IImended; the Code of Regulations of Westwood Village Condominium (hereinafter "Code of
Regulations"), which is recorded in Miscellaneous Book 213, Page 328 and thereafter as amended;
and the Declaration Plan ofWeslwood Village Condominium dated January 29, 1975, and recorded
in Plan Book 26, Page 13 and thereafter as amended.
5. PlaintifTis the body which manages the business, operations, affairs and property of
Westwood Village Condominium pursuant to the Unit Property Act of Pennsylvania, the
Declaration, and Code of Regulations.
6. Defendants arc the owners of Unit No. 849, Building 7, Block 5, known us 849
Louise Court, Suite 107, in Westwood Villuge Condominium, huving ucquired title by deed duted
July 29, 1991, und recorded in the Office of the Recorder of Deeds of Cumberland County in Deed
Book 35-F, Puge 923, together with u proportionute undivided interest in the common elements, us
defined by the Decluration of 0.606%.
7. Pluintiffhus the duty under Section 12 of the Declurntion and under Articlc VII of
the Code of Regulutions to muintain, repair und repluee the common clements as defined in the
Declurution and to muke und coli eel assessments from the unit owncrs for the payment of common
expenses as defined in the Declarution.
8. Section 16A und B of the Dcclurution und Sections 702 und 703 of the Act provide
thut ussessmenls uguinsl uny unit owner are churgeublc to thutunit owner und shull constitute the
personal liability of the unit owner. These sections also stute thut the ussessments may be enforced

by suit by Council acting on behalf of the unit owners and shall be listed by the Prothonotary as a
lis pendens.
9. For the years 1997 and 1998, pursuant to Articlc VII, Section I B of the Code of
Regulations, Plaintiff assessed the Dcfel1(!lmts an annual gencralassessment in the amount of$72
per month consistent with the Dcfcndants' respective undivided common interesl in the common
elemcnts as set forth in the Declaralion.
10. DUling thc years of 1997 and 1998, Plaintiffissucd special ansessments in the amount
of $37 pCI' month to the Defendants for increased operating maintenance and/or additional capital
expenses pursuant to Article VII, Section I C of the Code of Regulations.
II. Thc general and special monthly assessments levied by Plaintiff against the
condominium unit owned by Defendants at 849 Louise Drive went unpaid from September, 1997
through April, 1998. A copy of a slatement of account for the period of September, 1997 through
April 15, 1998, is attached hereto and marked as Exhibit "A."
12. The Defendants have failed to make the payments as shown on Exhibit "A", leaving
a balance due and owing as of April 15, 1998 of$886.91.
13. Pursuant to Arliele VII, Section 1.1. of the Code of Regulations, Plaintiff is
empowered to collect delinquent assessmcnts against unit owners together with interest, costs, filing
fees and attorney fee3.
14. Plaintiff has or will incur attorney fees in connection with this action for which
Defendants arc liable,
