The front porch roof was a built-up roof that did not leak and which drained
. toward the house Into existing downspouts. Plaintiff reversed the flow of the water so that it
now flows out over the edges of the porch, This makes the porch useless when it rains and
causes a dangerous condition in freezing weather, as water collects and freezes on the porch
and the sidewalk leading to the porch.

WHEREFORE, Defendant requests this Honorable Court to dismiss Plaintiff's
complaint with prejudice.
COUNTERCLAIM
10. The garage roof was a built-up roof that did not leak and which properly
drained away from the house Into existing downspouts. Plaintiff improperly repaired the
roof for the following reasons:
a. The built-up roof was broken up with portions removed thereby
making it no longer waterproof.
b. The water flow was reversed so that it now runs toward the house and
away from the existing downspouts,
c. Water now collects on the roof with some of it not draining
whatsoever.
d. The rubber roof material was applied in a very uneven manner with
the result that there are potholes and ripples throughout the 1'00f, which will greatly shOlten
the useful life of that material.
e. The roof' now leaks and has caused significant water damage.
II. The front porch/portico roof' did not leak and drained back toward the house
where there are downspouts. Plaintiff' did not properly repair this roof for the following
reasons:
a. The flow of the water was reversed so that it did not reach the
downspouts.
b. The reverse in water flow causes water to run off the front and sides of
the roof and down onto the floor of the porch as well as the sidewalk. This makes use of the
porch during rain and/ or freezing weather uncomfortable and possibly dangerous.
c. The water flow over trim, which surrounds the front and sides of the
porch, stains the trim making it unsightly with the probability that it wil1 deteriorate quickly.
12. Delendant contacted Plaintiff on many occasions explaining the problems.
Some minor repair attempts were initiated but despite repeated requests Plaintiff failed to
correct any of these problems.
13. After waiting more than five months for repairs, Defendant contacted other
roofing contractors to complete the project. The work and material as supplied by Plalntlft'
has actually worsened the situation, as it will need to be removed prior to the proper
installation of two new roofs.
14. The cost of repairing and replacing the garage roof will be at least $4,700.00.
The cost of repairing and replacing the front porch/portico roof will be at least $2,850.00,
Due to scheduling problems, the work has not been completed so there is a possibility that If
additional damage is discovered the total cost could increase.

COMPLAINT
AND NOW, comes Plaintiff Ewing Roofing, Inc. by and through
its attorneys, Saidis, Shuff & Masland and brings the following
action and avers as follows in support thereof:
1. Plaintlff Ewing Roofing, Inc. is a Pennsylvania
oorporation with a principal place of business at 1425 Spanglers
Mill Road, Camp Hill, Cumberland County, Pennsylvania 17011.
2. Defendant Murrell R. Walters, ls an adult individual
with a resldential address of 301 Brindle Road, Mechanicsburg,
Cumberland County, Pennsylvania 17055.
3. On or about the 27th day of October, 1997 Plaintiff was
hired by Defendant to replace the existing roofs on Defendant's
garage and porch at his residence.
4. Plalntiff performed the following work in replacing the
existlng roofs:
a. meohanically fastened half inch recovery
board directly over existing roofs;
b. adhere Carlisle. 60 Rubber to recovery board;
c. lnstall aluminum edging;
d. flash the edging, posts "nd wall and any
other penetrations; and
e. clean up and haul debris.

12. Admitted in part, Denied in part, It. is admitted that
Defendant contacted Plaintiff on many occasions explaining the
problems. It is denied that repairs were required to the work to
which Plaintiff performed on the roof, bllt instead, modifications
were requested by the cllstomer in an attempt to resolve the pre-
existing problems,
13. Denied. It is specifically denied that the work and
materials sllpplied by Plil.intiff worsened the situation. On the
contrary, the work and material supplied by Plaintiff were to
place a roof over the current pre-existing roof and did not
change the slope or direction of water flow. Strict proof that
the work and materials supplied by Plaintiff actllally worsened
the sitllation is demanded ,if deemed relevant at time of trial.
14. Denied. Plaintiff is withollt sufficient knowledge or
information to form a belief or opinion as to the truth or
accllracy of Defendant's averments Counterclaim paragraph 14.
However, it is denied that the total cost to complete the work
when Defrmdant initiated would increase, under any circumstances,
