4, Plaintiff is the body which manages thl) business, operations, affllirs and property of
Westwood ViIlagc Condominium pllrsuant to the Unit Property Act of Pcnnsylvania, the
Declaration, and Code of Rcgulations,
5, Defendanl is the owner of 850 Melissa Court, Building 24, Block 6, known as 850
Melissa Court, in Westwood Village Condominium, having acquired title by deed dated August 3,
1989, and recordcd in the Officc of the Recorder of Deeds of Cumberland County in Deed Book 34-
C, Page 38, togcthcr widl a proportionate undividcd interest in thc common clemcnts, as defined by
the Declaration of 0,539%.
6, P1aintif'fhas the duty under Scction 12 of the Declaration and under Article VII of
the Code of Regulations to maintain, repair and replace the common elements as defined in the
Deelllration and to make and collect assessments from the unit owners for the payment of common
expenses as defined in the Declaration,
7, Section 16A and B of the Declaration and Sections 702 and 703 of the Act provide
that IIssessments against any unit owner arc chargeable to that unit owner and shall constitute the
personllllillbility of thc unit owner. These sections also stllte that thfl assessments may be enforced
by suit by Counci IlIcting on behalf of the unit owners and shall be listed by the Prothonotary as a
lis pendens,p

expenses pursuant to Article VII, Section Ie of the Code of Regulutions,
10, The general and specilll monthly assessments levied by Plaintiff against the
condominium unit owned hy Defendant at 850 Melissll Court, went unpaid from Oetoher, 1997
lhrough April, 1998, A copy of a stlltement of account for the period of October, 1997 through

11. The Defendant has failed to make the payments as shown on Exhibit "A", leaving a
balance due and owing as of April I , 199801'$797,77,
12, Pursuant to Article VII, Section 1.1. of the Code of Rcgulations, Plaintiff is
empowered to collect dclinquent assessments agllinst unit owners together with interest, costs, filing
fees and attorney fees,
13, Plaintiff has or will incur attorney fees in connection with this action for which
Defendant is liable,
14, Intcrest has accrued on thc amount owing by Defendant to Plaintiff at the legal rate
of six pcrcent (601t,) per lInnumand will continuc to accrue,
15, All conditions precedent to Defendant's liability have becn satisfied,
