4. Plaintiff is the body which manages tho business. opemtions. lIffairs and properlY of
Westwood Villllge Condominium pursuant to the Unit Properly Act of Pennsylvllnia. the
Declarlltion. IInd Codc of Regulations.
5. Dcfcndant is thc owncr of Unit No. 843. Building 9, Block 5. known as 841 Brian
Drive. in Westwood Village Condominium. having lIcquired titlc by deed dated September 26. 1995.
and recorded in the Office ofthe Rccorder of Deeds of Cumberland County in Deed Book 128, Page
797. together with a proportionlltc undivided interest in the common clements. liS defined by the
Declaration of 0.534%.
6. PllIintiffhas the duty under Section 12 of the Declamtion and under Article VII of
the Code of Regulations to maintain. repllir and replace thc common clcmcnts as dcfined in the
Declaration and to make and collectllssessments from the unit owners for the payment of common
expenses as defmed in the Declaration.
7. Seetion16A and B of the Dec\anltion and Sections 702 and 703 of the Act provide
that assessments against any unit owner are chargeable to that unit owner and shall constitute the
personal liability of the unit owner. These sections also state that the assessments may be enforced
by suit by Council acting on behalf of the unit owners and shall be listed by the Prothonotary asa
lis pendens.

8. For the years 1997 lInd 1998. pursuant to Article VII, Section I B of the Code of
Regulations, Plaintiffllsscssed thc Defcndllntlln annuul gcnel'lll assessment inthc umount of$64 pel'
month consistent with the Defendant's respective undivided common interest in the common
elements as set forlh in the Declaration.
9. During the years of 1997 and 1998. Plaintiff issued special assessments in the
amount of $33 per month to the Defendunt for increased operating maintenance and/or additional
capital expenses pursuant to Article VII. Section I C of the Code of Regulations.
10. The general monthly assessments levied by Plaintiff against the condominium unit
owned by Defendant at 843 Brian Drive went unpaid from September, 1997 through April. 1998.
A copy of a statement of account for the period l1f September, 1997 through April I. 1998. is
attached hereto and marked as Exhibit "A."
11. The Defendant has failed to make the payments as shown on Exhibit "A", leaving a
balance due and owing as of April 1. 1998 of$898.22.
12. Pursuant to Arlicle VII. Section 1.1. of the Code of Rcgulations. Plaintiff is
empowered to collect delinquent assessments against unit owners together with interest. costs, filing
fees and attomey fees.
13. Plaintiff has or will incur attorney fees in connection with this action for which
Defendant is liable.
14. Interest has aecl1Ied on thc amount owing by Defendant to Plaintiff at the legal rate
of six percent (6%) pel' annum and will continuc to accrue.
15. All conditions precedent to r,efendant's liability have been satisfied.
