Dear Tyrone & Phil:
You may be aware that I have been appointed to serve as an
arbitrator in the above referenced matter which is currently
scheduled for January 20, 2000 at 9:30 AM. I feel constrained to
disclose that I am a member of the board of directors for Legal
Services Inc., who is representing the defendant in the person of
Philip C. Briganti.
Please advise if any interested party feels that this
potential conflict of interest rises to the level that I should
recuse myself. Canon 3C(1) (d) suggests that a judge, "including an
appointee of a judge," should disqualify himself in a proceeding in
which his impartiality might be reasonably questioned, including
instances where he is a director of a party in the proceeding.
I serve as an uncompensated director for Legal Services, Inc.,
and while I do not feel as though this relationship would affect my
impartiality; I am interested to hear whether the parties feel this
relationship may create even the appearance of potential
impartiality.
I encourage you to read the Canon and the official commentary
to 3C( 1) (d). The commentary to the Canon suggests that" (t)he fact
that a lawyer in a proceeding is affiliated with a law firm with
which a lawyer-relative of the judge is affiliated does not of
itself disqualify the judge. Under appropriate circumstances
however, the fact that 'his impartiality might reasonably be
questioned' under Canon 3C(1), or that the lawyer

to the premises at the time she moved out.
7. Admitted in part and denied in part. Defendant admits
that the letter attached to plaintiff's complaint as Exhibit "B"
was served upon her on or about April 20, 1998, but denies the
existence of the damages described therein and that she is liable
to Plaintiff for the amounts requested.
8. Denied. Although there were smudges in the stairway, on
one kitchen wall and on one bedroom wall, she denies that the
entire house required repainti.ng at a cost of $950.00. Defendant
further denies that Plaintiff's Exhibit "D" is an invoice for
this alleged repair.
9. Denied. Defendant was unaware of any damage to this
venetian blind when she vacated the rental premises.
10. Denied. plaintiff avers that she replaced all light
bulbs which had burned out.
11. Denied. Defendant denies that Plaintiff's inspection
of the rental premises immediately following vacancy showed that
the tenant had left the premises and appliances and fixtures in a
filthy and unsanitary condition which required complete cleaning,
including but not limited to all appliances, windows, carpets,
floors and general cleaning, at a cost of $450.00. Rather,
Defendant avers that she cleaned the premises thoroughly before
she moved out. Defendant denies that Plaintiff's Exhibit "G" is
an invoice for any cleaning services performed at the rental
premises.
12. Denied. Defendant denies that Plaintiff was required
to replace the locks because Defendant had given keys to third
parties, at a replacement cost of $48.85. Defendant avers that
she returned all keys to Plaintiff when she vacated the premises.
13. Admitted in part and denied in part. Defendant denies
that in the lease addendum attached to Plaintiff's complaint as
Exhibit "K", Defendant agreed to pay for attorney fees. Rather,
Paragraph 15 (h) of said addendum, which lists lease provisions
which are prohibited by HUD, provides that the parties' lease may
not contain a provision that Defendant can be charged with
attorney fees even if she wins in a court proceeding filed by the
Plaintiff against her. Although this paragraph goes on to state
that Defendant may be obligated to pay such costs if she loses,
it does not constitute an agreement to pay Plaintiff's attorney
fees if Defendant does not prevail. Rather, this language merely
means that a lease provision requiring her to pay Plaintiff's
attorney fees if she loses would not be prohibited. However, in
this case Defendant would not be required to pay Plaintiff's
attorney fees even if Plaintiff were to prevail, because the
parties' lease does not provide that Defendant is responsible for
them. Defendant admits the remaining averments in Paragraph 13
of Plaintiff's Complaint.
14. Admitted.
NEW MATTER
15. Any damage to the rental premises occurring during
Defendant's tenancy was the result of ordinary wear and tear, for
which Defendant is not liable to Plaintiff.
16. The parties' lease does not provide that Defendant is
responsible for the cost of replacing locks.
17. Defendant remitted to Plaintiff a security deposit in
the amount of $650.00, which should be applied to offset the cost
of repairing any damages for which Defendant may be liable.
WHEREFORE, Defendant requests that the relief requested by
plaintiff be denied and that judgment be entered in Defendant's
favor.
COUNTERCLAIM
18. Defendant repeats and incorporates by reference her
averments set forth above in Paragraphs 1 through 17.
19. Defendant paid to plaintiff a security deposit in the
amount of $650.00, prior to her occupancy of the rental premises.
20. Defendant vacated the rental unit and surrendered it to
Plaintiff on or about March 31, 1998.
21. Whell Defendant surrendered the rental premises to
plaintiff, Defendant orally informed Plaintiff of her new
address, which she believes and therefore avers was written down
by Plaintiff.
22. Defendant is not liable to Plaintiff for any damages to
the rental unit.
23. More than thirty days has passed since Defendant
surrendered the rental premises to Plaintiff, and Plaintiff has
failed to return Defendant's security deposit to her or any
portion thereof.
WHEREFORE, Defendant respectfully requests that a judgment

The Plaintiff's inspection of said aforementioned premises
immediately following vacancy showed that the tenant had not
replaced four light bulbs; at a replacement cost $4.90, a copy of
the invoice for the aforementioned repair is attached hereto,
made a part hereof, and marked as Exhibit "F".

The Plaintiff's inspection of said aforementioned premises
immediately following vacancy showed that the tenant had left the
premises and appliances and fixtures in a filthy and unsanitary
condition which required complete cleaning including but not
limited to all appliances, windows, carpets, floors, and general
cleaning; at a cost of $450.00, a copy of the invoice for the
aforementioned repair is attached hereto, made a part hereof, and
marked as Exhibit "G".

The Plaintiff's inspection of said aforementioned premises
immediately following vacancy required replacement of locks
because the defendant had given keys to the premises to third
parties; at a replacement cost $48.85, a copy of the invoice for
the aforementioned repair is attached hereto, made a part hereof,
and marked as Exhibit "H".

The Plain"tiff filed a civil complaint against defendant at
District Justice Donald W, Daihl, Sr., office for property
damages and a hearing was held on May 13, 1998, and judgment was
entered in favor of the plaintiff on May 13, 1998 for damages,
costs and attorneys fees, and against the defendant, The
defendant filed a counter claim for security deposit, which claim
was dismissed. A copy of said complaint is attached hereto, made
a part hereof, and marked as Exhibi t "I", A copy of said
judgment transcript is attached hereto, made a part hereof, and
marked as Exhibi t "J"; a copy of the "lease addendum wherein the
defendant agreed to pay for attorneys fee is attached hereto,
made a part hereof, and marked as Exhibit "K"; a copy of the
defendant's counter claim is attached hereto, made a part hereof,
and marked as Exhibit "L".

The aforementioned judgment was appealed by defendant on or
about June 2, 1998, and served on the Defendant on or about June
4, 1998. A copy of said appeal is attached hereto, made a part
hereof, and marked as Bxhibit "M".
WHEREFORE, it is requested that this Honorable Court enter
an Order in favor of the plaintiff and against the defendant,
which shall order payment of the monetary judgment in the amount
of $1,483.42, less the security deposit, in damages to the
premises in question together with all costs incurred in the
prosecution of this claim, including costs incurred at the
District Justice office, plus Attorneys fees and any other
damages as may be specified hereafter to be paid by the
defendant, and for all other relief just and appropriate.

Defendant moved into plaintiff's, ren'tal property, a, newly
constructed home which had not beenliv~d in prior to this tenancy,
pursuant to a lease agreement on January 1, 1996. Defendant was
notified by plaintiff to move out of the premises on or before
March 31, 1998. Defendant .did move out and returned the keys to
plaintiff through a third party..on or about April 2,' 1998; leaving
extensive damage to the property as folloWEr: (1 ) Painting-$950.00
(2) Venetian Blind-$29.6.7, (3) Four,light bulbs-$4.90 (4) Cleaning
of entire house and appliances-~45~;U~ and (5) Replacement of
locks-$48.85. Plaintiff has incurred legal fees. of $350.00 and costs.
