AND NOW COMES the Plaintiff, Council of Westwood Village Condominium, by and through its attorneys, Shumaker Williams, P.C., who file this Complaint and in support thereof aver as follows: I. Plaintiffis Council ofWe~tw()od Village Condominium (hereinafter "Council"), with a principal address at c/o Property Management, Inc., 1300 Market Street, P.O. Box 622, LCl\loyne, Pennsylvania 17043. 2. Defendant is Tilman McBrayer (hereinafter "McBrayer"), an adult individual, who resides at tl46 Brian Drive, Suite 112, Enola, East Pennsboro Township, Cumberland County, Pennsylvania 17025, 3. Westwood Village Condominium is a condominium located in East Pennsboro Township, Cumberland County, Pennsylvania, that was created and established on January 29, 1975, pursuant to the Unit Property Act of Pennsylvania; the Declaration Creating and Establishing Westwood Village Condominium (hereinafter "Declaration"), and recorded in the Office of the Recorder ofDeeds of Cumberland County in Miscellaneous Book 213, Page 283, and thereafter as amended; the Code of Regulations of Westwood Village ("ondomllllul1l (hereinal\cr "Codo of Regulations"), which is rccordcd In Mlscollanoous Book 21:1, Pago 328 and thoroul\or liS amomlod; and the Dcclaration Plan ofWeslwood Village Condominium dated January 29, 1975, IInd ,'ecordod in Plan Book 26, Pago 13 and thcrcafter liS amended, 4. Plaint I ff is the body which manages the business, operations, affairs and proporty of Westwood Village Condominium pursuant to the Unil Property Act of Pcnnsylvania, the Declaration, and Code of Regulations. 5. Defendant is the owner of Unit No. 846, Building 7, Block 5, known as 846 Brian Drive, Suite 112, in Westwood Villagc Condominium, having acquired title by deed dated April 13, 1993, and recorded in the Office of the Recorder of Deeds of Cumberland County in Dced Book 36- F, Page 641, together with a proportionate undivided interest in the common clements, as defined by the Declaration 01'0.480%. 6. Plaintiff has the duty under Section 12 of the Declaration and under Article VII of the Code of Regulations to maintain, repair and replace the common clements as defined in the Declaration and to make and collect assessments from the unit owners for the payment of common expenses as defined in the Dcclaration. 7. Section 16A and B of the Declaration and Sections 702 and 703 of the Act provide that assessments against any unit owner are chargeable to that unit owner and shall constitnte the personal liability of the unit owner. These sections also state that the assessments lTIay be enforced by suit by Council acting on behalf of the unit owncrs and shall be listed by the Prothonotary as a lis pendens. 2 8. During the yeurs of 1997 und 1998, Pluintiff issued specinlussessments in the umount of $29 per month to the Defcndunt for increuscd operuting l11uintenance und/or udditional capital expenses pursuant to Article VII, Section I C of the Code of Regulations. 10. The general und special 1110nthly assessments levied by Pluintiff aguinst the condominium unit owned by Defendant at 846 Brian Drive went unpaid from September, 1997 through April, 1998, A copy of a statement of account for the period of September, 1997 through April 1, 1998, is attached hereto and marked us Exhibit "A." II. The Defendant has fuiled to make the payments as shown on Exhibit "A", leaving a balance due and owing as of April I , 1998 of $808.66. 12. Pursuant to Article VlI, Section 1.1. of the Code of Regulations, Plaintiff is empowered to collect delinquent assessments against unit owners together with interest, costs, filing fees and attorney fees, 13. Interest has accmcd on the amount owing by Defcndant to Plaintiff at the legal rate of six percent (6%) per anllum and will continue to accrue. 15. Box 622 Lemoyne, PA 17043-0622 Att.n, James Stephens Re, Westwood Village Condominium Assessments ...., Dear Mr. Stephens, Please be advised that this office represents The Board of Westwood Village, as well as some individual unit owners, who were involved in two suits against the Council of Westwood Village. The purpose of this letter is to advise that all future assessments from individual unit owners will be held in an escrow account by my offics, until the earlier of two occurrences, 1. A Court Order reSolving the lawsuit between the individual unit owners and the Council of Westwood Village Condominiums, which an equity action is to be heard December 5, 1997; or 2. Until the Council agrees to call a Special Meeting of Homeowners for the specific purpose of voting upon a resolution to remove cert.ain council members and to appoint interim replacement members of council to serve until regular elections may be held. Because of the under.lying problems in the Condominium itself, and a question as to how the assessments are being used, the escrow and escrow account seem to be the only fair and reasonable way to go. The individual unit owners wish to express that they are not WithhOlding their assessments, and I can make available the account information in the escrow account at any time upon your request.
