4, Plaintiffis the body which managcs the busincss, operations, affairs und property of
Westwood Villugc Condominium pUl'suunt to thc Unit Property Act of Pennsylvania, thc
Declaration, und Code ofRegulutions.
5. Defendant is the owner of 781 Lee Lanc, Building 20, Block 4, in Westwood Village
Condominium, having ucquired title by decd datcd September 18, ] 997, and rccorded in the Office
of the Recorder of Dceds of Cumberlund County in Dced Book 164, Pagc 737, togethcr with a
proportionate undivided intcrest in thc common elements, us dcfincd by the Decluration of 0.539%,
6. P1aintiffhus the duty undcr Section 12 of the Declaration and under Article VII of
the Code of Regulations to maintain, repair and rcplace the common clements as defined in the
Declaration and to makc und collcct assessments from the lInit owners for the payment of common
expenses as defined in the Declaration.
7, Section 16A and B of the Dcc]aration and Sections 702 and 703 of the Act provide
that assessments against any unit owner ure chargcable to that unit owner and shall constitute the
personal liability of the unit owner, These sections also state that the assessments may be cnforced
by suit by Council acting on behalf of the unit owncl's and shall be Iistcd by the Prothonotary as a
lis pendens,
8, For the years 1997 and 1998, pursuunt to Article VII, Section I B of the Code of
Regulations, Plaintiffasscssed thc Defendunt an annuul general assessmcnt in the amount of$64 per

month consistent with thc Defendant's respective undivided common interest in the common
elements as set forth in the Declaration.
9. Thc general monthly assessments levied by Plaintiff against the condominiuln unit
owned by Defendant ut 781 Lee Lunc went unpaid from September, 1997 through April, 1998. A
copy of II statemcnt of account for thc period of Septcmbcr, 1997 through April I, 1998, is attached
hereto and marked as Exhibit "A."
I 0, The Dcfendant has failed to make the payments as shown on Exhibit "A", leaving a
balance due and owing as of April I, 1998 of$629.54.
II. Pursuant to Article VII, Scction I,/' of the Code of Regulations, Plaintiff is
empowered to collect dclinljuent assessments against unit owners togcther with interest, costs, filing
fees and attorney fees.
12, Plaintiff has or will incur aHomey fces in connection with this action for which
Defendant is liable,
13. Interest has accmed on the amount owing by Defendant to Plaintiff at the legal rate
of six percent (6%) per annum and will continue to accme.
14. All conditions precedent to Defendant's liability have been satisfied.
