5. T\1e parties agreed on the record that the court
resolve all of the economic issues as follows:
Mr. Mottern has a profit sharing plan with Sheaffer
[sio] Truoking. The marital portion of the profit sharing
plan will be divided by means of QDRO with 60% of the
marital portion going to wife and 40% going to husband.
Wife will obtain the preparation of the QORO and will pay
the first $250.00 of the fee to have that done. If there
is additional fee in excess of $250.00, the parties will
split that additional cost.
For purposes of detennining the coverture fraction,
there ia one issue that needs to be ironed out regarding
husband's start date of participation in the plan. We
understand that Mr. Mot tern worked for Sheaffer [sic]
Trucking on a part-time basis before he started full-time
and we do not know exactly when, for plan purposes, he
began to participate after the marriage or he may have had
a brief period of participation prior to the marriage. We
need to get those dates squared away so the QDRO oan
,properly compute the coverture fraction.
6. Bill Lackey, of Shaffer Trucking, Inc., reports that
Defendant began participation for plan purposes on July 1/ 1978.
7. Because there was some 12 years between the Date of
Marriage (09/17/78), and the Date of Distribution (08/30/00), it
is submitted that the difference between the Start Date
(07/07/78) and Date of Marriage (09/17/78) is de minimis; for
convenience, the Coverture Fraction should be computed at 100%.

liability for provision of the Participant/s benefits described
below i8 incurred, shall also be subject to the terms. of this
Order. Also, any benefits accrued by the Participant under a
predecessor plan of the employer or any other defined
contribution plan sponsored by the Participant / s employer /
whereby liability for benefits accrued under such predecessor
plan or other defined contribution plan has been transferred to
the Plan, shall also be subject to the terms of this Order.
Any changes in plan Administrator, plan Sponsor/ or name of
the plan shall not affect Alternate Payee/s rights as stipulated
under this Order.
5. pursuant to State Domestic Relations Law. This Order
is entered pursuant to the authority granted in the applicable
domestic relations law of the Commonwealth of Pennf!Ylyania.
6. For provision of Marital property Rights. This Order
relates to the provision of marital property rights and/or
spousal support to the Alternate Payee as a result of the Order
of Div9~ between Participant and Alternate Payee.
7. Amount of Alternate Payee's Benefit. This Order
assigns to the Alternate Payee an amount equal to ~J:xty
Eerce~t (6Q!l of the Participant' s Total Account Balance
accumulated under the plan as of Augu~t 30/ 2000. Such amount
will be withdrawn from the Participant / s investment accounts
(other than any loan account of the Pnrticipant's) pro rata.
Further, such Total Account Balance shall include all r~mounts
maintained under all of the various accounts and/or subaccounts
established on behalf of the Participant. Such Total Account
Balance shall be determined wi thout regard to any account
reduction caused by Participant's prior loan(s), if any, from
the Plan.
The Alternate payee/s portion of the benefits described
above shall be segregated and separately maintained in
Account(s) established on her behalf and shall additionally be
credited with any interest and investment income (or losses)
attributable thereon from the plan's valuation date immediately
following August 301~_QOO, until the date of total distribution
to the Alternate Payee.
e. Commencement Date and Form ot Payment to Alternate
Payee. If the Alternate Payee so elects, she shall be paid her
ben~fits as soon as administratively feasible following the date
this Order is approved as a CDRO by the plan Administrator and
the Order is final, or at the earliest date permitted under the
terms of the Plan, if later. Benefits will be payable to the
Alternate Payee in any form or permissible option otherwise
available to Participant under the terms of the Plan, including,
but not limited to/ a lump sum distribution.
9. Alternate Payee's Rights and Privileges. On and after
the date that this Order is deemed to be a QDRO, but before the
Alternate Payee receives her total distribution under the Plan,
the Alternate Payee shall be entitled to all of the rights and
election privileges that are afforded to Plan participants and
beneficiaries, including, but not limited to, the rules
regarding in-service withdrawals and distributions, the right to
designate a beneficiary for death benefit purposes, and the
right to direct Plan investments, all to the extent permitted
under the provisions of the Plan.
10. Death of Alternate Payee. In the event of the
Alternate Payee's death prior to her receiving the full amount
of benefits called for under this Order and under the benefit
option chosen by the Alternate Payee, such Alternate Payee's
beneficiary(ies) / as designated on the appropriate form provided
by the Plan Administrator, shall receive the remainder of any
unpaid benefits under the terms of this Order, and in accordance
with the benefit option selected by the Alternate Payee.
11. Death of Participant. In the event that the
Participant dies prior to the establishment of separate
account(s) in the name of the Alternate Payee, such Alternate
Payee shall be treated as the surviving spouse of the
Participant. for any death benefits payable under the Plan to the
may be amended from time to time, and that the Plan
Administrator shall reSArve the right to reconfirm the qualified
status of the Order at the time benefits become payable
hereunder.
15. Tax Treatment of Distributions Made Under This Order.
For purposes of sections 402(a) and 72 of the Internal Revenue
Code, any Alternate Payee who is the spouse of former spouse of
the Participant shall be treated as the distributee of any
distribution or payments made to the Alternate Payee under the
terms of this Order, and as such, will be required to pay the
appropriate federal income taxes on such distribution.
l6. Constructive Receipt. In the event that the Plan
Trustee inadvertently pays to the Participant any benefits which
are assigned to the Alternate Payee pursuant to the terms of the
Order, the Participant shall immediately reimburse the Al ternate
Payee to the extent that he has received such benefit payments,
and shall forthwith pay such amounts so received directly to the
Alternate Payee within ten (10) days of receipt.
17. Continued Jurisdiction. The Court shall retain
jurisdiction with respect to this Order to the extent required
to maintain its qualified status and the original intent of the
parties as stipulated herein.

After neqotiations this morninq, the Master
has been advised that the parties have reached an aqreement
with respect to the outstanding economic claims. The
agreement is goinq to be placed on the record in the presence
of the p'arties.
The aqreement as stated on the record will
be considered the substantive aqroement of the parties not
subject to any changes or modifications except for correction
of typographical errors which may be made during the
transcription. The parties and counsel are going to return
later today to review the draft of the agreement for
typographical errors, make any corrections as required, and
then affix their signatures affirming the terms of settlement
as' stated on the record at this time.
After the Master has received the 'approved
settlement document, tho Master will prepare an order vacatinq
his appointment, after which counsel can file a praecipe
transmitting the record to the Court requestinq a final decree
in divorce. Mr. Hildabrand.
MR. HILDABRAND: The parties have reached an

agreement and I will state the terms of the aqreement.
1. Mr. Mottern has a profit sharing plan with Sheaffer
Trucking. The marital portion of the profit sharinq plan will

of items that will be delivered by Mrs. Mottern to Mr.
Mottern.

b) Grandmother's antique trunk;
c) Wardrooe closet;
. d) Kentucky Flint Lock pistol,
.) Black powder bag;
f) Eagle claw fly rod;
0) Antique picture of a mountain scene;
h) Vial with qold dust and two gold nug;ets.
The exchange of the personal property will take place
within 30 days of today's date. Upon agreement of the parties
as far as a date and a time of exchange, that can be arranged
between Mr. Schwartz and myself.

Mrs. Mottern will make a diligent effort to locate all
.of the items specified above. She has indicated that she is
not sure if she ha~ the antique picture, the vial with ;old
dust and nuggets, the black powder bag, and the Eaqle claw fly
rod, but she will certainly attempt to locate them and deliver
them in the time specified.
4. During the marriage, the parties had taken out a loan
with PNC Bank for a bill consolidation. Mrs. Hottern has been

paYing that loan since the date of separation. We underetand,
that as of tOday the payoft on that loan is $13,007.05. Mr.
Mottern, &It of today, will a9SUllle full and sole responsibility
tor all tuture payments and pay ott the outstanding loan, and
he will agree to indemnity and hold harmless Mrs. Mottern on
that loan tor his tailur$ to make the payments and pay the
loan cstt.
S. Mr. Mottern will pay to Mrs. Mottern the SUlll of
$1,000.00 within sixty days by certitied or cashier's check
payable to wHe.
6. At the time of separation the parties had the following
outstanding debts:
al Providian VISA;
bl Dauphin Deposit VISA;
01 Texaco;
dl JC Penney.
The Texaco and JC Penney bills have been paid. Husband
agrees to aSSUllle sole responsibility for payment ot the
Providian VISA and the Dauphin Deposit VISA and agrees to hold
wife harmless for his failure to do so.
Both parties have indicated that at the time of
separation all joint credit cards were cancelled and closed
and there are no current joint cards existing.
7. Mr. Mottern's obligation to pay Spousal support will
continue until the issuance of a divorce decree.
8. The parties both agree to waive any. claims for alimony.
9. The parties' obligations with respect to child support
will continued to be handled through the Domestic Relations
Office.
10. Both parties agree to sign &ffidavits of consent and
.waivers for a nO-faUlt divorce, which will be signed today.
11. Both parties agree to waive any claims for counsel fees
or expenses otherwise than were stated previously in this
agreement.

he will agree to indemnify and hold harmless Mrs. Mottern on
that loan for his failure to make the payments and pay the
loan off,

6. At the time of separation the parties had the fallowing
outstanding debts:

The Texaco and JC Penney bills have been paid. Husband
agrees to assume sole responsibility for payment of the
providian VISA and the Dauphin Deposit VISA and agrees to hold
wife harmless for his failure to do sO,
Both parties have indicated that at the time of
separation all joint credit cards were cancelled and closed
and there are no current joint cards eXisting.
7. Mr, Mottern's obligation to pay spousal support will
continue until the issuance of a divorce decree.
8. The parties both agree to waive any claims for alimony.
9. The parties' obligations wHh respect to child support
will continued to be handled through the Domestic Relations
Office.
10. Both parties agree to sign affidavits of consent and
waivers for a no-fault divorce, which will be signed today.
11. Both parties agree to waive any claims for counsel fees
or expenses otherwise than were stated prevIously in this
agreement.
12. The parties are joint owners of a 1994 GEO tracker
automobile; Mr. Mottern agrees to transfer his right, title,
liability for provision of the Participant's benefits described
below is incurred, shall also be subject to the terms of this
Order, Also, any benefits accrued by the Participant under a
predecessor plan of the employer or any other defined
contribution plan sponsored by,the Participant's employer,
whereby liability for benefits accrued under such predecessor
plan or other defined contribution plan has been transferred to
the Plan, shall also be subject to the terms of this Order.
Any changes in Plan Administrator, Plan Sponsor, or name of
the Plan shall not affect Alternate Payee's rights as stipulated
under this Order.
5. Pursuant to State Domestic Relations Law. This Order
is entered pursuant to the authority granted in the applicable
domestic relations law of the Commonwealth of Pennsylvania,
6. For Provision of Marital Property Rights. This Order
relates to the provision of marital property rights and/or
spousal support to the Alternate Payee as a result of the Order
of Divorce between Participant and Alternate Payee,
7. Amount of Alternate Payee's Benefit, This Order
assigns to the Alternate Payee an amount equal to ~!xty
percent (60%)_ of the Part ic ipant' s Total Account Balance
accumulated under the Plan as of August 30, 2000. Such amount
will be withdrawn from the Participant's investment accounts
(other than any loan account of the Participant's) pro rata.
Further, such Total Account Balance shall include all amounts
maintained under all of the various accounts and/or subaccounts
established on behalf of the Participant. Such Total Account
Balance shall be determined without regard to any account
reduction caused by Participant's prior 10an(s), if any, from
the Plan,
The Alternate Payee's portion of the benefits described
above shall be segregated and separately maintained in
Account (5) established on her behalf and shall additionally be
credited with any interest and investment income (or losses)
attributable thereon from the Plan's valuation date immediately
following ~ugust 30, 2000, until the date of total distribution
to the Alternate Payee,
8. Commencement Date and Form of Payment to Alternate
Payee. If the Alterns'c Payee so elects, she ~llall be paid her
benefits as soon as administratively feasible following the date
this Order is approved as a QDRO by the Plan Administrator and
the Order is final, or at the earliest date permitted under the
terms of the Plan, if later. Benefits will be payable to the
Alternate Payee in any form or permissible option otherwise
available to Participant under the terms of the Plan, including,
but not limited to, a lump sum distribution.
9. Alternate Payee'e Rights and Privileges. On and after
the date that this Order is deemed to be a QDRO, but before the
Alternate Payee receives her total distribution under the Plan,
the Alternate Payee shall be entitled to all of the rights and
election privileges that are ~fforded to Plan participants and
beneficiaries, including, but not limited to, the rules
regarding in-service withdrawals and distributions, the right to
designate a beneficiary for death benefit purposes, and the
right to direct Plan investments, all to the excent permitted
under the provisions of the Plan.
10. Death of Alternate Payee. In the event of the
Alternate Payee's death prior to her receiving the full amount
of benefits called for under this Order and under the benefit
option chosen by the Alternate Payee, such Alternate Payee's
beneficiary (ies), as designated on the appropriate form provided
by the Plan Administrator, shall receive the remainder of any
unpaid benefits under the terms of this Order, and in accordance
with the benefit option selected by the Alternate Payee.
11. Death of Participant. In the event that the
Participant dies prior to the establishment of separate
account(s) in the name of the Alternate Payee, such Alternate
Payee shall be treated as the surviving spouse of the
Participant for any death benefits payable under the Plan to the
may be amended from time to time, and that the Plan
Administrator shall reserve the right to reconfirm the qualified
status of the Order at the time benef.its become payable
hereunder,
15. Tax Treatment of Distributions Made Under This Order.
For purposes of Sections 402(a) and 72 of the Internal Revenue
Code, any Alternate Payee who is the spouse of former spouse of
the Participant shall be treated as the distributee of any
distribution or payments made to the Alternate Payee under the
terms of this Order, and as such, will be required to pay the
appropriate federal income taxes on such distribution,
16. Constructive Receipt. In the event that the Plan
Trustee inadvertently pays to the Participant any benefits which
are assigned to the Alternate Payee pursuant to the terms of the
Order, the Participant shall immediately ,reimburse the Al ternate
Payee to the extent that he has received such benefit payments,
and shall forthwith pay such amounts so received directly to' the
Alternate Payee within ten (10) days of receipt,
17. Continued Jurisdiction. The Court shall retain
jurisdiction with respect to this Order to the extent reqUired
to maintain its qualified status and the original intent of the
parties as stipulated herein,
