STIPULATION AGAINST LIENS

THIS AGREF.MENT made the _~"U"___ day of April, 1998, by and between CHARLES
M. KELSO, hereinafter referred to as Contmctor, and MICHAEL E, KITZMILLER and LISA K,
KITZMILLER, husband and wife, hereinafter referred to as Owner, whereby the former
undertakes and agrees to erect and construct a single family dwelling on:
ALL THE FOLLOWING described real estate, lying and being situate in Hopewell
Township, Cumberland County, Pennsylvania, bounded and limited as follows:
BEGINNING at a railroad spike in Township Route 385, at corner of Lot No, 3 on
a land subdivision hereinafter referred to; thence by the centerline of Township Route 385,
North 38 degrees 30 minutes 54 seconds East, 125 feet to a railroad spi:<e at corner of Lot No.
S on a land subdivision hereinafter referred to; thence by Lot No.5 through an iron pin on line,
South 61 degrees 15 minutes 36 seconds East, 275 feet to an iron pin at other lands now or
formerly of Charles ./' Kelley and Tania Kelley, husband and wife; thence by other lands now
or formerly of Churles J. Kelley and Tania Kelley, husband and wife, South 38 degrees 30
minutes 54 seconds West, 125 feet to an iron pin at corner of Lot No.3 on a land subdivision
hereinafter referred to; thence by Lot No.3, North 61 degrees 15 minutes 36 seconds West,
275 feet to a railroad spike, the Place of BEGINNING,
CONTAINING 33,876 square feet and BEING Lot No.4 on a land subdivision for
Charleo J, Kelley, by Carl D.Bflrt, Registered Surveyor, dated April 29, 1982, and recorded
among the records of Cumberland County, Pennsylvania, in Plan Book 41, Page 137.
BEING the same property which Joe Bill Kelley and Nancy T. Kelley, husband and
wife, by their Deed dated October 11, 1996, and recorded in the Office of the Recorder of
Deeds in and for CI.lmberland County, in Deed Book 147, Page 983, granted and conveyed unto
Michael E. Kitzmiller and Lisa K. Kitzmiller, husband and wife,
NOW THEREFORE, THIS AGRF.EMENT WITNESSETH: That the said Contractor, for and
in consideration of the sum of One and 00/100 ($1.00) Dollar to him in hand paid by Owner,
the receipt whereof is hereby acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims thereto for or on account
of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of thfl said buildings on the
lot above describod, and the said Contractor, for themselves, their subcontractors and others
under them hereby expressly waive and relinquish the right to have, file and maintain any
mechanic's liens or claims against the said buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent covenant.
