Plaintiff is the body which manuges the business, operations, uffairs and property of Westwood Villuge Condominium pUl'suunt to the Unit Property Act of Pennsylvania, the Declaration, und Code of Regulations. 5. Defendant is the owner of Unit No. 851, Suite 123, Building 9, Block 5, known as 851 Brian Drive, in Westwood Village Condominium, huving acquired title by deed duted .June 21, 1985, und recorded in the Offiee of the Recorder of Deeds of Cumberland County in Deed Book 31. I, Puge 106, together with u proportionute undivided interest in the common elements, as defined by the Declarution 01'0.534%. 6. Pluinliffhas the duty under Section 12 of the Declarution und under Article VII of the Code of Regulutions to maintuin, repair and replace the common elements as defined in the Decluration amI to make und collect assessments from the unit owners for the payment of common expenses as defined in the Declaration. 7. Section 16A and B of the Deeluration and Sections 702 and 703 of the Act provide that assessments against any unit owner are chargeable to thut unit owner and shull constitutc the personal liability of the unit owner. These sections also state thut the assessments muy be enforced by suit by Councilucting on behalf of the unit owners and shall be listed by the Prothonotary as u lis pendens. 2 8. POI' lhc ycars 1997 and 1998, pursuanl 10 Article VII, Section I B of the Code of Regulutions, Plaintiffllssessed the Defendalll an annual generalllssessmcnt in the amount 01'$64 pel' month consistent with the Defendant's respective undivided common interest in the common clements as set forth in the Declurution, 9. During the years of 1997 and 1998, Pluintiffissued special assessments in the 1II110unt of $33 per month to the Defendunt for increased operating maintenance und/or additional capital expenses pursuant to Article VII, Section IC of the Code of Regulations, 10. The general and speciul monthly assessments levied by Plaintiff against the condominium unit owned by Defendant at 851 Brian Drive, Suite 123, went unpaid from August, 1997 thl'Ough April, 1998. A copy of a statement of account for the period of August, 1997 through April 1 , 1998, is attached hereto and marked as Exhibit "A," 11. The Defendant has failed to make the payments us shown on Exhibit "A", leaving a balance due and owing as of April I , 1998 of $1 ,053.47. 12. Pursuant to Article VII, Section 1.1. of the Codc of Regulations, Plaintiff is empowered to collect delinquent assessments aguinst unit owners together with interest, costs, filing fees and attorney fees. 13. Plaintiff has or will incur uttorncy fees in eonncetion with this action for which Defendant is liable. 14. Interest has accrued on the amount owing hy Defendant to Plainti rf lit the legal rate of six percent (6%) per annum and will continue to aceme. 15.
