formally release
Husband's rights and all claims to a mobile home in which Wife's mother residcs and to
formally release Husband from all obligations on the loan that is securcd by thc mobile
horne. Immediatcly upon Husband's dischargc from the obligations of said loan, he shall
pay to Wife the sum of$5,829. The parties are joint obligors on thc loan for the mobilc
home in which Wife's mothcr resides. Wife agrces to be solely rcsponsible for the
payment of this obligation alld will indemnity and hold Husband harmless from said
obligation. Within sixty (60) days of the sale of the parties' marital home, Wife shall
refinance orotherwisc rcmove Husband's name fl'Om said obligation. Upon proof that he
is released from said obligation, Husband will cxecute any documcntation necessary to
transfer his interest in the mobile home to Wife or to a person at Wife's direction. In the
event that Wife has not released Husband's name from said obligation within sixty (60)
days of the execution of the Agreement, thc mobile home shall be sold; and Wife shall be
solely obligated for any outstanding indebtedness and shall indemnity and hold Husband
harmless from said obligations.

party's obligations to contribute to the support or malntenancc ofthe other.
(b) Thc Ordcr of October 8, 1998, docketed to No. 98-2013 in the Court of
Common Pleas of Cumberland County, Pcnn8ylvania. for alimony pendente lite shall be
terminated after the entry of a full and final Decree of Divorce and thc payment of all
payments and arrearages,ifany, due through the date of the Decrec in Divorce.
(c) In the event that either party becomes a dcbtor ill any bankruptcy or financial
reorganization proceedings of any kind while any obligations remain to be performed by
that party for the benefit of the other party pursuant to the provisions of this Agreement,
the debtor-spouse hereby waives, relcases and relinquishcs any right to claim any
exemption (whether granted under State or Fedi:rallaw) to any property remaining In the
dcbtor as a defense to any claim made pursuant hereto by the crcditor-spouse as set f0l1h
herein, including all attorney fees and costs incurred in the enforcement of this paragraph
or any other provision of this Agreement. No obligation created by this Agreement shall
be discharged or dischargeable, regardless ofFcderal or State law to the contrary, and
each party waives any and all right to assert that obligation hereunder as discharged or
dischargeable. The parties mutually agree that, in the cvent of bankruptcy or financial
reorganization proceedings by either party in the future, any monies to be paid to the other
party or to a third party, pursuant to the terms of this Agreement, shall constitute support
and maintenance and shall not be dischargcd in bankruptcy.

other lnstnlmcnt or document executed pursuant to this Agreement.
8.03 Subsequent Divorce. Nothing hcreln contained will be deemed to prevent
either of the parties from maintaining a suit for absolute divorcc against the other in any
jurisdiction based upon any past or future conduct of the other, nor to bar the other from
defending any such suit. In the event any such action is instituted or concluded, the
parties will be bound by all of the tenns of this Agrecment.
8.04 Waiver or Estate Claim. Exccptos otherwise herein provided, in the event
of the death of either party hereto, each party hereby waives, rcleases and relinquishes any
and all rights that he or she may have or may hereafter acquire as the other parties' spouse
under the present or future laws of /l1IY jurisdiction, as follows:
(a) to elect to take against the will or codicils of the other party now or hereafter
enforced;
(b) to share in the other parties' estate in cases of intestacy; and
(c) to act as executor or administrator of the other parties' estate.
8.05 No Debts and Indemnification, Each party represents and warrants to the
other that he or she will not incur any debt, obligation or other liability, other than those
already described in this Agrcement, on which the party is or may be liablc. Each party
covenants and agrees that if any claim, action 01' proceeding is hereafter initialed seeking
to hold the other party liable for any othcr debt, obligation, liability, act or omission of

such party or lor any obligation assumed by a party hcreunder, the party liable will, at his
or her sole cxpensc, dc/end the othcr against any claim or demand, whelher or not well-
founded, and that he or she will indcmnity and hold harmlcss the other party in respect to
all damages resulting there/rom. Tlle obligation created hcreunder will be payablc as
alimony so as to constitute an exception to discharge in bankruptcy.
8.06 Full D1selosure, Each party asserts that he or shc has made a full and
complcte disclosurc of all 01 the real and personal propcrty of whatsoever naturc and
wheresoever located belonging in anyway to cach of them, of all Sources and amounts of
income received or receivable by each party, and of cvery other fact relating in anyway to
the subject matter of this Agreement. These disclosures are part of the considerations
made by each party for entering into this Agreement,
8.07 Right to Live Separately and Free from Interference. Each party will live
separately and apart from the other at any place or places that he or she may select.
Ncither party will molest, harass, annoy, injure, threaten or interfere with the other party
in any manner whatsoevcr. Each party may carry on and engage in any cmployment,
profession, business or other activity as he or shc may deem advisable for his or her sole
use and benefit. Neither party will intcrferc with the use, ownership, enjoyment or
disposition of any property now owned or hereaftcr acquired by the other.
8.08 Agreement Voluntary and Clearly Understood, Each party to this
Agrcement acknowledges and declares that he or she, rcspectivcly:

(a) Is fully and completely Informed as to thc facts relating to the subject matter of
this Agreemcnt and as to the rights and liabilities of both partk1s;
(0) Entcrs into this Agrecment voluntarily after receiving the advicc of
independent counselor, having had thc opportunity to do so, having dccided not to do so;
(c) Has givcn careful and mature thought to the making of this Agrcement;
(d) Has carefully read each provision of this Agreemcnt; and
(e) Fully and completely understands each provision of this Agreement, both as to
the subject matter and legal effect.
8.09 Compliance. Thc parties will cxecute and deliver any documents necessary
to formally conclude any of their obligations under thc terms of this Agreement to each
other.
8.10 Default. Ifeithcr party fails in thc due performance of any of his or her
material obligations hereunder, the party not in default will have the right to act against
the other, at his or her clection, to sue for damages for breach hereof, or to rescind this
Agreement or seek such other legal remcdi,es as may be available to either party. Nothing
herein shall be construed to restrict or impair cither party in the exercise of this clection.
8.11 Amendment or Modincatloll. This Agreement may be amended or
modified only by a written instrument signed by both parties.

8.12 Law Gonrnlng Agreement. This Agreement will be governed by and will
be constroed in accordance with the laws of the Commonwealth ()fPennsylvania in effcct
at the date of exccution hcreof,
8.13 Reconciliation. In the event of reconciliation, attcmpted reconciliation or
other cohabitation of the partics hereto aftcr thc date of this Agreement, this Agreement
shall remain in full force and cffcct in the abscnce of a written Agreement signed by both
parties hereto expressly setting forth that this Agreement has been rcvoked or modified.
IN WITNESS WHEREOF, the parties hercto have hcreunto set their hands and
seals, intending to bc legally bound hereby, thc day and year first above written.

this Agrecrnent. The propcrty shall be deemed to be in the possession or under the

in thc possession or control of the party at the time of the signing of this Agreement and,
in the case ofintanglble personal property, jfany physical or written evidence of

similar writing is in the possession or control of the party, unless provided otherwise in
this Agreement;
(e) The parties will execute and deliver any documents necessary to formally
release their rights in or claims to the employee benefits, including without limitation,
employee pension and savings plans of the other. Specifically, Husband and Wife are
owners of pension plans and Thrift Savings Plans through their employment with the
Federal Government. Husband hereby waives any right, title or interest which he may
have in Wife's benefits, including any entitlement to survivor benefits. Wife hereby
waives any right, title or interest which she may have in Husband's benefits, including
any entitlement to survivor benefits. Each party specifically waives any interest in post.

party's obligations to contribute to the support or maintenance of the other.
(b) The Order of Or,tober 8, 1998, docketed to No. 98-2013 in the Court of
Common Pleas of Cumberland County, Pennsylvania, for alimony pendente /lte shall be
tennlnated after the entry of a full and fmal Decree ofDivon:e and the payment of all
payments and arrearages, if any, due through thc date of the Decree in Divorce.
(c) In the event that either party becomes a debtor in any bankruptcy or fmancial
reorganization proceedings of any kind while any obligations remain to be perfonned by
that party for the benefit of the other party pursuant to the provisions of this Agreement,
the debtor-spouse hereby waives, releases and relinquishes any right to claim any
exemption (whether granted under State or Federal law) to any property remaining in the
debtor as a defense to any claim made pursuant hereto by the creditor-spouse as set forth
herein, including all attorney fees and costs incurred in the enforcement of this paragraph
or any other provision of this Agreement. No obligation created by this Agreement shall
be discharged or dischargeable, regardless of Federal or State law to the contrary, and
each party waives any and all right to assert that obligation hereunder as discharged or
dischargeable. The parties mutually agree that, in the event of bankruptcy or financial
reorganization proceedings by either party in the future, any monies to be paid to the other
party or to a third party, pursuant to the tcnns of this Agrecment, Shltlll,;ollslitutc support
and maintenance and shall not be discharged in bankruptcy.

8.03 Subsequent D1voree. Nothing herein contained will be deemed to prevent
either of the parties from maintaining a suit for absolute divorce against the other in any
jurisdiction based upon any past or future conduct of the other, nor to bar the other from
defending any such suit. In the event any such action is instituted or concluded, the
parlles will be bound by all of the tenns of this Agreement.
8.04 Waiver of Estate Claim. Except as otherwise herein provided, in the event
of the death of either party hereto, each party hereby waives, releases and relinquishes lIlIY
and all rights that he or she may have or may hereafter acquire as the other parties' spouse
under the present or future laws of any jurisdiction, as follows:
(a) to elect to take against the will or codicils of the other party now or hereafter
tlnforced;
(b) to share in the other parties' estate in cases of intestacy; and
(c) to act as executor or administrator of the other parties' estate.
8.05 No Debt. and Indemnification. Each party represents and warrants to the
other that he or she will not incur any debt, obligation or other liability, other than those
already described in this Agreement, on which the party is or may be liable. Each party
covenants and agrees that if any claim, action or procceding is hereafter initiated seeking

(a) Is fully and completely Informed as to the facts relating to the subject matter of
this Agreement and as to the rights and liabilities of both parties;
(b) Enters into this Agreement voluntarily after receiving the advice of
Independent counselor, having had the opportwlity to do so, having decided not to do so;
(0) Has given careful and mature thought to the maklng of this Agreement;
(d) Has carefully read each provision of this Agrccment; and
(e) Fully and completely understands each pf<\vision of this Agreement, both as to
the subject matter and legal effect.
8.09 Compliance. The parties will cxecute and deliver any documents necessary
to formally conclude any of their obligations under the terms of this Agrccment to each
other.
8.10 Default. If either party falls in the due performance of any of his or her
material obligations hereunder, the party not in default will have the right to act against
the other, at his or her election, to sue for damages for breach hereof, or to rescind this
Agreement or seek such other legal remedies as may be available to either party. Nothing
herein shall be construed to restrict or impair either party in the exercise of this election.
8.1 I Amendment or Modification. This Agreement may be amended or
modified only by a written instnlment signed by both parties.

(a) The Father has been the primary caretaker of the child since his birth.
Prior to the parties separation on April 10, 1998, the Mother on numerous occasions
declined the opportLlnity to spend time with the child and left him with the Falher for
care. The Mother has been verbally and physically abusive to the child, as well as
emollonelly distancing herself from the child.
(b) The Mother attempted to remove the young child from the only home
that he has known since birth and the company of his brother and his Father. This
move was made suddenly and without any notice to the Father. The Mother has
refused to enter into a court order to bring stability to the situation pending the
conciliation conference on May 21, 1998 unless the Father concedes to a shared
custody arrangement. Father believes that this is not in his son's best interest and has
proposed an alternating weekend and week night schedule. Father has also told
Mother that the child is afraid of and does not wish to spend time with a certain
individual, and Mother has declined to consider this request. Father wants to be
accommodating to permit "frequent and continuing contact and physical contact"
between Billy and his Mother. 23 PACSA 5303 (a).
8. Each parent whose parental rights to the child have not been
terminated and the person who has physical custody of the child have been named as
parties to this action. All other persons, named below, who are known to have or claim
a right to custody or visitation of the child will be given notice of the pendency of this

case. For pUl:'poses of--cFie Hearing, the Mother shall be deemed to be the
movIng party and shall pl:oceed initially with testimony. Counsel for the
parties shall file with the Court and opposing counsel a Memorandum setting
forth each party's position on custody, a list of witnesses who will be
called to testify at the Hearing, and a sURrnary of the anticipated
testimony of each witness. These Memol:'anda shall be filed at least ten
(10) days prior to the scheduled Hearing date.
2. The Mothel:' shall cooperate in par:ticipating in and in making the
Child available for: a Psychological/custody evaluation to be pel:'formed by a
pl:'ofessional selected by the Fathel' wi th appl:'Oval of the Mother and her
counsel. The pUl:'pose of the evaluation shall be to obtain an independent
opinion and reconrnendation with regard to custody arrangements which will
be in the best intel:'est of the Child. The pal:'ties shall sign all necessal:'Y
I:'eleases and authorizations for the evaluator to obtain information
pertaining to the parties and the Child. The Father shall be responsible
fOt' all cnsts of the evaluation but I:'eserves the right to petition the
Court for an Order allocating costs between the parties.
3. Pending further Order of Court or agr.eement of the partIes, the
prior Order of this Court dated May 4, 1998 shall continue in effect.

1. The pertinent information concerni.ng the Child who is the
subject of this litigation is as follows:

2. ^ Conciliation Conference was held on May 21, 1998, with the
following individuals in attendance: The Mother, Cathy J. Brewer, with her
counsel, Wayne F. Shade, Esquire, and the Father, William S. Brewer, II,
with his counsel, Robet.t L. O'Brien, Esquire. The paternal grandparents
also attended the Conference with the Mother's consent.
3. While the Mother would agree to a shared custody arrangement,
the Father wished to pursue his request for primary physical custody. The
Father requested, and the Mother agreed to participate in, a custody
evaluation. The Father's counsel requested a Hearing in the event the
parties are not able to reach an agreement after the evaluator issues a
report to prevent any further delay in obtaining a Court Order, if
necessary. This COllrt previously issued a temporary Order in this matter
on May 4, 1998 in response to the Father's Emergency Petition for CUstody.
The temporary Order awarded shared physical custody of the d1ild.
4. The Mother's position on custody is as follows: The Mother
believes the Child has been doing well under the existing shared custody
arrangement (Sunday through Wednesday wi th Mother and 'l'hursday through
Sunday with Father) but proposed that the parties share custody on a weekly
basis so that each party could have full weekends with the Child. The
Mother denied the Father's allegation that he has been the prImary
caretaker of the Child. The Mother agreed to cooperate in a custody
evaluation but believes it is not necessary.
5. The Father's position on custody is as follows: The Father
seeks primary physical custody of the Child and belie~'es it is in the
Child's best interest to have a stable pt'imary residence. The Father
proposed that the Mother could have partial physical custody on alternating

June 30, 1998, Hushnnd physically assaulted Wile. Charges of simple assault and
harassment were filed against Hushand by the Silver Spring Township Police
DepllrtmcnL With the coopel'lltion of Wife and Officcl' Burger ofthc Silver Spring
Township Police Department, Husband WllS pcrmitted to plead guilly to hllrassment in llJII
satisfaction of both chargcs so thai he would not lose his emploYlTlcnt. lIe paid a Iinc and
costs. Therealler, Husband continued to harass Wile with frequent and threatening
telephone calls at all limes of the day and night. As a result ol'that misconduct, Wifc
filed a Petition for Protection from Abuse. Aller a conlcstcd hcaring bcfbre Judge Buyley
in which Husbund wus represented by counsel, Judge Baylcy cntcl'cd a protcctivll Order
on October] 3, 1998. Hushand has been hospitalized under sulcidc watch ut least four
times since the date of sepUl'lltion.

Departments; and the Chief Legal Advisors to the JCS and the Unified and Specified
Commands, with regard to their respective Components, are authorized. after
consulting and coordinating with the appropriate Department of Justice litigation
attorneys, as required. to detennine whether offioial information originated by the
Component may be released in litigation; whether 000 persoMcl assigned 10 or

contacted i., or, for fanner personnel, was last assigned, In appropriate cases, the
responsible 000 offioial shall thereupon notify the Department of Justice of the
request or demands, After due consultation and coordination with the Department of
Justice, as required, the DoD ollicial shall determine whether the individual is required

1, The parties will share legal custody of William Hunter Brewer (DOB: 04/28/92).
2. Plaintiff ("Mother") shall maintain primary physical custody,

4, Defendant ("Father") will have partial physical custody as follows:
a, in 2000, from July 8 to the end of July or the beginning of
August, but no later than August 2,
b, in 2000, and in all even-numbered years thereafter, for the
Thanksgiving holiday, as defined by the school calendar.

the parties anticipate will fall in the third weck of February,
depending on the school calendar,

after the last day of class for a minimum of four (4) and a
