STIPULATION
AND NOW come the Plaintiff, Jennifer E. Shaffer and the Defendants, Terry Lee Cook and

1. None of them know the present whereabouts &Darlene Kay Sylvester and, to the best of their
knowledge, the said Darlene Kay Sylvester has had no contact with the minor child who is the subject of this
litigation, Travis Lee Cook, born 18 March 1992, since January of 1993.
2. The Court of Common Pleas of Cumberland County has proper jurisdiction and venue of this case
and has full authority to enter an Order regarding the custody of the minor child, Travis Lee Cook.
3. Legal and physical custody of the minor child, Travis Lee Cook, born 18 March 1992 shall be
with the Plaintiff, Jennifer E. Shaffer until further order of the Court in this matter.
4. The Court need not set any schedule of temporary or partial custody for any party with regard to
the said child at this time.
5. This Stipulation shall be entered as an Order of the Court in this action.

AND NOW comes the above-named Plaintiff, by her attorney, Samuel L. Andes, and files the
following Complaint for custody of a minor child:
1. The Plaintiffis Jennifer E. Shaffer an adult individual who resides at 5 South 2"d Street in
Wormleysburg, Cumberland County, Pennsylvania.
2. The Defendant, Terry Lee Cook is an adult individual who is curremly a resident at the York
County Prison in York, Pennsylvania.
3. The Defendant, Darlene Kay Sylvester is an adult individual whose current address and
whereabouts is not known. The Plaintiff`has had no contact with the said Darlene Kay Sylvester since
January of 1993 and, to the best of Plaintiff's knowledge, no one involved in this action knows her current
address or whereabouts.
4. The Defendant, Rosemary Mumma is an adult individual who resides at 119 South Beaver
Street, York, York County, Pennsylvania.
5. Plaintiff`seeks an award of legal and physical custody of the minor child, Travis Lee Cook, born
18 March 1992.
6. Since the birth of the said child, the child has resided at the following addresses with the following
persons, to the best of PlaintiWs knowledge:

7. The biological mother of the child is Darlene Kay Sylvester. Plaintiff.knows nothing of
Sylvester's whereabouts or living arrangements.
8. The biological father of the child is Terry Lee Cook, age 47 (born 8 September 1951) who is
currently incarcerated in the York County Prison where he lives with guards and inmates.
9. The Defendant Rosemary Mumma is not related to the child, although she was the first wife of
the child's father. She was awarded custody of the said child by the Court of Common Pleas of York
County, Pennsylvania, by an Order dated 19 September 1996, a copy of which is attached hereto and
marked as Exhibit A.
10. The only other litigation known to Plaintiffwhich involves custody of the child is the action
filed in York County in which the Order which is attached and marked as Exhibit A was entered in
September of 1996.
11. Plaintiff.is aware of no party claiming any rights to custody of the said child who are not
included as parties in this action.
12. Plaintiffdesires an award of legal and physical custody of the minor child to her for the
following reasons:
A. The child has been abandoned by his mother for a period of more that five years;
and
B. The child's father cannot competently care for the child, has a long history of
violence and psychological disorders, and is not a proper parent to have custody of the child;
and
C. Rosemary Mumma, to whom custody was awarded by the Court in September of
1996, cannot properly care for the child and desires that the child live with the Plaintiff} and
D. Plaintiffis best able to provide a suitable and proper home for the child and to
provide him with the stability and love that he needs to prosper.
WttEREFORE, Plaintiffprays this Court to award her full legal and physical custody of the.minor
child, Travis Lee Cook.

AND NOW come the Plaintiff, Jennifer E. Shaffer, the Defendant, Rosemary Mumma,
and Wayne B. Mumma, her husband, and petition the Court to modify the order it entered
in this matter on 27 May 1998, based upon the following:
1. The Petitioner Jennifer E. Shaffer is an adult individual who now resides at 4
Heather Drive, Carlisle, Cumberland County, Pennsylvania.
2. The Defendant, Rosemary Mumma, is an adult individual who resides at 119
South Beaver Street in York, York County, Pennsylvania.
3. The Defendant, Terry Lee Cook, is an adult individual who the Petitioners believe
resides somewhere in York County whose present address is not known to either of them
and has not been known to them since he was released from the York County Prison more
than one year ago.
4. The Defendant, Darlene K. Sylvester, is an adult individual whose address and
whereabouts are unknown to your Petitioners and who has had no contact with either of
the Petitioners for a period of several years.
5. Wayne B. Mumma is an adult individual who resides with the Defendant,
Rosemary Mumma, at 119 South Beaver Street in York, Pennsylvania.
6. The Petitioners herein are the Plaintiff, Jennifer E. Shaffer, the Defendant,
Rosemary Mumma, and her husband, Wayne B. Mumma.
7. This action involves the custody of a minor child, Travis Lee Cook, age 8, born
18 March 1992. The said child was the subject of an order entered by this Court, on the
basis of a stipulation reached by the parties in the action at that time, which said order is
dated 27 May 1998. A copy of that order and the stipulation and complaint on which it
was based are attached hereto and marked, collectively, as Exhibit A.
8. The Petitioners seek a modification of this Court's order of 27 May 1998 to
award primary legal and physical custody of the minor child, Travis Lee Cook, born 18
March 1992, to the Petitioners Rosemary Mumma and Wayne B. Mumma, for the following
reasons:
A. The Petitioners, Rosemary Mumma and Wayne B. Mumma, have a
long-standing and close relationship with the child. The child has. resided with
them in the past and they have provided care for the child in the past.
B. The order entered in May of 1998 was intended to protect the child
from the Defendant, Terry Lee Cook, who had come to the home of Rosemary
Mumma and engaged in several acts of violence directed at Mrs. Mumma and
which took place in the presence of the child. At the time the prior order was
entered, Terry Lee Cook was serving a sentence in the York County Prison
which resulted from his criminal prosecution arising out of those acts of
violence. Since the release from prison of the said Terry Lee Cook, he has
taken no further violent actions toward Rosemary Mumma or toward the said
child or in the child's presence and, for that reason, the parties believe it is no
longer necessary for the child to reside with Jennifer E. Shaffer.
C. The Petitioners believe it will be in the best interests of the said
child to reside with Rosemary and Wayne Mumma and wish to have the order
amended to formalize that arrangement.
9. All of the Petitioners believe it is in the best interests of the child to have Wayne
B. Mumma added as a party to this action so that any order of custody can vest custodial
rights in him as well as his wife, Rosemary Mumma.
10. The Petitioners are not able to obtain the consent of the biological parents of
the child, Darlene K. Sylvester and Terry Lee Cook, because the Petitioners have had no
contact with them for more than a year and do not know their present locations.
WHEREFORE, the Petitioners pray this Court to take the following actions:
A. Include Wayne B. Mumma as a party-Defendant in this matter.
B. Amend and modify its order of 27 May 1998 to award primary legal
and physical custody of the minor child, Travis Lee Cook, born 18 March
1992, to the Petitioners Rosemary Mumma and Wayne B. Mumma.

1. The Plaintiffis Jennifer E. Shaft'er an adult individual who resides at 5 South 2no Street in
Wormleysburg, Cumberland County, Pennsylvania.
2. The Defendant, Terry Lee Cook is an adult individual who is currently a resident at the York
County Prison in York, Pennsylvania.
3. The Defendant, Darlene Kay Sylvester is an adult individual whose current address and
whereabouts is not known. The Plaintiff has had no contact with the said Darlene Kay Sylvester since
January of 1993 and, to the best of Plaintiff's knowledge, no one involved in this action knows her current
address or whereabouts.
4. The Defendant, Rosemary Mumma is an adult individual who resides at 119 South Beaver
Street, York, York County, Pennsylvania.
5. Plaintiffseeks an award of legal and physical custody of the minor child, Travis Lee Cook, born
18 March 1992.
6. Since the birth of the said child, the child has resided at the following addresses with the following
persons, to the best of Plaintiff's knowledge:

7. The biological mother of the child is Darlene Kay Sylvester. Plaintiffknows nothing of
Sylvester's whereabouts or living arrangements.
8. The biological father of the child is Terry Lee Cook, age 47 (born 8 September 1951) who is
currently incarcerated in the York County Prison where he lives with guards and inmates.
9. The Defendant Rosemary Mumma is not related to the child, although she was the first wife of
the child's father. She was awarded custody of the said child by the Court of Common Pleas of York
County, Pennsylvania, by an Order dated 19 September 1996, a copy of which is attached hereto and
marked as Exhibit A.
10. The only other litigation known to Plaintiffwhich involves custody of the child is the action
filed in York County in which the Order which is attached and marked as Exhibit A was entered in
September of 1996.
11. Plaintiffis aware of no party claiming any rights to custody of the said child who are not
included as parties in this action.
