Plaintiff is the hody which manages the husiness, operations, affairs and propel1y of Westwood Village Condominium pursuant to the Unit Pl'Operty Act of Pennsylvunia, the Deelamtion, and Code of Regulations. 5. Defendunt is the owner of Unit No. 116, Building 4, Block 2, known as 116 Brian Drive, in Westwood Village Condominium, having acquired title by deed dated August 16, 1993, and recorded in the Office of the Recorder of Deeds of Cumberland County in Deed Book 36-L, Page 905, together with a pl'Oportionate undivided interest in the common elements, as defined by the Declaration of 0.580'%. 6. Plaintiff has the duty under Section 12 of the Declaration and under Article VII of the Code of Regulations to maintain, repair and replace the common clements as defined in the Deelamtionand to make and eolleetassessl11ents from the unit owners for the payment of common expenses as defined in the Declamtion, 7. Section 16A and B of the Declaration and Sections 702 and 703 of the Act provide that assessments against any unit owner arc chargeable to that unit owner and shall eonslitute the personal liability of the unit owncr. These sections also stute that the usscssmcnts may be enforced by suit by Council acting on hehalfofthe unit owners and shull be listed by the Prothonotary as a lis pendens. 2 8, For the years 1997 and 1998, pursuant to Al1iele VII, Section I B of the Code of Regulations, Plaintiff assessed the Defendanl an annual genemlassessment in the amount 01'$69 pel' month consistent with the Defendant's rcspective undivided cOl11mon interest in the common elements as set fOl1h in the Declaration, 9. During the years of 1997 and 1998, Plaintiff issued special assessmcnts in the mnount of $35 pcr month to thc Defendant for increased operating maintenance and/or additional capital expenses pursuant to Articlc VII, Scction 1 C of thc Codc of Regulations. 10. Thc gencral and special monthly assessments levied by Plaintiff against thc condominium unit owned by Defendanl ut 116 Brian Drive went unpaid from September, 1997 through April, 1998. A copy of a statel11cnt of account for the period of September, 1997 through April 15, 1998, is uttuched hereto und marked as Exhibit "A." II. The Defendant has fuiled to make the payments as shown on Exhibit "A",leaving a balance due and owing as of April 15, 199801'$851.22. 12. Pursuant to Article VII, Section 1.1. of the Code of Regulations, Plaintiff is empowered to collect delinquent assessments against unit owners together with interest, costs, filing fees and attorney fees. 13. Plaintiff has or will incur attorney fees in connection with this action for which Defendant is liable. 14, Interest has accrued on the amount owing hy Dcfendant to Plaintiff at the legal rate of six pcrcent (6%) pCI' annum and will continue to accrue. 15.
