KMART CORPORA'l'ION / JURY TRIAL DEMANDE:D Defendant No. 98-2200 TRIAL BRIEF I. FACTUAL BACKGROUND On February 16/ 1997 Mary walters entered the Shippensburg Kmart store. She noticed some cardboard boxes, etc. to her right believin<;J there was some construction being performed in the entrance area. She saw a line of people standi,ng at the service desk and friends, Dr. and Mrs. Freeman to her left. She walked towards the service desk, and did not notice a cart, tripped over the wheel and caused her'self to fall forward into the service desk. John Spei,renburg / store mana<;Jer, was situated on the opposite side of the vestibule area and saw Ms. Walters enter the store; he saw her bring an item to the service desk and then walk away from the service desk to a display area ten (10) to fifteen (15) feet away and upon returnin<;J back to the service desk, saw her falling into the service desk. Sandy Jeffries, Kmart employee, WctS working at the service desk register, she indicated that Ms. Walters came into the store and handed her some pajamas that did not fit her granddaughter and for which she wanted a refund. While Ms, Jeffries worked on the refund, Ms. Walters wa.1.ked i'lway from the counter, spoke briefly with Dr. and Mrs. Freeman and upon returning back to the service desk, apparently saying Goodbye or a last comment to the Freemans over her shoulder, fell forward into the service desk, The Defendant assert s that the cart, which Plai nt iff allegedly fell, was open and obvious to the Plaintiff. The cart was located adjacent to the service center desk and not in the path of customers or the PlainU,ff. Plaintiff's fall solely was the result of her failure to watch where she was walking. Furthermore, Plaintiff was aware of the cart as she had walked to the sel-vi,ce desk without walking i.nto the cart i.mmediately before her fall. II . Front St. Harriaburg. PA 17110-1706 " RE: Mary G. Walter Dear Mr. DeCinti: I am writing to you concerning Mary Wa1tera, who I have been treating aince February 17. 1997. This patient fell at K-Nart on February 16. 1997 and injured her right wrist. Apparently she tripped over Borne boxea. She ac- tually injured her wriat and her shoulder. At ('hat time the x-ray a of the shoulder did not reveal any evidence of fracture. X-rays of her wrist were obtained and they revealed a colles fracture. She also sustained a contus- sion of her eye. She underwent surgery for her right wrist on February 18. 1997, This sur- gery involved a closed reduction of pins and plaster of the right wrist. She remained in the cast for 7 weeks. I did inject her right shoulder on March 14, 1997 because she was complaining of a great deal of pain in the shoulder. Her cast and pins were removed from her wrist on April 11. 1997, She required extensive physical therapy for range of motion of the fingers and the wrist. She did develop a lot of stiffness in her fingers. I ob- tained an NRI of her right shoulder, and this revealed a complete tear of the rotator cuff of the shoulder. Her x-rays of the shoulder reveeled de- generative arthritis of the acromioclavicular joint and also a large spur beneath the acromion. She remained in physical the ray for her wrist and fingers for several months. On July 6. 1997, the patient underwent right ahoulder surgery. She was found to have a large complex tear of the rota- tor cuff of the shoulder. This tear of the rotator cuff was repaired. We also performed an acromioplsty and excision of the distal clavicle. She was discharged from the hospital on July 10. 1997. Since her shoulder surgery. she has been progressIng nicel.y. Her shoulder pain is gradually improving. She continues to go to physIcal therapy for range of motion and strengthening of the right shoulder. I last saw her in the office on November 14. 1997. At that time she was doing very well. She can now elevate her arm to about 120. in an active fashion, Pass1.vely, I can elevate her arm to abont 170.. 'rhe motion of her hand continuee to improve. She has very good motion of her wrist. It is difficult to determine whether or not further trestment will be required. She may require another month or two of physical therapy. hut other than that. I don't foraee any other type of treatment required. Her prognosis is good. She may end up having some stiffness in her fingers and in her shoulder. SOmetimes l.t takee Mary G. I can't really estimats the future cost of treatment. I will probably see her in the office 3-4 more times, and she will be billed for office visits. Apparently she tripped over some boxes. She injured her wrist and her ohoulder, X-rays at that time did not reveal any fractures of the ohoulder. X-rays of the wrist at that time revealed a calles fracture. She underwent surgery on 2/18/97. The surgery involved closed reduction with pins and plaster of the frecture of the right wrist. She did have some prob- lems with motion of her fingers while she was in the cast. During the time she was in the cast, she continued complain of a lot of discomfort in her right shoulder. I did inject her shoulder with cortisone to help relieve her pain. The cast and pins were removed on 4/11/97. She then continued with phyaical therapy for the wrist and fingers which helped her a great deal. I ordered an MRI of her right shoulder because she continued to have pain. Thie atudy revealed a complete tear of the rotator cuff. She was not an- xious to have any surgery for her shoulder at that time. Finally, she elect- ed to proceed with surgery of the shoulder. On 7/8/97 I performed surgery which involved an acromioplasty, excision of distal clavicle, and repair of a large complex tear of the rotator cuff of the right ohoulder. Since her shoulder surgery, she has been progressing nicely. Her shoulder pain is gradually improving, Since her ahoulder ourgery, Mary has had several other complaints of pain end also mishapo. I oaw her in June, 1998 becouoe of trochanteric buroitis of both hips. I injected bothher hipo et that time. She then missed her atap and fell and injured her left knee, left wrist, snd right elbow in Sep- tember, 1998. She sustained a fracture of the radial head of the elbow at t.hat time. In Qctober. 1998 ohe was in a automobile accident. She woe in a car when ohe rear-ended someone in front of her. She jammed her right shoulder at that time, I last saw her in the office Dr. Aohby in November, 1998. to be required in regards to in October, 1998. She noticed some cardboard boxes, etc. to her right believing there was some construction being performed in the entrance area, She saw a line of people standing at the service desk and friends, Dr. and Mrs. Freeman to her left. She walked towards the service desk, and did not notice a cart, tripped over the wheel and caused herself to fall forward into the service desk, John Speirenburg, store manager, was situated on the opposite side of the vestibule area and saw Ms, Walters enter the store; he saw her bring an item to the service desk and then walk away from the service desk to a display area ten (10) to fifteen (15) feet away and upon return:lng baok to the sorv:toe desk, saw her f~ll:lng :lnto the serv:lce d~sk. Sandy Jeffries, Kmart employee, was work:lng at the service desk register, she indicated that: Ms. Waltms camE, into till,) store and handed her some pajamas that d:i.d not f:i.t her granddauqhter and for which she wanted a refund.
