in Plun Book 26, Puge 13 amlthereafler us amemkd.
4, Pluinti 1'1' is the body which manages the business, operations, affairs and property of
Westwood Village Condominium pursuant to the Unit Property Act of Pennsylvania, the
Declllnltion, and Code of Regulations.
5. Defendant is the ownc:r of 847 Louise Court, Building 7, Block 5, known as 847
Louise Court, ir, Westwood Village Condominium, having acquired title by deed dated August 7,
1996, and recordcd in thc Office of the Recorder of Decds of Cumberland County in Deed Book 143,
Page 1028, together with a proportionate undividcd intcrest in the common clements, as defined by
the Declaration of 0.480%.
6. Plaintiff has the duly under Section 12 of the Declaration and under Articlc VII of
the Code of Regulations to maintuin, repair and replace the common clements as defined in the
Declaration and to make and collect asscssments from the unit owners for the payment of common
expenses as defined in the Declaration.
7. Section 16A and B of the Declaration and Sections 702 and 703 of the Act provide
that assessments against any unit owner are chargeable to that unit owner and shall constitute the
personal liability of the unit owner. These sections also state that the assessments may be enforced
by suit by Council acting on behalf of thc unit owners and shall be listed by the Prothonotary as a
lis pcndens.

9. During the ycurs of 1997 and 1998, Pluintiffissued special assessments in the umount
of $29 per 1110nth to the Defendant for increuserl operating maintenunco and/or udditional capital
expenses pursuant to Article VII, Section IC of the Codc of Regulutions.
10. The general and speciul monthly ussessments levied by Plaintiff against the
condominiul11 unit owned by Defendant ut 847 Louise Court went unpaid from September, 1997
through April, 1998. A copy of a stlltcmcnt of uccount for the pcriod of Septcmbcr, 1997 through
April 1, 1998, is attachcd hereto and marked as Exhibit "A."
11. The Defendant has railed to make the puyments as shown on Exhibit "A", leaving a
balance due and owing as of April 15, 1998 of $722.66,
12. Pursuant to Article VII, Section 1.1. of the Code of Regulations, Plaintiff is
empowered to collect delinquent assessments against unit owners together with interesl, costs, filing
fees and uttorney fees.
13. Pluintiff has or will incur attorney fees in connection with this action for which
Defendant is liable.
14. Interest has acerucd on thc al110unt owing by Dcfendant to Plaintiffat the legal rate
of six percent (6%) pCI' annul11 and will continue to accrue.
15. All conditions prcccdcnt to Dcfendant's liability have been satisfied.
