7, On 01' IIbout June 20, 1980, thc Decedont entered Inlo Rnlnstallment Sales
Agreemenl (the "Articles of Agreemcnt") 10 sell certain real estllte located at 109 Cumberland
Street, Harrisburg, Dauphin County, l'ennsylvlll1ia, ( the "Ileal Estate") with Waldemar
Kirschbaum and Florence Kirschbaum (hereinaller the "Kirschbaums"), A true and correct copy
of the Articles of Agreement is attached hereto, incorporated by reference herein, and marked as
Exhibit "8",
8, Pursuant to the terms of the Articles of Agreement, the Kirschbaums were to pay
the Decedent $278,70 per month beginning July 20, 1980, and continuing monthly thereafter until
such time as the Kirschbaums were able to pay ()ffthe outstanding balance under the Articles of
Agreement,
9, The Kirschbaums made monthly payments under the Articles of Agreement from
July 20, 1980, through October 17, .1986, when the Kirschbaums purchased the property by
paying off the balance due and owing under the Articles of Agreement,
10, Beginning with the May 20, 1984, payment under the Atticles of Agreement, the
Kirschbaums, at the request of the Defendant, and upon her representation that she was the
attorney-in-fact for the Decedent, began to make the monthly payments under the Articles of
Agreement paYRble to the Decedent or, in the alternative, the Defendant, Copies ofall checks
comprising payments from the Kirschbaums to the Decedent under the Articles of Agreement,

beginning with the May 20, 1984, payment, are attached hereto, incorporatcd by reference herein,
and marked as Exhibit "C",
II, All or the checks comprising Exhibit "c" were endorsed by the Defendant and used
by the Defendant for her own purposes, The monies from said payments wcre not usml by the
Defendant for the wclfare or in the best interest of the Defendant.
12, The total amollnt of said checks equals $8,083,00
13. On 01' about October 17, 1986,the Kirschbaums paid oll'the Articles of
Agreement from which transaction the Decedent netted $23,397,85, A true and correct copy or
the HUD-) Settlement Statement from the sale of the Decedent's real estate is attached hereto,
incorporated by reference herein, and marked as Exhibit "0",
14, The HUD-) Settlement Statement was signed by the Defendant on behalf of the
Decedent pursuant to her purported status as the Decedent's attorney-in-fact under the forged
Power-of-Attorney that is marked as Exhibit "A",
15, A check for the Decedent's settlement proceeds in the amollnt 01'$23,397,85 was
paid to the Defendant pursuant to her alleged status as attorney-in-fact under the forged Power-
of-Attorney,
16, Said monies were used by the Defendant for her own personal profit and gain and
were not used for the care, welfare, health, or benefit of the Decedent,
17, At the time the Defendant requested and accepted both the monthly payments
under the Articles of Agreement and the check for the sale of the Decedent's real estate, the
Defendant knew that she was not the Decedent's attorney-in-fact and that the Power-of-Attorney
dated December I, ) 984, was a forgery,

18, Neither the KIrs<;hbaumR nor the settlement agent for the sale of the real estate
knew or had reason to know the Power-of. Attorney inlavor of the Defendant waR a forgery and
they justif1ably relied upon the Delcndnnt's representations that she was the Decedent's attol'lley-
In-fact.
19, As a result of the Defendant's misrepresentations to buth the Kirschbaums and the
settlement agent, the Defendant was able to den'aud the Decedent out 01'$31,480,85 by
purporting to be the Decedent's attorney-in-fact under a forged Power-of-Attorney,
20, PUf311ant to the forged P()wer-ol~Attorney, the Defendant had access to and
control over various personal items belonging to the Decedent, including but not limited to the
Decedent's bank accounts, insurance policies, II pearl necklace and other items of personal
property (the "Personal Property"), the lull extent of which, and value lor which Is not known at
the present time,
21, The Defendant's fraudulent misrepresentations that she was the Decedent's
Attorney-in-Fact, when in fact she knew she was not, enabled her to take possession and control
of these items and use them for her own benefit and gain rather than the bencf1t of the Decedent.
WHEREFORE, the Plaintiff respectfully requests that judgment be entered against the
Defendant in an amount of exceeding $30,000,00, plus costs OfSllit and interest from the date of
judgment, plus all further relief which this Court deems necessary and just,

When/Kllllement on the real estate occuned, the Defendant took and converted all payments ml\de
by the Kirschbaums under the AI1icles of Agreement, as well as the final payment for the sales
proceeds of the house, to her own use without the Decedent's consent or lawful justification,
24, The value of said payments and the proceeds from the sale of the house is
$31,480,85,
25, In addition to the payments under the Articles of Agreement and the proceeds
from the sale of the Decedent's real estate, Plaintiff believes and therefore avers that the
Defendant came into possession of various personal items belonging to the Decedent, including
but not limited to a pearlnecklacc, various bank accounts, and insurance policies belonging to the
Decedent, ( the Personal Property),
26, The identity of all the items of Decedent's Personal Property converted by the
Defendant for her own use and the exact value of those items is unknown at the present time,
27, Durinllthe period commencing May 20, 1984 and continuing until the Decedent's
death, the Defendant converted the Personal Property to her own usc without the Decedent's
consent or lawful justification,
WHEREFORE, PlaintiO' demands judgment against Defendant in an amount in excess of
$30,000,00 plus costs ofsult and interest from the date of judgment, plus all further relief which
this Court deems necessary and just.

29, If the Defendant was the Decedent's Attorney-ill-fact, the Defendant was under a
llduciary duty pursualltto her Power-of-Attorney to act at all times in the Decedent's best
interest.
30, The Defendant did not use any of the monies from the payments by the
Kirschbaull1s under the Articles of Agreement or the monies from the sale proceeds of the house
for the care, welfare, 01' benellt of the Decedent. Rather, she used the monies for her own
personal benellt, proflt and gain,
3 I, Pursuant to her Power-of-Attorney, the Defendant also had access to and control
ol'er various personal items belonging to the Decedent s\lch as bank accounts, Insurance policies
and per~ollalty, the full extent of which and the value of which is still unknown,
32, Plaintiff believes and therefore avers that the Defendant used her status as the
Decedent's attorney-in-fact to take possession and control of these items and to use them for her
own personal benefit and not for the benefit ofthe Decedent.
33, The Defendant's actions constitute a breach of Defendant IS fiduciary duty toward
the Decedent as the Decedent's attorney-in-fact,
