ACTION TO QUIET TITLE
DECREE
AND NOW, TO WIT, this ~tt. day of ~_, 1998, a Complaint
having been filed with the Court on April ~m, 1998. and it appearing that in accordance
with the Order of this Court dated May 6, 1998, notice to appear and answer on 01' be.fore
the twentieth (20th) day following the last date of publication of said Complaint, was given
by publication to the Defendants, their Heirs, Administrators, Executors, Successors and
Assigns, as is attested to by the proofs of publication duly filed in this case,
AND, it further appearing that no Answer has been entered or filed by the
Defendants, 01' any of them, 01' their Heirs, Administrators, Executors, Successors and
Assigns. or their predecessors in title; and that no action has been taken by Defendants to
bring an Action in Ejectment against the Plaintiffs, it is hereby
ORDI<:RED, ADJUDGED, AND DECRlmO that Plaintiffs were, and are, the legal
owners of that tract of land described in Plain~iffs' Complaint, and that the Defendants,
their He,irs, Administrators, Executors, Successors and Assigns, are, and shall be, forever
barred from asserting any right, lien, title, or interest iil said premises which may be
inconsistent with the intercsts 01' claims of the plaintiffs set forth in this Complaint, unless
tllll Defendants do, within thirty (30) days hereof, institute an Action in Ejectment in the
Court of Common Pleas of Cumbcrland County, Pennsylvania seeking to eject the Plaintiffs
from possession of the laml situate in the South Middlet.on Township, Cumberland County,
Pennsylvania, being more particularly bounded and described as follows, to wit:
BEGINNING at II point in the centerline of the Holly Pike (S,R,0034), sllid

rOlldwllY; thcnl~e extending in and through the centerline of the Holly Pike,
North one (I) degrce fifty-folll' (54) minutes twenty-five (25) seconds West,
for a distanee of two thOl!sand eleven and sixty-one hundredths (2,011.61) to
a point; thenee eontinuing in and through tbc centcrline of the Holly Pike,
by an arc or a curve to the right IllIving a radius of eleven thousand four
hundred fifty-nine and nineteen hundredths (11,459,19) feet, a chord of
eleven hundred sixty-four and forty-four hundredths (1164.44) feet on a
bearing North one (I) degrees zero (0) minutes twenty (20) seconds East, for
an afC distance of eleven hundred sixty-four and ninety-four hundredths
(1164,94) feet to a point in the center of said roadway at lands now or
formerly of the Midway Bowling Center; thence departing from the centerline
of the Holly Pike, and extending IIlong lands now or formerly of the Midway
Bowling Center, other lands now or formerly of Farmers Trust Company,
North sixty-five (65) degrees twenty-fivc (25) minutes twenty-five (25) seconds
East, for a distance of eleven hundred fifty-nine and thirteen hundredths
(1159,13) feet to a steel pin at lands now or formerly of Mark A. Naugle;
thence extending along lands now or formerly of Mark A. Naugle, South
seventeen (17) degrees zero (00) minutes forty-five (45) seconds East, for a
distance of fifteen hundred ninety-five and fifty-five hundredths (1595,55) feet
to a steel pin at lands now or formerly of Harold E, Otto; thence extending
along lands now or formerly of Harold E, Otto, South seventeen (17) degrees
eighteen (18) minutes forty (40) seconds East, for a distance of seventeen
hundred forty and fifty-foul' hundredths (1740.54) feet to a steel pin at lands
now or formerly of Dauphin Deposit Bank; thence extending along lands now
01' formerly of Dauphin Deposit Bank, South seventy-nine (79) degrees
sixteen (16) minutes twenty (20) seconds West, for a distance of one
thousand seventy-three and fifty-seven hundredths (1,073.57) feet to a steel
pin; thence continuing South seventy-three (73) degrees fifty-nine (59)
minutes zero (00) seconds West, for a distance of nine hundred seventy-five
and forty-six hundredths (975.46) feet to a point in the center of the Holly
