Carlisle, PA 17013 (717) 240-6200 8, Due to the impact of the vchlclcs, Plaintiff's vehlele struck the guardrall causing damage to the Plaintiffs truck pnd the guurdruil. 9, At ull times relevunt to this compluint, Defendunt Kitner's Pennsylvllnia driver's license wus under suspension, and Defendant Kitner was eited at the scene of the accident for driving under a suspended license and for failing drive the vehicle at a safe speed, COUNT I NEGLIGENCE East Coust Leasing v, Barry L. Kitner 10, Paragraphs I - 9 are incorporated by reference as if set forth at length. 11. Defendant Kitner operated the Defendant Henry's vehicle in a negligent mlUUler causing damage to Plaintiffs vehicle in that Defendant Kitner: a) operated the vehicle on public roadways while under a suspended license; b) failed to operate the vehicle at a safe speed; e) failed to keep alert and maintain a propcr watch for vehicles on the highway; d) failed to operate the vehicle in a safe manner with due regard for the highway and traffic conditions; e) failed to obey and operate the vehicle in accordance with the traffic. signs and signals; f) failed to keep proper and adequate control over the vehicle, 12. As a result of Defendant Kitner's negligent operation of defendant Henry's vehicle, Plaintiff suffered property damage and costs Including: a) repairs to Plaintiffs vehicle in the amount of $8,645,93; b) towing costs in the amount of$I,475,00; 16.
