K;;P;-w.."""P~~th~~~i~'~;'" _./ Dy ~ ~< *- '.~ .', ~ ~ ~ MARRIAGE SEITLEMENT AGREEMENT This Agreement is made between Karen A Glazer (Wife) and Lloyd S, Glazer (Husband), The panies are Husband and Wife having been manied on August 4, 1989 in Mechanicsburg, Pennsylvania, There are no children born of the maniage, The parties have agreed to end their maniage through a divorce to be granted by the Court of Common Pleas of Cumberland County, Commonwealth of Pennsylvania, This Agreement is made to settle all economic issues between them with the express desire that the tenns of this Agreement be binding upon them and be accepted by the Court as their positions with regard to all issues raised in this Agreement. They ask the Court to enforce the provisions of this Agreement as it would an Order of Court however no aspect of this Agreement shall be modified by the Court, Both parties acknowledge that they have the right to have an attorney review these documents. Wile has been represented by Kathleen Carey Daley, Esquire, in making this Agreement. Husband is aware that he has the right to counsel but has declined his right to have an attorney represent him in this matter, Wife has agreed to file and serve a no fault divorce complaint on Husband and Husband hereby agrees to sign all consents and notices necesslllY to obtain a divorce under the no fault divorce provisions found at Section 3301(c) of the Divorce Code. harmless any lender, title company, seller or any other party who relies upon this waiver in making a transfer of real estate or a loan in consideration of that transfer to Wife, The parties agree and acknowledge that it may be the intention of Husband to purchase real estate in his name alone, Wife hereby specifically agrees and acknowledges that she shall have no interest of any nature to any real estate Husband may purchase after the date of the execution of this Agreement and does hereby make a complete and total waiver of any spousal claim she may have under the provisions of the Divorce Code or any other statute, She agrees to indemnify and hold harmless any lender, title company, seller or any other party who relies upon this waiver in making a transfer of real estate or a loan in consideration of that transfer to Husband, VEHICLES 6, The Dodge Van, 1993 Honda Aspencade, the fishing boat, motor and trailer shall be the sole and separate property of Husband, The Ford Probe shall be the sole and separate property of Wife, Each party agrees to sign any documents requested by the other regarding title or ownership of these vehicles, DEBTS OF THE PARTIES 7, Husband and Wife state by signing this Agreement that they have split all debts so that no credit cards or similar accounts exist which provide for joint liability. Husband agrees he shall refinance the loan currently in both names for the Dodge Van and the he shall be responsible for and sha1l indemnify Wife from any liability for this loan. Husband further acknowledges that he shall pay in full the business loan with West Shore Teacher's Federal Credit Union. Both of these debts must 4 be refinanced within 30 days of Husband's receipt of funds under this agreement so as to eliminate Wife's liability under these obligations, Both parties agree that any debt incurred by either individual after April 14, 1998, is that individual's sole responsibility, ALIMONY 8, Husband and Wife expressly waive, discharge and release any and all claims that he or she may have now or hereafter by reason of their marriage to alimony, alimony pendente lite, support, maintenance or any other benefits resulting from their status as Husband and Wife, INCOME TAX 9. Husband and Wife agree that all tax returns for the years 1989 through 1997 have been filed and that no notices have been received from the IRS or any other taxing authority which indicate that a tax liability remains unresolved. In the event that any tax deficiency should arise for any joint returns filed by the parties, the parties agree that the party ultimately detennined to be responsible for the increase in tax liability shall be the party solely responsible for the payment of said liability, The party found to be liable hereby indemnifies and holds harmless the other party from any liability including interest, penalty and reasonable counsel fees, OBLIGATIONS 10. Each party agrees that any and all obligations existing between them as the result of their status as Husband and Wile are settled by this Agreement. The parties further agree that neither shall take any action to indebt the other for any future liabilities after the execution of this Agreement. Any liability which should arise for which the other party would be liable which has not been 5 '-"_~-,-"~.._' '.~ '..n,""''''_''''''''''''~'' disclosed in this Agreement shall be the sole and exclusive responsibility of the party who created the liability and not the responsibility of the other party, Husband agrees to pay the sum of$250,OO toward the legal fees of Wife, ESTATE RIGHTS 11. The parties agree that if either should die after the signing of this Agreement but prior to the finalization of the divorce that any claims against the other's estate are extinguished by virtue of this Agreement. All estate claims as a spouse are terminated upon signing this Agreement. FULL RELEASE 12. Except as set forth in this Agreement, the parties release the other from any and all claims that they may have against each other of any nature whether in law or in equity by signing this Agreement. MODIFICA nON 13, Any change, modification or waiver to any term of this Agreement must be in writing and signed by both parties, BREACH 14, In the event that a party were to breach any term of this Agreement, the non-breaching party shall be entitled to all costs, including reasonable counsel fees incurred to enforce his or her rights under this Agreement. JURISDICTION OF COURT 15.
