COMPLAINT
AND NOW comes the Plaintiffs, Richard and Felicia DeKleine,
by and through their attorneys. the Offices of Fenstermacher and
Associates, p.e" and files this Complaint, as follows:
1. Plaintiffs Richard and Felicia DeKleine
(collectively referred to as "the DeKleines.) are adult
individuals, sui juris, currently residing at 26 Goldenrod Drive,
Carlisle, PA 17013,
2. Defendants John and Cynthia D'Adamo (collectively

referred to as "the D'Adamos") are adult individuals, sui juris,
currently residing at 2402 Deerview Drive, Mechanicsburg, PA
17055.
3. The D' Adamos were owners of the real property and
improvements located at 26 Goldenrod Drive, Carlisle, PA J.7013
(hereinafter "the Property.) ,
4. In or about November 1996, the D'Adamos listed the
Property for sale.
5. On August 5, 1997, the DeKleines and the D'Adamos
entered into an Agreement of Sale for the Property, for the sale
price of $159,900,
6. On April 10, 199'1, t.he D'Adamos executed a
Seller's Propert.y Disclosure Statement (hereinafter "Selle~'s
Disclosure/l, a copy of which is attached and incorporat.ed herein
as Exhibit "A/I) ,
7. At such time, all sellers of residential real
estate were required to execute such Seller's Disclosure under the
Real Estate Seller Disclosure Act, 68 P.S, ~1021 ~ ~,
8. On the Seller's Disclosure, in response to the
question "Are you aware of any water leakage or accumulation
within the basement or crawl space?/I, the D'Adamos responded "No",
9. On the Seller's Disclosure, in response to the
question regarding any dampness in the basement, the D'Adamos
responded "No".
10. The D'Adamos had experienced water leakage and/or
accumulation in the basement of the Property in January, 1996.
11. It is believed and therefore averred that the
D'Adamos experienced water leakage and/or accumulation in the
basement of the Property at other points in time.
12. Despite experiencing water leakage and/or
accumulation in the basement of the property, the D'Adamos failed
to identify such on the Seller's Disclosure.
13. Prior to entering into the Agreement of Sale, the
D'Adamos were asked by the DeKleines whether there had ever been
water leakage or accumulation in the basement, to which the
D'Adamos responded that there had not been.
14, At no t.ime prior to execut.ing the Agreement of
Sale, or prior to conducting final settlement on the Property, did
the D' Adamos advise t.he DeKleines of the prior water leakage
and/or accumulation in the basement of the Property.
15. In or about January 1998, the DeKleines began to
experience water leakage and accumulation in the basement of the
Property, experiencing as much as 8 inches of water in the
basement.
16, Due to the accumulat ion of water in the basement,
numerous personal and household items have been damaged.
17. Due to the leakage and acc~mulation of water in
the basement, the DeKleines have had to expend monies to remediate
the water problems.
18. The D' Adamos' outrageous conduct, as set forth
herein, was done with intentional, willful, wanton and reckless
indifference to the rights of the DeKleinss.
COUNT I
Richard and Felicia DaKleine v. John and Cynthia D'Adamo
FRAUD
19. Paragraphs 1 through 18 are incorporated herein as
if more fully set forth.
20. It is believed and therefore averred that the
Defendants failed to disclose material information regarding water
leakage and/or accumulation in the basement of the Property with
the intent.ion of inducing Plaintiffs to execute the Agreement of
Sale,
21. Plaintiffs justifiably relied on bot.h Defendants'
misrepresentations and Seller's Disclosure in executing the
Agreement of Sale.
22. Defendants knew, or should have known, that
Plaintiffs would rely upon their representations and Seller's
Disclosure in entering into the Agreement of Sale,
23. As a direct and proximate result of Defendants'
mis~epresentations and disclosures regarding a material defect in
the Property, Plaintiffs have suffered damages.
WHEREFORE, Plaintiffs respectfully request this
Honorable Court enter judgment for Plaintiffs and against
Defendants, including punitive damages, in an amount in excess of
$25/000, plus costs and all other relief deemed fair and proper.
Said amount exceeds the amount requiring compulsory arbitration.
COUNT II
Richard and Felicia DeKleine v. John and Cynthia D'Adamo
NEGLIGENT MISREPRESENTATION
24. Paragraphs 1 through 23 are incorporated herein as
if more fully set forth,
25. It is believed and therefore averred that
Defendants knew, or reasonably should have known, that the
basement of the Property had experienced water leakage and/or
accumulation during their ownership.
26, Defendants acted negligently by failing to
disclose this material information to Plaintiffs.
27. It is believed and therefore averred that
Defendants failed to disclose such material information with the
intention of inducing Plaintiffs to execute the Agreement of Sale,
28. Defendants knew, or reasonably should have known,
that Plaintiffs would rely upon their representations and Seller's
Disclosure in entering into the Agreement of Sale.
29. Plaintiffs did, in fact, rely upon Defendants'
misrepresentations and disclosure regarding a material defect in
the Property,
30, As a direct and proximate result of Defendants'
misrepresentations and disclosures regarding a material defect in
the Property, Plaintiffs have suffered damages,
WHEREFORE, Plaintiffs respectfully request this
Honorable Court enter judgment for Plaintiffs and against
Defendants, including punitive damages, in an amount in excess of
$25/000, plus costs and all other relief deefTled fair and proper.
Said amount exceeds the amount requiring compulsory arbitration.
