THIS AGREEMENT made the

day of April, 1998, by and
between HARRY B. CLARK d/b/a JOY-ARK BUILDERS, of 117 Fineview
Road, Camp Hill, Pennsylvania 17011, hereinafter referred to as
Contraotor, AND THOMAs C. WETZEL and CHERI L. WETZEL, husband and
wife, of 318 South Market Street, Meohanicsburg, Pennsylvania
17055, hereinafter referred to as Owner, whereby the former
undertook and agreed to ereot and oonstruct a single-family
residential dwelling on that certain lot of ground situate in
Spring Willow Drive, Upper Allen Township, Cumberland County,
Pennsylvania, being Lot No. 52 on Phase VIII - Final SUbdivision
Plan of Meadowview Estates, said Plan being reoorded in the
Cumberland County Recorder of Deeds Office in Plan Book 74, Page
108. Being the same premises which John M. Knaub by Deed dated
February 10, 1998 and recorded February 13, 1998 in the
Cumberland County Recorder of Deeds Office in Deed Book 172, Page
73, granted and conveyed unto Thomas c. Wetzel and Cheri L.
Wetzel, husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH I That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknOWledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their SUbcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
