4. At all times relevant to the within state of cause of
action, your Plaintiffs, Dominic D, DiFrancesco, II and Stefanie
DiFrancesco were operating an at home business known as 3D
Productions, 3D Productions does desktop publishing, small
business advertising and resume services,
5, In the summer of 1997, Plaintiff Dominic D, DiFrancesco,
II contacted your Defendant with regards to purchasing a new
Macintosh Computer System so as to allow the Plaintiffs to
upgrade their current computer system in order that the business,
3D Productions would be able to scan in documents and
photographs, produce documents in multiple colors, and operate
with a CD ROM System.
6, Mr, DiFrancesco did some research on Macintosh Systems
and provided a list to the Defendant of what he thought, in his
layperson's opinion, was needed to do the necessary upgrades,
7. Your Defendants, by letter of July 25, 1997 with an
attached proposal, a copy of which is attached hereto and marked
Exhibit "A" and made a part hereof by reference thereto,
8uggested an alternative solution to meet the needs required of
3D Productions as set forth by 3D Productions to Cinemagic, Inc,
8, By invoice dated July 30, 1997 your Plaintiffs received
and paid $3,47'7.86 for a system more specifically described on
said invoice, attached hereto marked Exhibit "B" and made a part
hereof by reference thereto,
9. Your Plaintiffs proceeded to attempt to assemble the
system and were unsuccessful in getting the system to start up
when the sca.nner was on, Also when the Plaintiffs attempted to
use the new Epson printer the ink bled down the entire side of
each printed page,
10, An employee of the Defendant came to the Plaintiffs
house and corrected the scanner problem by reversing the cables
on the back of the scanner, quite contrary to the instructions.
He did not attempt to nor claim to be able to fix the bleeding
problem on the Epson color printer, Your Plaintiffs were charged
$56.25 plus tax to correct the flaw in product information, A
oopy of said invoice is attached "ereto, marked Exhibit "C" and
made a part hereof by reference thereto.
they already had everything that was needed to perform the
necessary tasks. The Defendant then suggested the Plaintiffs
attempt to use the software that came with the system purchased
from Defendant to attempt to recreate all of the documents.
Although once again your Defendant provided no service to your
Plaintiffs, your Defendant charged the Plaintiffs $112,50 plus
tax as more specifically set forth on Exhlbit "D" attached hereto
and made a part hereof by reference thereto.
14, After Defendant's representative had left the
Plaintiffs' residence on October 13, 1997 your Plaintiffs
recreated all the documents on the Mac publishers software t\lat
was provided with the new system as recommended by your
Defendant, When your Plaintiffs attempted to print the documents
the same results occurred: post script errors which would allow
nothing to print and documents printed with blacked out spaces
where the .:1 ip art or scanned images and text should have
appeared,
15, After four (4) months of frustration your Plaintiffs
attempted to contact your Defendant to request a refund of all
moneys paid due to the fact that the system sold to your
plaintiffs did not provide the services as represented by your
Defendant, Your Defendant refused to respond to your plaintiffs
and refused to even grant a refund of $299.00 for the bleeding
printer that was returned in the fall of 1997,
16, A review of the invoice attached hereto as Exhibit "B"
reveals no limited warranty of any sort which would prevent your
plaintiffs from returning the system and receiving their money
back.
17, Your plaintiffs are unaware of any return policy that
would pr.ohibit them from obtaining their money back for a system
which failed to meet their needs,
WHEREFORE, your plaintiffs request recission of the contract
and return of their money totaling $3,477,86 upon their return of
the system as more specifically set forth in exhibit "A" attached
hereto, plus interest and the costs of this action,
