and the Decimation l'lan of Westwood Village Condominium dated January 29, 1975, and recorded
In Plan Book 26, Page 13 and thereafler as amended.
4. Plaintiff is the hody which manages the busincss, opeJ'Htions, affairs and property of
Westwood Village Condominium pursuant to the Unit Pl'operty Act of Pennsylvania, the
Declaration, and Code of Regulations.
;, Defendants are the owner of Unit No. 823, Building 11, Block 5, known as 823 Lee
Lane, in Westwood Village Condominium, having acquired title by deed dated April 8, 1994, and
recorded in the Ofliec of the Recorder of Deeds ofCumhcrland County in Deed Book 103, Page
811, together with a proportionate undivided interest in thc common elemcnts, as defined by the
Declaration of 0.606%.
6. Plainti ff has the duty undcr Section 12 of the Declaration and under Article VII of
the Code of Regulations to maintain, repair and replace thc common elements as defined in the
Declaration and to make and collect assessments from the unit owners for the payment of common
expenscs as defined inthc Declaration.
7. Scetion 16A and B of the Dcclaration and Sections 702 and 703 of the Act provide
that assessments against any unit owner are ehllrgcahle to that unit owner and shall constitute the
personal liability of the unit owner. These sections also state that the asscssments may be enforced
by suit by Council acting on behalfofthe unit owners and shllll be listed by the Prothonotary as a
lis pendens.

8. For the years 1997 and 1998, pursuant to Article VII, Section I B of the Code of
Regulations, Plaintiff assessed the Defendants an annual general assessment in the amount of $72
per month consistent with the Defendants; respective undivided common interest in the common
elemcnts liS set forlh in the Declaration.
9. During the years of 1997 and 1998, Plaintiff issued special assessmcnts in the amount
of$37 per month to the Defendants for increased operating maintenance and/or additionul cup ita I
expenses pursuant to Article VII, Section 1 C of the Code of Regulations.
10. The general and special monthly assessments levied by Plaintiff against the
condominium unit owned by Defendants at 823 Lee Lane went unpaid from August, 1997 throllgh
April, 1998. A copy of a statement of account for the period of August, 1997 through April 24,
1998, is attached hereto and marked as Exhibit "A."
II. The Defendants have failed to make the payments as shown or. Exhibit "A", lellving
a balance due and owing as of April 24, 1998 of$I,075.36.
12. Pursuant to Arliele VII, Section 1.1. of the Code of Regulations, Plaintiff is
empowered to collect delinquent assessments against unit owners together with interest, costs, filing
fees and attomey fees.
13. Plaintiff has or will incur attorney fees in connection with this action for which
Defendants are liable.
14. Interest has accrued on the amount owing by Defendants to Plaintiffat the legal rate
of six percent (6%) per annum and will continue to accrue.
15. All conditions precedent to Defendants' Iiabi.lity have been satisfied.
