STIPULATION AGAINS'r I.!ENS
THIS AGREEMENT made the J~ll,L1ay of -~l!-J': I , 1998,
by and between CUMBERLAND DESIGN' BUILDING COMPANY. INC., Post and
'Claremont Roads, P.O. Box 248, Carlisle, PA 17013, hereinafter
referred to as CONTRACTOR,
and
PYRAMID GROUP, 590 California Road, Quakertown, PA 18951,
hereiuafter 1.'eferred to as OWNERS, whereby the former undertook and
agreed to erect and construct an addition to a facility on the
certain lot of ground situate in Newville Borough, Cumberland
County, Pennsylvania, more fully bounded and described in
Cumberland County Deed Book 115, Page 253 and Deed Book V-34, Page
1059.
NOW THEREFORE, THIS AGREEMENT WITNESSETH I That the said
CONTRACTOR, for and in consideration of the sum of one ($ 1.00)
D01,LAR to them in hand paid by OWNER, the receipt. whereof is hereby
acknowledged, and the fur-t.her consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and
all parties acting through or under them, covenant and agree that
no mechanic's liens or claims shall be filed or maintained by them
or any of them against the said buildings andt.he lot of ground
appurtenant t.hereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise,
for, towards, in, or about the erection and construction of the
saId bull.cUngs on the lot above described, and the said CONTRACTOR,
for themselves, their subcontractors and others under them hereby
expr.-essly waive and relinquish the right to have, file, and
maintain any mechan.ic' fl I iens or claims against the said real
est.ate and/or buildings or any of them, and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.
