BAUMGARDT, Defendant NO, 98. ~ fvef CIVIL TERM TEMPOR.UY PROTKCTIVE ORDER AND NOW, this .Jf,'d day of April, 1998, upon presentation and consideration of the within Petition, and upon finding that Plaintiff, Angela M. Thompson, is in Immediate and I' present danger of abuse from Defendant, Brian L. Baumgardt, the following Temporary Order Is entered. I. Defendant is ordered to refrain from abusing, harassing or stalking Plaintiff, or placing her In fear of abuse, either personally or through his agents. 2, Defendant is ordered to stay away from any location which Plaintiff may establish as her residence, and from Plaintiff's mother's (Joyce A. Thompson) residence located at 169 West North Street, Carlisle, Pennsylvania. 3. Defendant is ordered to refrain from having any direct or indirect contact with the Plaintiff including, but not limited to, telephone and written communications, and contact through third persons. 4. Defendant is enjoined from harassing and stalking Plaintiff's minor children, Terrance R. Baumgardt and Alan X. Dillon. S. Defendant shall turn over all firearms in his possession or control to the Sheriff of Cumberland County. 6. A violation of the Order may subject the Defendant to: i) arrest under 23 Pa,C.S. L fi6tt3; ii) a private criminal complaint under 23 Pa.C.S. fi6tt3. I; Iii) a charge of indirect criminal contempt under 23 Pa.C.S. 66114, punishable by imprisonment up to six months and II , jI l a fine of $100.00'$1,000.00: and Iv) civil contempt under 23 Pa.C.S. *6114, l. 7. Temporary custody of Terrance R. Baumgardt, is hereby awarded to petitioner, Angela M. Thompson. 8. A hearing shall be held in this mattcr on the ,/(( day of May, 1998 at): ,3",:. PM., in Courtroom No.2, Cumberland County Courthouse, Carlisle, Pennsylvania. Defendant is hereby informed that he has the right to be represented by counsel. DEFENDANT IS FURTHER INFORMED THAT ANY PROTECTION ORDER MA Y BE CONSIDERED IN ANY SUBSEQUENT DOMESTIC RELATIONS PROCEEDING, INCLUDING A CHILD. CUSTODY PROCEEDING. 9. The Carlisle Police Department shall be provided with a certified copy of this Order by the Plaintiff's attorney. This Order shall be enforced by any law enforcement agency where a violation occurs by arrest for indirect criminal contempt without warrant upon probable cause that this Order has been violated, whether or not the violation is committed in the presence of the pollee officer. In the cvent that an arrest is made, under this section, the Defendant shall be taken without necessary delay before the court that issued the order, When that court is unavailable, the Defendant shall be taken before the appropriate district justice. (23 P.S. *6113). 10. The Plaintiff may proceed without pre-payment of fees pending a further order after the hearing. II. This Order shall be docketed in the office of the Prothonotary. Plaintiff feared serious bodily injury. h. In December of 1994, while Plaintiff was pregnant with Terrance, Defendant intentionally hit Plainliff with his car. Plaintiff sustained S<1me bruises to her back and buttocks and suffered substantial pain. 7. Plaintiff believes and therefore avers that she and her second child are in immediate and present danger of seriOIlS abuse from Defendant and thaI she and her second child are in need of protection from abuse. WHEREFORE, pursuant to the provisions of the "Protection From Abuse Act" 23 Pa.C.S.A. fi6101 et seq., Plaintiff prays this Court to grant the following relief: A. Grant a Temporary Order as follows: I) Defendant is to refrain from abusing the Plaintiff and from threatening harm to Alan X. Dillon. 2) Defendant is enjoined from harassing and stalking the Plaintiff and from threatening harm to her child Alan X. Dillon, 3) Defendant shall not trespass at Plainlifr s current or future residence. 4) Defendant shall not have any contact with Plaintiff except for the limited purpose of arranging custody or visitation of their child. 5) Grant temporary custody of Terrance R. Baumgardt to Plaintiff, pending further order of court; and 6) Granting such other relief as the Court deems appropriate and just. 7) Defendant shall temporarily relinquish to the sheriff all weapons in his possession or control. B. Schedule a plenary hearing and enter an order against the Defendant, to be in 4 effect for one year: 1) Directing Defendant to refrain from abusing the Plaintiff; 2) Prohibiting the Defendant from having any contact with the PlaintiffeKcept for the limited purpose of arranging visitation of' their son, Terrance R. Baumgardt; 3) Granting primary physical custody of Terrance R. Saumgardt to the Plaintiff; 4) Prohibiting Defendant from having any contact with the Plaintiff, including, but not limited to trespassing at Plaintiffs current or future residence, and from threatening harm to Plaintilrs minor child, Alan X. Dillon. S) Directing the Defendant to pay child support in an appropriate amount; 6) Directing the Defendant to pay the administrative costs and fee required for filing the Petition; 7) Granting any such other relief as the Court dr.cms appropriate and just. COUNT II - CUSTODY 8. The previous allegations of this Petition are incorporated here by reference. 9. The Plaintiff seeks primary custody of Terrance R. Baumgardt, born August 25, 1995, who lives with the Plaintiff at an undisclosed location. 10. Since birth, Terrance has lived with the following persons and the times and places as if)dicated: a. Angela Thompson, Brian Baumgardt and Ida Neal at 502 North Bedford Street, Carlisle, PA from his birth through October, 1996. b. Angela Thompson and Brian Baumgardt at North East Street, Carlisle, PA 5 from October, 1996 through March, 1997. c. Angela Thompson and Joyce Thompson at 169 West North Street, Carlisle, PA from March, 1997 through August, 1997. d. Angela Thompson at 365 North Hanover Street, Carlisle, PA from August, 1997 through October, 1997. e. Angela Thompson and Joyce Thompson at 169 West North Street, Carlisle, PA from October, 1997 through December, 1997. f. Angela Thompson at an undisclosed location in Carlisle from December, 1997 to present. Plaintiff is the child's mother. She is single. Plaintiff and the child live alone. Alan X. Dillon born on April 16, 1998 is currently in the hospital. II. Defendant is the child's father. He is single and lives with his grandmother, Ida Neal, at 502 North Bedford Street, Carlisle, Pennsylvania. 12. Plaintiff has not participated in any capacity in other litigation in this or any other court concerning the custody of the child. 13. Plaintiff has no information of any pending custody proceeding concerning the child in any court of this commonwealth or elsewhere. 14. Plaintiff does not know of any person not a party to these prOCeedings who has physical custody of the child or claims to have custody or visitation rights with respect to the child. 15. The best interests and permanent welfare of Terrance R. BAUMGARDT, Defendant NO. 98.2404 QJtDER OF' COURT AND NOW, this .J4-- day of May, 1998, upon review of the Consent Agreement submitted by the parties and without admitting Plaintiffs allegations of abuse, it is hereby ordered: 1. Defendant shall not further abuse, harass, or stalk the Plaintiff, Angela M. Thompson. 2. Defendant shall not harass or threaten Plaintiffs minor child, Alan X. Dillon. 3. Defendant shall not have any firearms in his possession or control during the period of this Order, 4. Defendant shall not contact Plaintiff except for the limited purpose of discussing the welfare of their minor child, Terrance R. Baumgardt. 5. Defendant shall not enter Plaintiff's current or future place of residence. 6. Plaintiff and Defendant agree that Plaintiff shall have temporary custody of Terrance R. Baumgardt, pending further order of court. 7. The Defendant understands that the petition Order entered in this matter will be in effect for a period of one (1) year and can be extended beyond that time if the Court finds that the Defendant has committed an act of abuse or has engaged in a pattern that indicates risks of harm to the petitioner.
