15, At the time of the ucddent Plaintiff, Kelly Stanley was the front sent passenger of
the vnn.
16. As a result ofdefcndant's negligence, plaintitTsustained the following injuries::
(a) Severe contusion left hip to left knee.
(b) Left side of head contusion after striking the windshield.
(c) Muscle and Iigamcnt sprains and strains to her neck, shoulders, lower
back, and Icft hip.
(d) Muscle weakness in the left hip, left knee and abdominal muscles.
Plaintiff, Kelly Stnnley continues to suffer from muscle ligament strain in the neck.
thoracic low back, elbow tendonitis with deeonditioning as a result of sustained mu~cle
spasms.
17. As a result of defendant's negligence, plaintiff has suffered great bodily pain and
suffering, as well as mental anxiety and nervousness, to her great detriment and loss.
18. As a result of defendant's negligence, plaintitThus suffered an interruption of her
daily habits and pursuits of his enjoyments in lite.
19. Plaintiff has made demand for l:ompensation of the aforesaid injurie~ and losses,

unit 2 > Heavy right front end contact damage, Right side window frame bent outwards, Larae
amount of induC4d damage to roof line of vehicle, from A to C pll1ar, In looking at the interior
of the vehicle the automatic shift lever was bent to the right, A mark on the top of the interior
of the A pillar that had hair on it that was stuck to the intact head liner was consistent with the
occupant 1I0t belted in and was thrown out of the vehicle at impact. This would account for the
bent shifter handle, window frame bent outwards, mark on interior A pillar and finding the
driver on the ground as a unrestrained occupant moving towards point of ilontact between the
two vehicles. I also found 110 physical evidence of the driver lil1d sole occupant of this vehicle
wearing a safety belt, Head lights were on, and no vehicle defects were noted.

Unit I was North bound on Wesley Dr.
Unit 2 was South bound on Wesley Dr.
According to witnesses and physical evidence eollccted on scene unit 2 was making a left hand
turn into a private driveway at BethanY Towers, This turn occurred directly in ftont ,of unit 1.
Point of contact was between I and 2 feet from the East edge of the roadway in the North bound
lane, At this point the dAver of unit I had already taken defensive action by pulling his .vehicle
to the right as the collision occurred. Impact of the right front wheel of unit 2 to the left front
(If unit I was less than 8" In on the bumper from the left side end. This would mean that the van
was already 3/4th off the roadway to the right attempting to avoid the crash. There was no
evidence of excessive speed on either unit. Unit 1 had the left front wheel locked due to contact
damage and went into a grassy field after striking a 7" high curb and running over a 3"
(approx,) diameter pine tree to uncontrolled rest. During the travel after impact, there was no
brnldng. Unit 2 spun counter clock wise to uncontrolled rest with the right front wheel locked,
No braking occurred in this unit as well. There were no preimpact brake/tire marks noted, 1 was
able to locate corresponding conlact maj'ks on each vehide to pin point Initial contact between
both units. These area's were also photographed.
The accident scene was photographed by evidence technician Ickler and Cpl. Williamson. Also
Officers Wllt, Crone and McNair were also on scene.

Thie ie in responee to your letter November 11, 1998 regarding
Mr. Morris Stanley.
Mr. Morris Stanley was initially evaluated April 8, 1998
referred by hie wife who is my ex-patient. At that time he
oomplained of pain in the left shoulder and left knee.
Sued on the history, he started suffering with these probleme
after involved in MVA May 9, 1996. At that time patient WAe
driving And his air bag deployed. He injured his shoulder And
knee. He saw many doctors but unfortunately he did not get much
better. He started suffering with attacks of pain in the left
ohest and shoulder muscles and as well as behind the left knee.
I examined him and provided some treatment and thle patient
also brought MRI film.
BaBed on my diagnosis, this patient is suffering with left
shoulder tendinitis with left pectoralis tendinitis and minor AC
joint impingement with chronic patellar tendinitis on the left.
MRI study done in early 1998 showed some joint effusion but this
just supports patient suffers with chronic tendinitis.
Depending on his activity or other conditions, he could have
more or less pain in the left shoulder and left knee which is
purely chronic tendinitis problem as a result of MVA May 9, 1996.
This patient states he never had this left shoulder problem or left
knee problem prior to MVA May 9, 1996.
With known chronic tendinitiA in the left shoulder, without
tear, and AC joint impingement, which is only mild, and left knee
tendinitio which is more chronic, at this time patient does not
lIeed any aggI'essive treatment unless symptoms flare up for whatever
reason.

This Is in response to your letter July 28, 1999 regarding Mr. Morris Stanley's
medical problems. I sent a letter to you December 1998 and today's letter is in
response to your Jetter July 28, 1999.
You sent a copy of records from ER at Holy Spirit Hospital, Dr, Morton Rubin's,
orthopedic surgeon note, second opinion from Dr. Ernest Rubbo, orthopedic surgeon
and West Shore Family Practice notes and police report and Photographs of accident
scene.
I had an opportunity to review all these records intensively and reviewed my
records to provide report to you regarding you questions on July 28, '1999 letter.
#1. Holy Spirit ER note stated he slIffers low abdominal pain and right leg and
knee pain. X-ray was negative.
#2. In the review of Dr. Rubin's note August 29, 1996 mentioned only left knee
problem with swelling. Left knee x-ray done January 16 showed no fracture. March 7,
1997 Dr. Rubin's noted only documented knee problem. February 10, 1998 Dr. Rubin
note stated left shoulder and anteriol' chest wall pain. Also mentioned left knee
problem.
#3. Regarding Dr. Rubbo's note as second opinion, documented left knee
problem. His note documents patient had second opinion dlle to Or. Rubin's
recommendation to consider arthroscopic evaluallon for Possible surgery and patient
did not wish to have surgery for the knee, Patient states due to financial obl/gatlons, he
should continue working as a black top paving buriness as self-employed and his

diagnosis was possible seml-tendlnosls bursitis of the left knee vs menlsoull pathology,
Baker's cyst.
#4. I reviewed police report and pictures whloh confirmed patient was Involved
in head on collision as driver and his car was damaged intensively in the front and car
slide down toward right side off of the road which as expected he had full effort to avoid
head on collision and tried driving and turning his car to the right which was great effort
for his left arm and shoulder with great Impact which Is only my guess as a medical
expert.
#5. In review of West Short Farnily Practic:e notes, there Is very Interesting
findings documented In a few places. They document left shoulder problem and state
patient has history of pain In the left shoulder and diagnosed with bursitis previously
dooumented JUly 22, 1906 which Is only about 2 Ya months after Injury. They state
slightly tender over the long head bleeps tendon and more posterior and laterally at the
deltoid region, October 1,1997 documents left shoulder pain and chest pain and state
Dr. Greiner, who Is family doctor for patient, states left shoulder bursitis a year ago but
pain Is now radiating Into chest wall, back of arm Into his hand which is about 5 months
after MVA March 3, 1998 note documents chronic left shoulder and chest discomfort.
They state he blamed most discomfort on auto accident which was over a year ago,
and tenderness at the anterior chest wall and given diagnosis of costochondrltls and
thf;ly state patient was advised to do stretching exercise for the pectoralis muscle which
Is left chest wall muscle.
In the review of my notes carefully from the initial eval on April 8, 1998 to
November 4, 1998, patient suffered with left shoulder pain with pector~lIs tendinitis and
my examination indicated he had tenderness at the sternocostal junction on the left side
which Is anterior chest wall, and also tenderness at the pectoralis tendon attaohment at
left shoulder anterior surface. No tenderness at the bicipital tendon. Minimal
tenderness at the AC jOint. My diagnosis was left shoulder pain which is pectoralis
tendinitis at the left shoulder which Is localized tenderness at the anterior aspect of the
left shoulder and peotoralls muscle covers anterior chest wall on the left side. Based on
family physician's note on July 1996 documented this left anterior chest wall muscle
pain, shoulder pain and performed cardiac work up to rule out cardiac pathology. Also
he suffered with left knee problems which Is more indicate Baker's cyst or tendinitis at
the distal end of hamstring tendon on the left knee. His diagnosis was consistent with
left shoulder pectoralis tendinitis with early sign of AC joint Impingement and left knee
hamstring tendinitis until November 4, 1998 when I examined this patient the last time.

In summary to answer your question,
Regarding chronic tendinitis In the left shoulder, he may have had bursitis In the
left shoulder before, probably related to occupation, but that was asymptomatic at the
time of MVA on May 9. 1996, but he developed left chest wall muscle pain which Is
muscle contusion and developed tendinitis at the anterior surface of the left shoulder
which Is were pectoralis muscle attaches and middle of anterior chest, so-called,
costochondritis which is tendinitis at the distal end of pectoralis muscle attachment on
the sternum and left middle anterior chest wall. In Dr., Rubin's note February 1998 and
also family practice note documents from July 22, 1996 and up to March 1998, this
patient suffered with constant pain at the left shoulder and anterior chest wall and
diagnosed with costochondrltis and left shoulder bursitis. However this Is only one
problem which Is attached to chest wall muscle, pectoralis muscle, attaches at the left
shoulder as a tendon and middle of chest which is only one muscle and that muscle
was damaged as a contusion from the MVA and developed costochondro-tendlnitls at
the chest wall and aggravation or recurrence or new onset of pectoralis tendinitis ao
result of MVA with left chest wall contusion. The reason I state aggravation or
recurrence means family practice noticed patient had left shoulder pain for a couple of
years which Is documented October 1, 1997 so he may have had left shoulder bursitis
which is not the same as pectoralis tendinitis in the left shoulder but I did not examine
patient prior to car accident for his shoulder so it's very hard to differentiate as
recurrent, aggravation or new onset of left shoulder problem. At least costochondrltis,
which Is pain In the left anterior chest wall, It is new onsat from MVA.
In the review of all records, regarding left knee tendinitis Is definitely as a result
of MVA as head-on collision May 9, 1996. New onset or recurrence or aggravation of
pectoralis tendinitis and new onset of costochondrltls and left knee problem Is result of
MVA May 9,1996.

DISCHARGE SUMMARY
Mr. Stanley was been seen at Pinnacle Health Physical Therapy of Cumberland Valley for only 5
sessions since 3/27/98. Treatments during that time have consisted of gentle stretching for the
leg and calf musculature, plllsed ultrasound with Dexamethasone, followed by cold pack, and
home instruction.

1. Complaints of recurrent moderate, 5/10, pain in the posterior aspect of the left knae with
sensation that the knee wants to "give out" and occasional posterior swelling.

APPEARANQE: From a posterior coronal view there Is slight swelling In the popliteal area.
PALPATION: No palpable warmth In the popliteal space. No significant tendemess.
Good palpable pulses in the lower extremities.
RANGE OF MOTION: Active range of motion for the right knee Is 6 to 1410 compared to
the involved left knee 5 to 1400 In supine. There is fall' flexibility for the long muscles of the lower
extremity as well as the gastrocsoleus group.
STRENGTH: A gross assessment for both lower extremities revealed 5/5 throughout.
REFLEXES: Deep tendon reflexes were brisk and equal.
SPECIAL TEST!t Negative ligamentous and meniscal tests. Negative lumbar spine
screening.
PROBLEMS ARE~
1. Patient complains of recurrent, moderate, 5/10, pain in the posterior aspect of the leti
knee, the sensation that the knee wants to give out, and occasional posterior swelling.
2. Functional limitations. The patient cannot maintain bending, squatting positions for more
than 15 minutes without intolerable posterior knee pain. Patient has also had to refrain
from playing basketball with his 5 sons secondary to pain. Patient Is no longer able to
stand on concrete floors for more than 1/2 hour without aggravated left knee symptoms.
3. Fair flexibility for the long muscles of the lower extremities as well as the gastroc soleus
group.
!l:IORT TERM GOALS: (Date of attainment - 4/13/98)
1. Eliminate left posterior knee pain In stability sensation and swelling, 0/10.
2. Introduce tl.tolerable exercise in clo'SI;td kinetic chain position that will enable the patient to
return to hi,S premorbld functional activities.
3. Educate the patient on basic anatomy, proper posture and a home care/exercise program
which supplements Physical Therapy.
4. Improve lower extremity flexibility.
TREAIMENT PLAN: Mr. Stanley has been scheduled for outpatient Physical Therapy services 3
times per week for 3 to 4 weeks starting on 3/25/98. Treatments will Include:
1. Phonophoresls.
2. Cold packs.
3. Education and a hOme care/exercise program, and a strength/endurance program for the
lower extremities particularly In closed chain positions.
