AND NOW, Plaintiffs, MARTIN T, VRANICAR and MINERVA M,
VRAN I CAR , his wife, by and through counsel, Killian &. Gephart, and
in support of this Quiet Title Action aver the following:
1. Plaint i f fs, Mart in T. and Minerva M, Vranicar, are adult
individuals residing at. 50a Gale Road, Camp Hill, Cumberland
County, Pennsylvania 17011.
2. Defendant, Howa,t'd C, Gale Development Co., Inc., is a
corporation with its offices locat.ed at 105 Fairway Drive, Camp
Hill, Pennsylvania 17011.
3. In June of 1997, plaintiffs purchased a tract of land
situated in Hampden Township, Cumberland County, Pennsylvania, more
part.icularly bounded and described as follows:
ALL THAT CERTAIN t.ract of land situate in Hampden
Township, Cumberland County,pennsylvania, more
particularly bounded and described as follows to wit:
BEGINNING at a point on the western line of Gale
Road, which point is at the dividing line bet.ween Lots
Nos. 74 and 75 on the plan of Lots hereinafter mentioned;
thence south 60 degrees 25 minutes West, and along the
dividing line between Lots Nos. 74 and 75 on the plan of
Lots late of L. p, Deubler; thence North 48 degrees 25
minutes West, and along lands now or late of L. p,
Deubler, a distance of 162.09 feet to a point; thence
North 76 degrees 55 minutes East, and along other lands
of Howard C. Gale Development Co., Inc., a distance of
160,87 feet to a point on the western line of Gale Road;
f) In June of 1997, Martin and Minerva Vranicar
purchased this property from Commerce Bank/Harrisburg, N,A"
fqr the purchase price of $225,000.
g) Mr, and Mrs, Vranicar used the home, garage and
connecting driveway continuously until December of 1997.
h) However, the VranicarrJ are now aware that the garage
and a portion of the driveway were in fact located on the
neighboring parcel., more particularly described as l,ot No,
169.
i} It is Plaintiffs' belief and understanding that this
property is owned by Howard C. Gale Devel.opment Co., IllC.
6, Plaintiffs believe and therefore aver that there now
exists a dispute in title to a triangular parcel of land which
includes the garage and driveway. A copy of a map highlighting the
disputed parcel is attached hereto as Exhibit "B".
7. Plaintiffs believe and therefore aver that this garage
and driveway parcel were adversely possessed by Howard C. Gale,
Jr" and his wife, Rita Gale, in that they had actual, continuous,
exclusive, visible, notorious, distinct and hostile possession of
the land for a period of over twenty-one (21) years.
8. Plaintiffs believe and therefore aver that as successors
in title, they have also secured the rights of Howard C. Gale, Jr.,
and Rita Gale, his wife, to this property.
