WAIVER OF RIGHT TO FILE MECHANICS' LIENS
WHEREAS, BRINTON E. FOX and MELISSA ANN FOX, husband and wife,
owners of 138 Pine Grove Road, Gardners, Cumberland County, PA
17324, ente~ed into a contract with Forrest W. Hunter, tla Hunter's
Masonry, 1724 Walnut Bottom Road, Carlisle, PA 17013 to provide
materials and perform the necessary labor in regards to the
construction of a dwelling house on property situated at 138 Pine
Grove Road, Gardners, Dickinson Township, Cumberland County,
Pennsylvania, more particularly bounded and described as followsl
SEE ATTACHED EXHIBIT "A"
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the said parties, as part of the said contract and for the
consideration therein set forth, that neither the undersigned
Contractor, any subcontractor or material man, nor any other person
furnishing labor or materials to the said Contractor under his
contract, shall file a lien, commonly called a mechanics' lien, for
work done or materials furnished to the said building, improvements
or any part thereof.
THIS STIPULATION is made and intended to be filed with the
Cumberland County Prothonotary within ten (10) days after date, in
accordance with the requirements of Act of Assembly of
Pennsylvania, in such case provided.

EXHtBIT "A"
ALL that certain tract of land situate in Dickinson Township,
Cumberland County, Pennsylvania, bounded and des~ribed as
follows:
BEGINNING at a point on the southern side of L.R. 21005 On the
dividing line between Lot Nos. 2 and 3 on the hereinafter
mentioned Plan of Lots; thence by said dividing line,
South 19 degrees 10 minutes East 431.05 feet to a point; thence
by the dividing line between Lot Nos. 2 and 5 on said Plan of
Lots, South 64 degrees 5S minutes 30 seconds West 150.8 feet to a
utility pole; thence by the dividing line between Lot Nos. 1 and
2 on said Plan of Lots, North 19 degrees 10 minutes West 446.58
feet to a point on the southern side of L.R. 21005 aforesaid;
thence by the southern side of said road, North 70 degrees
50 minutes East 150 feet to the Place of BEGINNING. CONTAINING
1.511 acres, more or less.
BEING Lot No. 2 on the Preliminary-Final Subdivision Plan of
Beechwood Acres recorded in the Office of the Recorder of Deeds
in and for Cumberland County in Plan Book 42, Page 101, being
known and numbered as 138 Pine Grove Road, Gardners, PA 17325.
BEING the same premises which George G. '1'oner, single man, by his
deed dated March 9, 1992 and recorded in the Office ot the
Recorder of Deeds aforesaid in Deed Book "N", Vol. 35, Page 1109
granted and conveyed unto Ronald E. Marsh. Said Ronald E. Marsh
entered an Agreement of Sale Oll March 9, 1992 agreeing to grant
and convey the premises to Melissa Ann Marsh, now Melissa Ann
Fox, his daughter, which Agreement is recorded in the Office of
the Recorder of Deeds in and for Cumberland County in
Miscellaneous Book 498, Page 927. By Assignment of Rights dated
June 1, 1995 and recorded in the Office of the Recorder of Deeds
aforesaid in Miscellaneous Book 49B, Page 934 Ronald E. Marsh
assigned his rights as Seller under said Agreement of Sale unto
Ronald E. Marsh and Shirley J. Marsh, husband and wife, the
Grantors herein.
