IN RE: PRETRIAL CONFERENCE
A pretrial conference was held in the
chambers of JUdge Oler in the above-captioned case on
Wednesday, June 23, 1999. Present on behalf of the
Plaintiff was George B. Faller, Jr., Esquire. Present on
behalf of the Defendants was George C. Werner, Esquire.
This is a negligence action for personal
injuries arising out of a motor vehicle accident in Enola on
October 8, 1996, which occurred as Defendants' decedent
started to make a left turn and Plaintiff Terry L. Sola,
approaching in another vehicle, struck her; Defendants'
decedent died in the accident; Mr. Sola's foot was allegedly
injured. Plaintiff Patsy J. Sola sues for loss of
consortium. Defenses include a lack of negligence and
contributory negligence.
This will be a jury trial in which each side
will have four peren~tory challenges, for a total of eight.
The estimated duration of trial is three days.
By sepa~ate order of court of eVen date
herewith, a continuance motion filed by the Defendants will
be granted, [o'or purposes of future referenc!'J, the Court has
indicated that a future pretrial conference order would
probably include the following directions: (1) in the event
that any deposition testimony is to be shown or read to the
jury and contains objections being pursued by counsel, a
copy of the transcript of such testimony, with the areas of
objection being pursued highIighted and accompanied by
brief memoranda in support of their respective positions,
shall be submitted to the trial court at least five days
prior to commencement of the trial term; (2) the
admissibility of evidence of a second personal injury action
being maintained by Plaintiff Terry L, Sola will be
relegated to a determination by the trial judge, with the
understanding that Defendants' counsel will not elicit such
testimony other than for purposes of impeachment and will
not do so prior to obtaining permission of the trial judge
at side bar; and (3) the admissibility of evidence of
Plaintiff's use of painkillers at the time of the accident
will be relegated to a determination by the trial judge,
with the understanding that Defendants' counsel will not
elicit such testimony without first securing the permissiof)
of the trial judge at side bar.
With respect to settlement negotiations,

4, On or about October 21, 1996 Defendants Pauline Allison and Beth Sider were
granted Letters Testamentary on behalf of the Estate of Maybelle R, Kanode, Deceased. (See
Exhibit "A" attached hereto,)
S, The facts and occuO'ences hereinafter related took place on or about October 8, 1996
at approximately 10:OS a,m, at the intersection of Center Strect and the entrance to Pmlnsylvania
Blue Shield, East Pennsboro Township, Cumbt1rland County, Pennsylvania,
6, At the aforesaid time and place, Plaintiff Terry Sola was Ilperating his motor vehicle,
a 1994 Oldsmobile, traveling southbound on Center Street.
7, At the aforesaid time and place, Defendants' decedent, Maybelle R, Kanode, was
operating a 1983 Dodge Aries northbound on Center Street.
8. At the aforcsaid timc and placc, Maybelle R. Kanode attempted to make a left turn
cutting directly in thc path of PlaintiffTcrry Sola,

I. Plaintiffs Terry L. Sola and Patsy J. Sola are adult individuals who reside at 1036
Dogwood Lane, Enola, Pennsylvania 17025.
2, Defendant Pauline Allison is an adult individual who resides at R. D, #5, Box 448,
Mifflintown, Pennsylvania 17059.
3, Defendant Beth Sider is an adult individual who resides at \09 Fileys Road,
Dillsburg, Pennsylvania 17\09,
4, On or about October 21, 1996 Dcfendants Pauline Allison and Beth Sider were
granted Letters Testamentary on behalf of the Estate of Maybelle R. Kanode, Deceased, (See
Exhibit "A" attached hereto,)
5. The facts and Occurrences hereinafter related took place on or about October 8, 1996
at approximately 10:05 a,m, at the intersection of Center Street and the entrance to Pennsylvania
Blue Shield, East Pennsboro Township, Cumberland County, Pennsylvania,
6, At the aforesaid time and place, Plaintiff Terry Sola was operating his Illotor vehicle,
a 1994 Oldsmobile, traveling southbound on Center Street.
7, At the aforesaid time and place, Defendants' deccdent, Maybelle R. Kanode, was
operating a 1983 Dodge Aries nOl1hbound on Center Street.
8, At the aforesaid time and place, Maybelle R, Kanode attempted to make a left turn
cutting directly in the path of Plaintiff Terry Sola,
9, At the aforesaid time and place, as a result of Maybelle R. Kanode not yielding the
right-of-way, PlaintiffTerry Sola violently collided with Maybelle Kanode's automobile,
10, The foregoing IIccldent IInd 1111 of the injuries IInd damages set forth hereinafter
sustained by PlaintiffTel'l)' Sola ure the dircct and proximutc result of the negligent, cureless, and
reckless munner in which Defendants' Dcccdcnt opcrated her motor vchiclc us follows:
u, Fuilurc to have her vehicle under such control as to be able to stop within the assured
clear distance ahead;
b, Fuilure to keep alert and muintain a propel' watch for the presence of other motol'
vehicles on the highway;
c, Failure to stay within her lane of travel;
d, Failure to comply with Section 3334 of the Pennsylvania Motor Vehicle Code
concerning turning movements and required signals;
e, Failure to yield the right-of-way to Plaintiff Sola's vehicle in violation of Section
3322 of the Pennsylvania Motor Vehicle Code;
f, Failure to keep a propel' watch for traffic on the highway;
g, Failure to drive her vehicle with due regard for the highway and traffic conditions
which were existing and ofwhich she was or should have been aware;
h, Failure to keep proper and adequate control over her vehicle; and
i. Driving her vehicle upon the highway in a manner endangering persons and property
and in a reckless manner with careless disregard to the rights and safety of others and
in violation of the Motor Vehicle Code of the Commonwealth of Pennsylvania,
11, As a result of the accident and Defendants' Decedent's negligence, Plaintiff Terry
J, Sola sustained painful and severe and pennanent injuries
12, By reason of the aforesaid injuries sustained by PlaintiffTerry Sola, he was forced
to incur liability for medical treatment, medications, hospitalizations and similar miscellaneous
expenses,
13. Because of the nature of his injuries, Plaintiff Terry Sola has been advised and,
therefore, avers that he mUY be forced to incur similar expenses in the future, and claim is made
therefor,

14. As a result ofthe uforemenlioned injuries, PluintiffTeny Solu hus undergone um! in
the future will undergo great physical and mentul suffering, great inconveniencc in currying oul his
duily activities, loss of life's pleasures und enjoyment, und claim is mude therefor,
15, As u result of the uforementioned injuries, Plaintiff Terry Sola has been und in the
future will be subject to great humiliution and emburrassmcnt, and claim is made thercfor,
16, As a result of the aforementioned injuries, PlaintiffTcrry Sola has sustuined work
loss, loss of opportunity, and a permanent diminution of his eaming power and capacity, and claim
is made therefor,
17. As a result ofthc aforesaid injurics, PlaintiffTcrry Sola has sustained uncompensated
work loss, and claim is made therefor,
18, PluintiffTeny Solu continues to be plugucd by persistent pain and limitation and,
therefore, uvers that his injuries are of a penn anent nature, causing residual problems for the
remainder of his IW,time, und claim is madc therefor,
WHEREFORE, Plaintiffs demand judgment against Defendants in an amount in excess of
Twenty-Five Thousand Dollars ($25,000,00) exclusive of interest and costs and in excess of any
Jurisdictional amount requiring compulsory arbitration,

20. Patsy J, Sola avers that she is the wife of Terry 1. Sola, above Plaintiff.
21. As the result of the negligence of Maybelle Kanode resulting ininjutics to said
Spouse, as set forth ubove, said Patsy J. Sola has bcen obliged to expend various sums of money for
medicines and medical attention in and about endeavoring to treat and cure said Spouse of his
injuries and she will be required to expend large sums of money for the same purpose in the future.
22, Further, by reason of the aforesaid, the Plaintiff Patsy Sola has been deprived of the
love, affection, consortium, assistance and society of her husband, all of which has been to her great
financial damage and loss,

1, This is an action for personal injuries to the Plaintiff as the result of an automobile
accident which occurred on Octobcr 8, 1996,

3, Plaintiffs also served a Request for Production of Documcnts on the Defendants on

4, Dcfendants have failed to answer or objcct to the Intcrrogatories despite numerous
requests from Plaintiffs' counsel and despite the passage of nearly five months,
5, Defendants have produced what was purported to be their cntire file, but has not
served a fonnal response to the Rcquest for Production of Documents despite the passage of nearly
five months,
6, On October 22, 1998 the depositions of all of the relcvant parties and witnesses were
scheduled to occur on Tuesday. Decembcr 22, 1998. The dcpositions were scheduled two months
in advance due to that bcing thc first available date for Defendants' counsel.
7, It is imperative that Plaintiffs have thc Answers to Interrogatorics prior to the
deposition scheduled for Deecmber 22, 1998 and rescheduling those depositions would cause
substantial delay and hardship to the Plaintiffs,

was a fracture/dislocation of hiS tight ankle, The ankle!I\iury required. ,wslea! trealment, and
Sola's primary treating health cue provider was an orthopedic 5U1'ICOn,

6. Plaintift's' oounsel has provided Deftl'ndanls' counsel with some pre1iminary office
note. of Dr. Bream.
7. Plaintiffs' counsel h811 infol1'llcd Defendants' counsellhat Plaintiff Terry Sola
underwent surgmy for 1hi. condition in early June, and that the surgioal procedure, the findin&.
during .urllery, and the follow-up from this surgery will be topics to be disolUised by Dr. Bream
and clements orSola's d4mage olaim.
8. The videotapetriaJ deposition of Dr. Bream is scheduled for WednCllday, June 23,
1999.
9. To date, Plaintiffs' counsel has not been able to obtain, and conaequently has not heM
able to provide Defendants' cOl1/l!lel with, Dr. Bream's surgical records and fol!ow-\lp records.
10. Defendants' counsel oannot adequately prepare Cor the deposition of Dr. Bream
without the records and without the opportunity of having the records reviewed by Defendants'
examinins physioian.
11. Accordingly, Defendants' oounsel rc."cctiWly requests that this Court enter an Order
oontinuin& the deposition of Dr. Bream until Dr. Bream's entire file is produced, with sufficient
time to prepare for his deposition.
12. Defendants' counsel further requests tbat thls matter be removed from the July trial
term, sinoe there is not now BUfficient time to Dbtain Dr. Bream's records, have them reviewed,
schedule the deposition ofDr. Bream and schedule the depositioD ofDefendanlS' examinln.
