When a party has the burden of pl'oof on a part.icular issue,
his contention on that issue must be estabHshed by a fair'
preponderanco of the evidence. 'l'he evidence es tablishes a
oontention by a fai r preponder'anoe of tho evidence if you are
persuaded that it :Ls more probably accurate and tl;ue than not.
To put it another way, think, if you will, of an ordinary
balance scale, with a pan on each side. Onto one (1) side of the
scale, place all of the evidence favorable to the Plaintiff; onto
the other, place all of the evidence favorable to the Defendant,
If, after considering the comparable weight of the evidence, you
feel that the scales tJ.p, ever so sllghtly or to the slight.est
degree, in favor of the Plaintiff, your verdict must be for the
PlaintHf. If the scales tip in favol' of the Defendant, or are
equally balanced( your verdict must be for the Defendant.
In this case, the PlaintHf has the burden of proving the

TRIAL BRIEF
I. FACTUAL BACKGROUND
On February 16/ 1997 Mary walters entered the Shippensburg
Kmart store. She noticed some cardboard boxes, etc. to her right
believin<;J there was some construction being performed in the
entrance area.
She saw a line of people standi,ng at the service
desk and friends, Dr. and Mrs. Freeman to her left.
She walked
towards the service desk, and did not notice a cart, tripped over
the wheel and caused her'self to fall forward into the service
desk.
John Spei,renburg / store mana<;Jer, was situated on the
opposite side of the vestibule area and saw Ms. Walters enter the
store; he saw her bring an item to the service desk and then walk
away from the service desk to a display area ten (10) to fifteen
(15) feet away and upon returnin<;J back to the service desk, saw
her falling into the service desk.
Sandy Jeffries, Kmart employee, WctS working at the service
desk register, she indicated that Ms. Walters came into the store
and handed her some pajamas that did not fit her granddaughter
and for which she wanted a refund. While Ms, Jeffries worked on
the refund, Ms. Walters wa.1.ked i'lway from the counter, spoke
briefly with Dr. and Mrs. Freeman and upon returning back to the
service desk, apparently saying Goodbye or a last comment to the
Freemans over her shoulder, fell forward into the service desk,
The Defendant assert s that the cart, which Plai nt iff
allegedly fell, was open and obvious to the Plaintiff. The cart
was located adjacent to the service center desk and not in the
path of customers or the PlainU,ff. Plaintiff's fall solely was
the result of her failure to watch where she was walking.
Furthermore, Plaintiff was aware of the cart as she had walked to
the sel-vi,ce desk without walking i.nto the cart i.mmediately before
her fall.

Under Pennsylvani.a law, the Plaintiff clearly has the burden
of provi.ding that the Defendant was negligent. .E).aaiello"y""

does not establish negli.gence nor does it raise an inference or
presumpti.on of negligence nor does it make out a prima facia case

Fitterer, 503 Pa. 178, 469 A.2d 120 (1983). Under the provisions
of this section, recovery by an injured plaintiff will be
precluded where plaintiff's negUqence oxceeds the combined

Contributory/comparative negligence is commonly definod as

which is a legally contributing cause, cooperating with the
negligence of the defendant, in bdnging about tho plaintiff I s
harm", Thompson v. Goldman, 382 Pa. 277, 14 A.2d 1960 (1955);

Contributory/comparative negliqonce may stom from oithor a

The general rule in Pennsylvania regarding damages is that a
wrongdoer is liable for the natural and probable consequences of

Unfortunlltely, Mrs. Walters never made it to the service desk to return the pajamas. Ncar
the service desk she tripped over an inconspicuously placed pallet jnek being used by a store
employee who was hanging cnrdboard banners from the ceiling, The pallet jack was carrying about
10 of the cardboard banners. Mrs, Walters fell headfirst into the service desk and the floor and
sulTered serious personal injuries,

Dear Mr. DeCinti:
I am writing to you concerning Mary Wa1tera, who I have been treating aince
February 17. 1997. This patient fell at K-Nart on February 16. 1997 and
injured her right wrist. Apparently she tripped over Borne boxea. She ac-
tually injured her wriat and her shoulder. At ('hat time the x-ray a of the
shoulder did not reveal any evidence of fracture. X-rays of her wrist were
obtained and they revealed a colles fracture. She also sustained a contus-
sion of her eye.
She underwent surgery for her right wrist on February 18. 1997, This sur-
gery involved a closed reduction of pins and plaster of the right wrist.
She remained in the cast for 7 weeks. I did inject her right shoulder on
March 14, 1997 because she was complaining of a great deal of pain in the
shoulder. Her cast and pins were removed from her wrist on April 11. 1997,
She required extensive physical therapy for range of motion of the fingers
and the wrist. She did develop a lot of stiffness in her fingers. I ob-
tained an NRI of her right shoulder, and this revealed a complete tear of
the rotator cuff of the shoulder. Her x-rays of the shoulder reveeled de-
generative arthritis of the acromioclavicular joint and also a large spur
beneath the acromion. She remained in physical the ray for her wrist and
fingers for several months. On July 6. 1997, the patient underwent right
ahoulder surgery. She was found to have a large complex tear of the rota-
tor cuff of the shoulder. This tear of the rotator cuff was repaired. We
also performed an acromioplsty and excision of the distal clavicle. She
was discharged from the hospital on July 10. 1997.
Since her shoulder surgery. she has been progressIng nicel.y. Her shoulder
pain is gradually improving. She continues to go to physIcal therapy for
range of motion and strengthening of the right shoulder. I last saw her
in the office on November 14. 1997. At that time she was doing very well.
She can now elevate her arm to about 120. in an active fashion, Pass1.vely,
I can elevate her arm to abont 170.. 'rhe motion of her hand continuee to
improve. She has very good motion of her wrist. It is difficult to determine
whether or not further trestment will be required. She may require another
month or two of physical therapy. hut other than that. I don't foraee any
other type of treatment required. Her prognosis is good. She may end up
having some stiffness in her fingers and in her shoulder. SOmetimes l.t takee

up to a year to regain normal use of the arm, especially in light of the
filet thtlt she had 2 significant injuries involving this arm. I can't really
estimats the future cost of treatment.
I will probably see her in the office 3-4 more times, and she will be billed
for office visits. I do not forsee any further surgery in the future.

Dear Mr DeCinti:
I am wrlting to you concerning Mary Waltero. who I have been treating oince
February, 1997, On February 16, 1997 thie patient fell at K-Mart and in-
jured her right wriot. Apparently she tripped over some boxes. She injured
her wrist and her ohoulder, X-rays at that time did not reveal any fractures
of the ohoulder. X-rays of the wrist at that time revealed a calles fracture.
She underwent surgery on 2/18/97. The surgery involved closed reduction with
pins and plaster of the frecture of the right wrist. She did have some prob-
lems with motion of her fingers while she was in the cast. During the time
she was in the cast, she continued complain of a lot of discomfort in her
right shoulder. I did inject her shoulder with cortisone to help relieve
her pain. The cast and pins were removed on 4/11/97. She then continued with
phyaical therapy for the wrist and fingers which helped her a great deal.
I ordered an MRI of her right shoulder because she continued to have pain.
Thie atudy revealed a complete tear of the rotator cuff. She was not an-
xious to have any surgery for her shoulder at that time. Finally, she elect-
ed to proceed with surgery of the shoulder. On 7/8/97 I performed surgery
which involved an acromioplasty, excision of distal clavicle, and repair
of a large complex tear of the rotator cuff of the right ohoulder. Since
her shoulder surgery, she has been progressing nicely. Her shoulder pain
is gradually improving,
Since her ahoulder ourgery, Mary has had several other complaints of pain
end also mishapo. I oaw her in June, 1998 becouoe of trochanteric buroitis
of both hips. I injected bothher hipo et that time. She then missed her
atap and fell and injured her left knee, left wrist, snd right elbow in Sep-
tember, 1998. She sustained a fracture of the radial head of the elbow at
t.hat time. In Qctober. 1998 ohe was in a automobile accident. She woe in
a car when ohe rear-ended someone in front of her. She jammed her right
shoulder at that time,

On February 16, 1997 Mary Walters entered the Shippensburg
Kmart store. She noticed some cardboard boxes, etc. to her right
believing there was some construction being performed in the
entrance area, She saw a line of people standing at the service
desk and friends, Dr. and Mrs. Freeman to her left.
She walked
towards the service desk, and did not notice a cart, tripped over
the wheel and caused herself to fall forward into the service
desk,
John Speirenburg, store manager, was situated on the
opposite side of the vestibule area and saw Ms, Walters enter the
store; he saw her bring an item to the service desk and then walk
away from the service desk to a display area ten (10) to fifteen
(15) feet away and upon return:lng baok to the sorv:toe desk, saw
her f~ll:lng :lnto the serv:lce d~sk.
Sandy Jeffries, Kmart employee, was work:lng at the service
desk register, she indicated that: Ms. Waltms camE, into till,) store
and handed her some pajamas that d:i.d not f:i.t her granddauqhter
and for which she wanted a refund. While Ms. Jeffries worked on
the refund, Ms. Walters walked away f rom the counter, spoke
briefly with Dr, and Mrs, Freeman and upon returning back to the
service desk, appar'ently saying goodbye or a last comment to the
Freemans over her shoulder, fell forward into the setvice desk.

The Defendant asserts that the cart, which Plaintiff
allegedly fell, was open and obvious to the Plaintiff. The cart
was located adjacent to the service center desk and not in the
path of customers or the Plaintiff. Plaintiff's fall solely was
the resul t of her failure to watch where she was walking,
Furthermore, Plaintiff was aware of the cart as she had walked to
the service desk without walking into the cart immedL;'ltely before
her fall.

right wrist and right hip, Subsequent medioal examinations revealed that Mrs, Walters' injuries
inolude a torn right rotator cuff, right eye oontusion, right hip pain, and right wrist oolles
fraoture of the radius.
g, Mrs. Walters has undergone painful surgeries to repair her fraotured radius and
torn rotator ouff.
10, Mrs, Walters oontinues to undergo rehabilitation for her right arm, right wrist,
right shoulder and oontlnues to experienoe pain in her right wrist, right arm, right shoulder and
right hip.
11. The aforasaid fall and the resulting injuries herein sustained by Plaintiff Mary G,
Walter~ are the direct and proximate result of the wanton, careless, reckless, and negligent
aotions of Defendant K-Mart Corporation In failing to properly maintain and Inspect Its
premises as follows:
a. falling to properly warn business Invltees of the renovation site and of
the possibility of tripping or falling over materials used In or moved because of the
renovations;
b. failing to properly inspect the premises to determine whether there were
eny dangers whioh would pose a hazard to business Invitees;

Mary G. Walters has endured pain and suffering, and will endure additional pain and suffering

business invitee of the alleged renovation site or
of the possibility of tripping or falling over the
allegedly present materials or moved to the area
as a result of alleged r<~novations, but to the
contrary at all times material, Defendant
maintained the premises at a reasonable, safe,
proper and prudent manner;
b. Denied that Defendant failed to properly inspect
the premises to allegedly determine whether there
was any dangers which could potentially pose a
hazard to a business invitee, but to the contrary
at all times material, Defendant operated its
business and maintained the premises in a
reasonable, safe and prudent manner;
c. Denied that Defendant failed to guard against
alleged dangers of the premises which the
Defendant allegedly knew or should have known
existed, but to the contrary at all times
material, Defendant maintained its premises and
operated its business in a reasonable, safe,
proper and prudent manner under the circumstances;
d. Denied that Defendant failed to take proper
measures for the elimination of alleged hazards on
the premises, but to the contrary at all times
material, Defendant acted in a reasonable, safe,

By way of further defense, Defendant, Kmart Corporation,
alleges the following New Matter:
18. Plaintiff's Complaint fails to set forth a cause of
action upon which relief may be granted.
19. Plaintiff's claims are barred or appropr.iately reduced
by the Plaintiff's comparative negligence.
20. Plaintiff I s claims are barred or appropriately reduce
by application of the Pannsylvan1a Comparati,ve Negligence Act
codified at 42 Pa. C.S.A. 1702 at sea.
21. 'rhe incident which Plaintiff claims entitles her to
damages was caused by a per.son or persons not associated with the
Defendant and/or its agents and the same constitutes a complete
defense to the alleged cause of action.
22. If the condition which Plaintiff claims caused her
injury existed at the time of the claimed fall, which is denied,
Kmart Corporation had no notice of its existence prior to
Plaintiff I s claimed fall and the same constitutes a complete
defense to the alleged cause of action.
