Visa card number thereby rcndering the numbcr previously given to Delcndant lJ.HlIul invalid.
8. On 01' about March 9, 1998 Plaintiff contacted Defcndant U-I-Iaul to make
anangements to pick up the personal bclongings which he hlld storcd with said Defendant.
9. At that time Defendant U-I-Iaul advised Plailltiffthat his goods had been sold at
auction on 01' about March 6, 1998.
10. At no time was Plaintiff given notice by Defendant lJ.Haulthat his goods would
be auctioned off.
II. The fair market vllluc of Plaintiffs goods auctioned without authorization or
knowledge of Plaintiff is $19,845. Attachcd hereto, marked as Exhibit "B" and incorporated
herein by reference is a complete itemized listing of said property.
12. In addition,Plaintiffincurrcd thc following additional damages:
a.) $'1,700 penalty for borrowing $17,000 from mutual funds to buy furniture; and
b.) $4.760 penalty to pay taxes on the $17,000 at 28%.
Total: $6,460
13. In addition, PlaintitT lost intercst on his mutual fund account by having to
withdraw $17,000 to purchase replacement fltrniture.
14. Plaintiff hilS further been harmed by the lost sentimental value/value to the owner
of the hems sold.

15. Plaintiff also lost time from work and incurred othel' expenses in attempts to
recover his property and in having to replace thc property.
COUNT I -- Brcach of'Contract
16. The averments of paragraphs 1-15 hercof are incorporatcd hcrein by reference.
17. The contract entercd into bctween PllIintiff and Defendant is uttached hereto,
marked as Exhibit "A" and incorporated herein by refcrcnce.
18, By failing to return Plaintiffs goods upon dClIlllnd lInd selling them without prior
notice to Plaintiff, Defcndant has brcached the terms of sllid contract.
19. Defendant U..Haul has breached the aforesaid contraet und is liable to Plaintiff for
the value of the goods lost plus sentimental value/valuc to the owner, plus incidental and
consequential damages incurred by Plaintiff, interest, costs of suit and damages for delay.
WHEREFORE, Plaintiff demands judgment against Defendant U-Haul, in an amount in
excess of Twenty Five Thousand Dollars ($25,000.00) plus interest, costs of suit and damages
for delay.
COUNT 11 - Bailment

21. Plaintiffs delivery of his property to Defendant U-Haul, to store ona monthly

and further, any failure on the part of Plaintiff to receive any
notice generated by Defendant was due solely and exclusively to
the actions, or failures to act, on the part of the Plaintiff.
11. Denied. It is specifically denied that
Plaintiff's goods were auctioned without authorization or
knowledge of Plaintiff, and strict proof thereof is demanded at
the time of trial. It is further specifically denied that the
fair market value of any goods belonging to Plaintiff was
$19,845.00, and strict proof thereof is demanded at the time of
trial. By way of further answer, the itemization of property
attached to Plaintiff's Complaint as Exhibit "B" is specifically
denied, and strict proof thereof is demanded at the time of
trial. By way of further answer, Defendant is without knowledge
or information sufficient to form a belief as to the truth of the
averment, or the exhibit referred to therein, and strict proof
thereof is demanded at the time of trial.

12. Denied. It is specifically denied that Plilintiff
has incurred any damages whatsoever, including, but not limited
to, the following:
(a) It is specifically denied that Plaintiff incurred
any penalty in any amount for borrowing any amount of money from
any mutual fund for any purpose including, but not limited to,
for the purchase of furniture, and strict proof of each element
of this averment is demanded at the time of trial; and
(b) It is specifically denied that Plaintiff incurred
any penalty whatsoever in the form of any amount for the purpose
of paying any taxes on any amount at any percentage, and strict
proof thereof is demanded at the time of trial. By way of
further answer, it is specifically denied that Plaintiff suffered
any loss or damage whatsoever as a result of any act, or failure
to act, on the part of Defendant. To the extent that Plaintiff
incurred any losses, those losses are attributable solely to
Plaintiff's own actions or failures to act.
13. Denied. It is specifically denied that Plaintiff
lost any interest on any mutual fund account in any amount
whatsoever, for any purpose whatsoever, and strict proof thereof
is demanded at the time of trial. By way of further answer, it
is specifically denied that Plaintiff suffered any loss as a
result of any action, or failure to act, on the part of
Defendant. By way of. further answer, any loss suffered by

17. Admitted. The storage rental contract entered
into by the Plaintiff and the Defendant is attached hereto as
Exhibit "A" and made a part hereof.
18. Denied. The averment sets forth a legal
conclusion, to which no response is required. By way of further
answer, it is specifically denied that Defendant breached the
terms of the storage rental contract, and strict proof thereof is
demanded at the time of trial. By way of further answer, it is
specifically denied that the Plaintiff at any time demanded
return of his goods, and strict proof thereof is demanded at the
time of trial. By way of further answer, it is specifically
denied that Defendant sold any goods belonging to Plaintiff
without prior notice to Plaintiff and strict proof thereof is
demanded at the time of trial. By way of further answer, all
actions on the part of Defendant were consistent with law and
were consistent with the terms of the storage rental contract.
19. Denied. The averment sets forth a conclusion of
law, to which no response is required. By way of further answer,
Defendant specifically denies breaching the storage rental
contract in any manner, and strict proof thereof is demanded at
the time of trial. Defendant denies all liability to Plaintiff
of whatsoever sort or nature. Further, Defendant denies that any
goods allegedly belonging to Plaintiff possessed any value to
Plaintiff and/or sentimental value to Plaintiff, and strict proof
thereof is demanded at the time of trial. By way of further

Defendant specifically denies that any property of Plaintiff/s
was unlawfully sold, and strict proof thereof is demanded at the
time of trial. To the contrary, Defendant at all times acted
within its rights under the law and under the otorage rental
contract.
WHEREFORE, Defendant respectfully requesto that this
Honorable Court enter judgment in its favor, and against
Plaintiff, plus an award to Defendant of interest, costs of suit
and attorney's fees.
NEW MATTER
29. Responding Defendant incorporates by reference its
responses to Paragraphs 1 through 28 of Plaintiff's Complaint as
set forth herein at length.
3D. Under the terms of the storage rental contract
(Exhibit "A" hereto) / Plaintiff selected the optional credit card
payment plan, by which he specifically authorized Defendant to
automatically charge his credit card account every month for
rental payment for the storage area set forth in the storage
rental contract.
31. Pursuant to the storage rental contract, and
specifically the addendum thereto, plaintiff provided Defendant
with a Visa account number for the express purpose of automatic
payment of the rentals set forth in the contract.

point Defendant was adviEled that Plaintiff no longer worked at
the number he had provided. F'Llrt.her telephone calls were placed
by Defendant's employees to Plaintiff at the home telephone
number he had provided, and such calls were placed on ,January 23,
25, February 9, 10, 11, 16 and 19, 1998. No contact was made
with Plaintiff. During one of those calls, on February 10, 1998,
Defendant employee John Strobert contacted an answering machine,
upon which he left a message for Plaintiff. No response to the
message was received from the Plaintiff.
36. On or about January 26, 1998, Defendant sent to
Plaintiff, at the address Plaintiff had provided, a "lien
sale/notice" (Exhibit "D" hereto) by certified mail. A copy of
the certified mail card and the envelope are also appended as
part of Exhibit "D". This letter was returned to Defendant
marked "Forwarding Address Expired." (Exhibit "0" hereto).
37. The letter sent on January 26, 1998, which bore a
January 13, 1998 date, indicated that Plaintiff's rental payment
for the storage room was overdue and that the stored property
would be sold to satisfy the Hen on or about March 6, 1998.
38. On or about February 19, 1998, Defendant
transmitted to the Patriot News Legal/Classified Advertising
Department, a classified advertisement to be published in the
Patriot News on February 24 and March 2, 1998. A copy of that
advertisement is attached hereto as Exhibit "E".

39. On or about Pebruary 24 and March 2, 1998,
advertisement of the public sale of the items contained in
Plaintiff's storage room was published by the Patriot News. A
copy of that proof of publication is attached hereto as Exhibit
!IF",
40. On or about March 6, 1998, the public auction was
held, as set forth in the letter to Plaintiff (Exhibit "0") and
the advertisement in the Patriot News (Exhibit "E", "P"). The
entire contents of Plaintiff's rented storage room were sold.
41. Approximately one day following the sale,
Plaintiff contacted Defendant to notify Defendant of his new
telephone number. During that telephone conversation, upon
information and belief, Defendant advised Plaintiff that he had
received Plaintiff's messages, but did not call since he believed
that the automatic payment provisions were being utilized through
Visa to cover the rental costs. At that time, Plaintiff also
notified Defendant of his new address and telephone number.
Prior to that date, Plaintiff had not notified Defendant of a new
address or telephone number.
42. Plaintiff's claims are barred by the doctrine of
accord and satisfaction.
43. Plaintiff's claims are barred by the doctrine of
arbitration and award.
44. Plaintiff's claims are barred by the doctrine of
consent.

5, Pursuant to the terms of the aforesaid written contract, Plaintiff was required 10
pay a monthly fee 01'$68.85.
6. Plaintill'executed the "Optional Credit Card Pllymentl'lan" section of the written
contraet authorizing monthly deductions in the amount of $68.85 to be posted to his Creslar Visa
credit card. Specifically, Plaintiff did not authorize monthly deductions to be made to the
Meridian Visa card.
5. Defendant V-Haul agreed that the monthly rental charge in the amount 0[$68.85
would be posted to Plaintiff's Crestar Visa card.
7. Defendant failed to adhere to the provisions of the written contract. Specifically,
Defendant disregarded Plaintiff's specific, limited authorization detailed in the "Optional Credit
Card Payment Plan" and posted monthly rental deductions to the unauthorized Meridian Visa
account.
8. As clearly indicated on the written contract, the Meridian Visa account expired
10/97.
9. On or about March 9, 1998 Plaintiff contacted Defendant V-Haul to make
arrangements to pick up the personal belongings stored with Defendant.
9. At that time Defendant U-Haul advised Plailltiffthat his goods had been sold at
auction on or about March 6, 1998.
10. At no time was Plaintiff given notice by Defendant V-Haul that his goods would
be auctioned off.

12. In addition, I'laintiff incurrcd the following additional damages:
a.) $1,700 penally for borrowing $17,000 from mutual funds to buy furniture; and
b.) $4.760 penalty to pay taxes on the $17,000 at 28%.
Total: $6,460
13. In addition, I'laintiff lost Interest on his mutual flmd account by having to
withdraw $17,000 to purchase replacement furniture.
14. Plaintiff has furthcr been harmed by the lost sentimental value/value to the owner
of the items sold.
15. Plaintiff also lost time from work and incurred other expenses in attempts to
recover his property and in having to replace the property.
COUNT I -- Breach ofConlrac(
16. The avennents of paragraphs 1-15 hereof are incorporated herein by reference.
17. The contract entered into between Plaintiff and Defendant is attached hereto,
marked as Exhibit "A," and incorporated herein by reference.
18. By tailing to adhere to the provisions of the written contract, specifically the
"Optional Credit Card Payment Plan" authorizing monthly rent to be deducted from the erestal'
Visa Account, Defendant breached the tenns of said contract.
18. By flliling to return Plaintiff's goods upon demand and selling them without prior
notice to Plaintiff, Defendant has breached the terms of said contract.

19. Defendant V-Haul has breachcd the aforesaid contraet and is liable to Plllintiff for
the value ofthe goods lost plus sentimental valuc/value to the owner, plus incidental and
consequential damages incurred by Plaintiff, including interest, costs of suit IInd damages for
delay.
WHEREFORE, Plaintiff demands judgment against Defendant t I-Haul, in an amount in
excess ofTwenty Five Thousand Dollars ($25,000.00) plus interest, costs of suit and damages
for delay.
COUNT II Negligence
19, The averments of paragraphs 1-20 are incorpol'llted herein by reference.
20. Pursuant to the terms of the written contract, Defendant was authorized to post
monthly rental deductions only to Plaintiffs Crestar Visa card.
21. Contrary to the terms of the written contract, Defendant, without authorization,
posted monthly deductions to Plaintiffs Meridian Visa card, which card Defcndant knew would
expire October 1997.
22. Because Defendant's monthly rental fees were paid from Plaintiffs Meridian
Visa card, upon its expiration, Defendant's monthly fees were no longer paid.
23. Because monthly rental fees were no longer paid, Defendant exercised its rights
under the Landlord's Lien provisions ofthe written contract and sold off Plaintiff's
property found in Defendant's storage facility.

24. As a result, Plalntlffhas becn deprlvcd of the ownership and enjoyment of his
persona,! property st<lred at Defendant's facility.
25. Defendant was negligcnt in failing to adhere to the "Optional Credit Card
Payment I'lan" provisions of the contract, resulting in Plaintiffs loss of personal property.
WHEREFORE, Plaintiff demands judgment against Defendant V-Haul in an amount In
excess of Twenty Five Thousand Dollars ($25,000.00) plus interest, costs of suit and damages
for delay.

21. Plaintiff's delivery of his property to Defendant V-Haul, to store on a monthly
basis for a fee created a bailment.
22. Plaintiffhas demanded the return of his property and Dcfendant, as the bailce, has
failed to return said property to Plaintiff.
23. Defendant V-Hau1's failure to return Plaintiff's goods upon demand and sale
thereof without prior notice to, or consent of; Plaintiff constitutes ordinary negligence and
thereby renders Defendant V-Haulllab1e to I'laintiff I'm the value of the goods lost plus
sentimental value/value to the owner, plus incidental and consequential damages incurred by
Plaintiff, interest, costs of suit and damages for delay.
WHEREFORE, Plaintiff demands judgment against Defendant V-Haul In an amount in

Complaint as an Exhibit. The actual document signed by thc Plaintiff is IIttllched hcreto as
Exhibit "1 ". Thc difterence bctween thesc documcnts is that the document signed by the
Plaintiff and presented to Defendant contains only 12 digits in Plaintiffs Visa curd account
number, as opposed to the document attached to I'luintiffs Complaint, which apparently contains
all 16 digits of his account number. Further, Defendant specifically denies that Plaintiff did not
authorize monthly deductions to be made from the Mcridilln Visa curd (bcing the card with
which he puid thc Novcmbcr 23-- December 31, 1996 rentul).

act.

Visa curd. I'luintiff failcd to providc u complete uccount numhcr for the Crcstar Visa card to thc
Deli:mdunt. Strict proofofl'laintifl's avel'ment is dcmanded ut the til11c of trial. Fl1l1her,
Plaintiff, despite his knowledge of the continued postings to the Meridian Visa card, failed to
notify or otherwise take aetion to ensure that eharges would be posted to the Crestar Visa card.
Therefore, Plaintiffeonsented to the continued posting of monthly rental deductions against the
Meridian card.
21. Denied, Thc temls of the written contract speak for themselves, and no
resr>onse is rcquired. Further, Defendant, at all times, acted within the tenns of the written
contract and within any authorization grantcd to it by Plaintiff. Plaintiff knew that his Meridian
Visa card would expire in October, 1997 yet continue to allow Defendant to post monthly rental
charges against that card without complaint.
22. Admitted with the proviso that it continued to be Plaintiff's obligation under
the tenns of the contract to see that Defendant's monthly fees would continue to be paid
following the expiration of I'laintifrs Meridian Visa card.
23. Admitted with the proviso that the provisions of the contract speak for
thcmsclves and no fUl1hcr response is requircd. At all times relevant hereto, Defendant acted in

Plaintiff at his address of rccord, is attached hereto as Exhibit "C". Following his rcceipt of thai
notice, Plaintiff puld for thc Junuary, 1997 rcnt hy personal check on or about January 7, 1997.
(Exhibit "8" hcrcto).
33. Thc datc ofthr contract was Novcmber 23,1996, On January 7,1997,
Plaintiff paid by chcck for the January, 1997 rent. Thereafter, from February, 1997 through and
inclUding November 30, 1997, Plaintifrs rent was automatically charged to his Mcridian Visa
account, and such payment was receivcd by Defendant. Copies of the receipts confirming the
charges against thc Mel'idian Visa account of Plaintiff arc attachcd hereto collcctively as Exhibit
"Btl,
34. Thereafter, when Defendant attempted to obtain paymcnt for the monthly
rentals by obtaining an automatic charge against Plaintiff's Meridian Visa account, Defendant
was informed that Meridian Visa declined to accept thc chargc for payment. No I'eason was
offered by Meridian Visa.
35. Dcfendant then placed telephone calls to Plaintiff'at the phone number

provided by I'I1Iintiffllt the time of the execution of the stol'uge rental contrucl. Telephone calls
were placed to Defendllnt's work numher on .Iunuary 20, 1998, ut which point Defendunt was
advised thut I'I1Iintiffno longer worked at thc numhel' he had pl'Ovidcd. Further telephone calls
were placcd by Defendllnl's omJlloyces to I'laintiff at thc home tclephone number he had
provided, and such calls were placed on January 23, 25, Fehruary 9, 10, II, 16 and 19, 1998. No
contact was made with Plaintiff. During one of those calls, on February 10, 1998, Defendant
employee John Strohert contactcd an answering machine, upon which he left a message for
I'laintiff. No response to the message was received from thc I'laintiff.
36. On or about January 26, 1998, Defendant sent to PlaintifC at the address
Plaintiff had provided, a "lien sale/notice" (Exhibit "D" hereto) by certified mail. A copy of the
certified mail card and the envelope are also appended as part of Exhibit "D". This lettel' was
returned to Defendant marked "Forwarding Address Expired." (Exhibit "D" hereto).
3 7, The letter sent on January 26, .\ 998, which bore a January 13, J 998 date,
indicated that Plaintifrs rental payment for the storage room was overdue and that the stored
property would be sold to satisfy the lien on or about March 6, 1998.
38. On or about February 19, 1998, Defendant transmitted to the Patriot News
Legal/Classified Advel1ising Department, a classified advertisement to be published in the
Patriot News on February 24 and March 2, J 998. A copy of that advel1isement is attached hereto
as Exhibit "E".
39. On or about February 24 and March 2, 1998, advertisement of the public sale
of the items contained in Plaintifrs storage room WllS published by the I'atriot News. A copy of

that proof of publication is attachtJd hereto as Exhibit "F".
40. On or about March 6, 1998, the public auction was held, as set forth in the
letter to Plaintiff (Exhihit "D") and the advcrtiscmcnt in thc Patriot Ncws (Exhibit "E", "F"). The
entire contcnts of Plaintiffs I'ented storagc room wcre sold.
41. Approximately onc day following the sale, Plaintiff contacted Defendant to
notify Defendant of his new telephone number. During that telephone conversation, upon
information and bclief, Defendant advised Plaintiff that hc had received Plaintiffs messagcs, but
did not call since he believed that the automatic payment provisions werc bcing utilized througb
Visa to cover the rental costs. At that timc, Plaintiff also notified Defendant of his new address
and telephonc number. At no time during this telephone conversation, did Plaintiff make
reference, inquiry or objection to the charging of rcntals against :he Meridian Visa as opposed to
the Crestar Visa. Nor did I'laintiff draw to Defendant's attention that he still had a Crestar Visa
account open for that purpose. Because Plaintiff was rccciving Meridian Visa statements, as well
as Crestar Visa statements, he knew or should have known that charges wcre being placed
against the Mcridian, as opposed to Crestar accounts for thc rcntals. Prior to that date, Plaintiff
had not notified Defendant of a new addrcss or telephonc number.
42. On or about August 30, 1997, which was during the life of the contract, and
prior to the October, 1997 expiration of the Mcridian VISA card, Plaintiff completed a change of
address order with thc United States Postal System, changing his addrcss from P.O. Box 1442
Mechanicsburg, I'A to 1434 Butts Road, 2"" Floor, Breinigsvillc, PA. A copy of that ordcr is
attached hereto has Exhibit G and made a part hereof. At no timc, prior to this change of

address, had Plaintiff provided Defendant with the Mcchllnicsbul'g I'ost Office Box mailing
Ilddress. The only addrcss which thc Defcndant had for thc I'laintiffwas the one PllIinliffgave at
the time that hc began the rentlll contl'llct IInd lit thc time that he executed the credit card
authorization, which was 486 Brighton Place, Mechanicshurg, I'A.
43. The changc of lIddrcss ordcr from the M~chanicshurg Post Oflicc to the
Brelnigsvllle address (Exhibit G hercto) also indicated not only t1mtlhc Plaintiffs move was not
tcmporary, hut Iistcd whatapparcntly purports to br I'laintiffs night time phone numbcr at the
time that he execuled the change of addrcss 1'01'111. That phone number was ncvel' providcd to
Defendant, and was different than thc phone number Plaintiffprovidcd at thc time he
commenccd the rental contract.
44. Upon information and helieI', somctime in Scptemhcl', 1997, and prior to
Septcmber 25, 1997, Plaintiff IIga.in exccutcd a forwarding ol'dcr changing his IIddrcss from 1434
Butts Road Breinigsville, PA to 1'.0. Box 12 Breinigsvillc, pA. A copy of this change order also
appears on Exhibit G hereto IInd is made II part hereof. This second chunge order was activated
by the Plaintiff during thc time of the rental contract, and prior to the October, 1997 expiration of
the Meridian VISA card. At no limc did I'laintiff providc Defendant with the Breinigsvllle post
office box address.
45. During the time pcriod of Octobcr, 1997- March, 1998, which is the relevant
time period sct forth inl'laintiffs Complaint, Plaintiff was rcceiving, at his two scparate
Brcinigsville addresscs, information conccrning onc of his crcdit cards. It is unknown, at this
stagc, whethcr thc credit card account rcprcsented on thc exhlhils hercto (collcctively Exhibit H)

refers to either of the particular accounts mentioned in Plainlifrs Complaint. However, upon
informlltion and belief, it is averred that, irrespective of his vurious changes of address, Plaintiff
was receiving monthly statements and othcr information perlaining 10 the credit accounts sct
forth in his Complaint, which put him on noticc, or should have put him onnotlcc as to the
deduction of rental charges from the Mcridian account as opposcd to the Crestar lIccount. Such
notice would have been acquired at a sufficient amount of time to pcrmit Plaintiff to notify
Defendant of the account he wishcd to be charged, prior to inclll'ring any loss.
46. In the alternative, Plaintiffs fililurc or refusal to provide accurate and current
address and telephone infOlmation to Dcfcndant resulled from either negligence on the part of
Plaintiff or, in the alternative, was intcntional on Plaintiffs part for the purpose of avoiding, or
delaying, fulfillment of his payment obligations for the rentals.
47. I'laintiffs claims ale barred by the doctrine of consent, in that Plaintiff by his
inaction agreed to the continued charging against the Meridian VISA account for rental expenses.
Also, Plaintiff, by his agfecmcnt (Exhibit Al consented to the actions taken by Defendant
regarding the sale.
48. Plaintiffs claims are barred by the doctrine of estoppel, in that Plaintiff
received the benefit of the storage, and Defendant granted that benefit in reliance upon Plaintiffs
providing accurate credit card, addrcss and telephone information.
49. I'laintiffs claims arc barred by the doctrine of fraud.
50. Plaintiffs claims are harred by the doctrine of illegality, in that the charging
to the Crestar card for the rental expenses would have been illegal without I'laintiffs providing

the full and entire credit account nUll1her.
51. Plaintifrsclaims are harl'ed by thc doctrine of il11possibility of performance,
in that Defendant could not impose rentals upon the Crestar card without rcceipt of the full
account number. Further, Dcfendant could not give notice to Plainti ff of the impending sale of
his items of propel'ly hecausc Plaintiff did not provide accurate, current address and telephone
information.
52. Plaintifl's claims are barred by the doctrinc of justification, in that Plaintiff
authorized the actions taken hy Defendant as set forth in the rental agreement (Exhibit A hereto).
53. Plaintifrs claims arc barred hy the doctrine of latches, in that Plaintiffknew,
or should have known, that what he considered to be the incorrect account was being charged for
the rcntals, yet he accepted the services, and chose not to point out the alleged error to Defendant
54. Plaintifrs claims are barred by the doctrine of license, in that Plaintiff gave
Defendant license to charge his Meridian card for monthly rentals, as well as license to take
whatever actions were necessary upon Plaintifrs default of the contract, as set forth in the
contract (Exhibit A).
55. Plaintifrs claims are barred by the doctrine of release, in that the agreement
(Exhibits I, A) functions as a release of Defendant from liability for all actions taken pursuant to
that contract once Plaintiff is in default.
56. Plaintifrs claims are barred by the doctrine of waiver, in that Plaintiff waived
his objections to the continued charging against the Meridian VISA card by his failure to object,
even though he knew, or should have known, 01' had notice of, those continued charges well in

Pennsylvania location, told Plaintiff, in response to Plaintiff/s
telephone call, that the goods had been Bold at a public sale.
10. Denied. It is specifically denied that Plaintiff
was not given notice by Defendant that his goods would be
auctioned off, and strict proof thereof is demanded at the time
of trial. By way of further answer, Defendant provided Plaintiff
with each and every type of notice required by law or contract,
and further, any faUure on the part of Plaintiff to receive any
notice generated by Defendant was due solely and exclusively to
the actions, or failures to act, on the part of the Plaintiff.
11. Denied. It is specifically denied that
Plaintiff/s goods were auctioned without authorization or
knowledge of Plaintiff, and strict proof thereof is demanded at
the time of trial. It is further specifically denied that the
fair market value of any goods belonging to Plaintiff was
$19/845.00, and strict proof thereof is demanded at the time of
trial. By way of further answer, the itemization of property
attached to Plaintiff' s Complaint as Exhibit "B" is specifically
denied, and strict proof thereof is demanded at the time of
trial. By way of further answer, Defendant is without knowledge
or information sufficient to form a belief as to the truth of the
averment, or the exhibit referred to therein, and strict proof
thereof is demanded at the time of trial.

32. Prior to the commencement of the automatic charges
against Plaintiff's visa account for the rentals. Plaintiff was
delinquent in the payment of his rent for the storage room that
was due on January 1, 1997. A copy of the late notice which was
sent to Plaintiff at his address of record, is attached hereto as
Exhibit "CR. Following his receipt of that notice, Plaintiff
paid for the January, 1997 rent by personal check on or about
January 7, 1997. (Exhibit "B" hereto).
33. The date of the contract was November 23, 1996.
On January 7, 1997, Plaintiff paid by check for the January, 1997
rent. 'l'hereafter, from February, 1997 through and including
November 30, 1997, Plaintiff's rent was automatically charged to
his Visa account, and such payment was received by Defendant.
Copies of the receipts confirming the charges against the Visa
account of Plaintiff are attached hereto collectively as Exhibit
IIBll .
34. Thereafter, when Defendant attempted to obtain
payment for the monthly rentals by obtaining an automatic charge
against Plaintiff's Visa account, Defendant was informed that
Visa declined to accept the charge for payment. No reason was
offered by Visa.
35. Defendant then placed telephone calls to Plaintiff
at the phone number provided by Plaintiff at the time of the
execution of the storage rental contract. Telephone calls were
placed to Defendant's work number on January 20, 199B, at which

39. On or about 11ebruary 24 and March 2, 1.998,
advertisement of the public sale of the items contained in
Plaintiff's storage room was published by the Patriot News. A
copy of that proof of publication i8 attached hereto as Exhibit
IIFII,
40. On or about March 6, 1998, the public auction was
held, as set forth in the letter to plaintiff (Exhibit "D") and
the advertisement in the Patriot News (Exhibit "8", "F"l. The
entire contents of Plaintiff's rented storage room were sold.
41. Approximately one day following the sale,
Plaintiff contacted Defendant to notify Defendant of his new
telephone number. During that telephone conversation, upon
information and belief, Defendant advised Plaintiff that he had
received Plaintiff's messages, but did not call since he believed
that the automatic payment provisions were being utilized through
Visa to cover the rental costs. At that time, Plaintiff also
notified Defendant of his new address and telephone number.
Prior to that date, Plaintiff had not notified Defendant of a new
address or telephone number.
42. Plaintiff's claims are barred by the doctrine of
accord and satisfaction.
43. Plaintiff's claims are barred by the doctrine of
arbitration and award.
44. Plaintiff's claims are barred by the doctrine of
consent.
