property and compensalion for his services and expenses under the contract.

9. Plainti IT anticipates an eminent breach of contract, as Defendant has listed the
Norway Street property liJr sale with a realtor, and has begun negotiuting with a buyer,

13. On or about Maroh 201 19971 Plaintiff and
Detendant entered into a written Lea.e tor the term beginning
April 11 1997, and ending Maroh 311 19981 for the premises
looated at 212 Norway street, Meohanio.burg, Cumberland County,
penn.ylvanial ("Norway straet Property"). A copy of said Lease
ia attaohed hereto I inoorporated herein by referenoe and marked
a. Bxhibit A.
14. On or about February 51 19981 Plaintiff offered to
puroha.e tro. Defendantl under a Sale. Agreement I the Norway
street Property I which otter waG verbally transmitted to
Detendant by and through Robert Voigtl who I at all times from
that time to the pre.ent ha. aoted a. an agent of Defendant
(Agent") .
15. On or about February, 19981 Defendant rejeoted
.aid otfer by and through her Agent and .imultaneously orally
direoted her Agent to pre.ent a oounteroffer to Plaintiff.
16. On or about February I 1998, Plaintiff I through
Defendant'. Agent I orally rejeoted Defendant's counteroffer.
17. On or about February 16, 1998, Plaintiff was
notified in writing that the Norway street Property woul~ be
placed on the mar~et for sale and that the Lease would not be
renewed upon the expiration date of March 21, 1998. A true and
correct copy of said written notice is attached hereto,
incorporated herein by reference, and marke~ as Exhibit B.
18. On or about February 18, 1998, Defendant requested
that the Norway street Property be listed for sale and an
Exclusive Right to Sell Agreement for Sale of Real Estate was
entered into by and between Defendant and ERA Anderson Real
Estate. A copy of said Agreement is attached hereto,
incorporated herein by reference and marked as Exhibit c.
19. On or about February 25, 1998, an Agreement for
Sale and Purchase was entered into, a copy of said Agreement is
attached hereto, incorporated herein by reference and marked as
Exhibit D.
20. On or about February 27, 1998, Plaintiff contacted
Defendant directly by telephone and presented another offer. for
purchase on the Norway street Property, which offer was rejectred
as it occurred subsequent to the February 25, 1998, executed
Agreement for Sale and Purchase between Defendant and buyers.
21. Prior and subsequent to the execution of the
February 25, 1998, Agreement, Plaintiff has maliciously
interferod with appointments made by agents to show the Norway
street property, and ha. .aliciou.ly attempted, through repeated
telephone oall. to buyer. and any agent. of buyers, inoluding but
not limited to an in.uranoe repre.entative, to prevent the
.uoc...ful cl08ing of the Norway street property whioh is
scheduled to ooour on May 29, 1998.
22, A. a re.ult of .aid maliuiou. attempts as
referenced above, Defendant retainod legal counsel who, on Maroh
16, 1998, forwarded to plaintiff a written notice that the Norway
street property wa. to be vaoated on or before April 16, 1998.
23. On or about April 6, 1998, plaintiff presented to
Defendant & handwritten ".tatement" for alleged "improvements" to
the Norway street property, a copy of said statement is attaohed
hereto, incorporated herein by referenoe, and marked as Exhibit
I.
24. All of the improvements were made, to the best of
Defendant'e knowledge, prior to the listing of the Property for
.ale, an~ the improvemente were undertaken under the term of the
Lea.e of Maroh 20, 1997, and without prior disoussion or approval
of either Defendant or Defendant's Agent. said improvemants
whioh appeared on the April 6, 1998, statement were made known to
Defendant upon vieiting the Norway street Property on or about
Deoember 27, 1997.
25. In epite of the above-referenced written notice.
to vaoate and the faot that Plaintiff had full knowledge and
information that the Norway street Prop8rty was under a oontract
for sale, plaintiff has refused to vacate said Property and has
made olaim for an amount of money alleged to have been expended
for the above referenced improvements.
26. On or about May 15, 1998, Defendant filed a
Complaint and Petition for Emergency Relief and a hearing was
held on May 19, 1998, as a result of which an Order was entered.
27. As a result of the necessity of filing the
aforementioned Petition, Defendant has incurred substantial
expenses to attend the May 19, 1998, hearing, and attorneys'
fees. A copy of said expenses is attached hereto, incorporated
herein by reference, and marked as Exhibit F.
28. .1.s a result of plaintiff I s refusal to timely
vacate the Norway street property, and as a result of Plaintiff's
malicious interference with the Showing and closing of the
Property, Defendant has incurred additional t~lephone expenses in
an effort to resolve issues creat~d by Plaintiff.
29. As of April 1, 1998, Plaintiff has refused to pay
to Defendant any sum(s) of rent while continuing to reside at the
Norway street Property. The rent under the term of the
aforementioned Lease was in the amount of five hundred fifty and
no one-hundredths ($550.00) per month, payable on the first at
eaoh month.
