6. Delendants refllsed to pay the lUli rent fol' the month of September, 1997,
but did pay $40.00.
7. Defendants were provided with a lUll tank of heating 011 at the beginning of
the lease term for .the property and it was agreed that if and when the lease ended,
Defendants wOllld filltbe oil tank.
8. Plaintim flied a Landlord Tenant Complaint against Defendants for failure
to pay rent on a timely basis and failure to pay back rent.
9. PlalntilTs were awarded a judgment for back relit and costs which has been
appealed.

Defendants vacated the propel'ty on or about April 15. 1998.
Defendants owe back rent in the amount of$I,747.50.
When Defendants vacated the property, they refused to fill the oil tank with
PlaintilTs expended $2] 4.15 for the filling of the oil tank.
Defendants caused severe damage to Plaintiffs' property as follows:
a. intentionally disconnecting all phone and cable lines and extension
outlets and pushing the wires into the walls and/or !loors;
b. damage to walls;
c. damage to outside light fixtures;
d. removal of all curtain hardware; and
e. leaving property in an unclean manner necessitating general and specific
cleaning.
IS. Plaintiffs have or will expend $250.00 for damages caused to the property.
WHEREFORE, PlaintilTs pray this Honorable Court enter a Judgment in their
favor in the amount of $2,211.65 together with filing fees and service costs totaling

The averments of fact contained in paragraph four (4) orthc Complaint arc denied. On
the contrary, the defendants began residing at the property in Januury of 19%. The plaintiffs also
agreed to suspend rental payment from the date that Robel1 Stinc injured his back while working
on behalf of the plaintiff until his return to work in September of 1997.

The averments of fact contained in paragraph five of the Complaint are specifically
denied. On the contrary, the plaintiffs agreed not to seck rental payments for the months of June
through September 1997.

The averments of fact contained in paragraph six (6) of the Complaint are specifically
denied. On the contrary, the plaintiffs sought the immediate removal of the defendants by the
plaintiffs in order lor their daughter to move into said mobile home. At considerable time and
expense, the defendants moved from the trailer as soon as they were able to do so in April

The averments offact contained in paragraph seven (7) of the Complaint are specifically
denied. On .the contrary, the defendants never agreed to fill the oil tank when the lease ended.
There was no written lease between the parties since the plaintiffs never prepared a written lease.

In June of 1997, the defendant, Robert Stine, Injured his back while working on behalf of
the plaintift:q in order to move an old mobile home away Irom their property.

After the plaintiff discovered the nature of the defendant's injuries, they promised that no
. rent would be payable until Mr. Stine was able to return 10 work. Mr, Stine returned to work in
September of 1997,

The defendants never agreed to pay to refill the oil tank for the mobile home.

The defendants did their best to clean the trailer, but the plaintiffs kept urging the
defendants to leave the trailer as soon as possible. They never notified the defendant
of any damages nor arc the plaintiffs entitled to any legal fees.

The plaintiffs are entitled to wages for the labor supplied to the plaintiffs to Initially clean
and later move the original mobile home,

17. Denied. Plaintiff. supplied a written lease to Defendants on several
occasions and Defendants refused to execute the same and return it to Plaintiffs.
18. This averment is a conclusion of law to which no response is required. To
the extent the averment contains factual averments, after a reasonable investigation.
Plaintiffs are unable to determine the truth or falsity of such averment and therefore
demand specific proof thereof.
19. Admitted in pllt, denied in part. It is admitted that Mr. Stine was injured
while helping Mr. Calaman replace the mobile home in which the Defendants were
residing with . newer mobile home in which Defendants would be residing. It is denied
that any home was moved away or off Plaintiffs' property.
20. Admitted in part, denied in part. It is admitted that Plaintiffs agreed that
they would defer payment of rent until Mr. Stine returned to work, however, it is denied
that · promise was made that no rent would be payable while Mr. Stine was off work.
Plaintiffs. after reasonable investigation, are unable to ascertain the truth or falsity as to
