V, VINNY PALUMBO t/a PALUMBO'S PIZZA 13 , The averments set forth in paragraphs 1 through 12 are incorporated herein by reference as if set forth at length, 14, The Lease provides, inter alia, for the payment of fixed rent, a pro rata share of real estate taxes, common area maintenance charges ("CAW') and premiums for insurance and, in the event of a default, costs of suit and attorney's fees, 15, Palumbo is in default under the terms and conditions of the Lease in that Palumbo has failed to pay in full rent for the months of January through April 1998, accrued late fees and other charges when due as required under the Lease.
