COMPLAINT
AND NOW, comes Plaintiff, Robert C, Lott, Jr., by and through
his counsel, Killian & Gephart, and in support of this complaint
avers the following:
1. Plaintiff, Robert. C. Lott, Jr., is an adult individual
who currently resides at 760 Wenksville Road, Biglerville,
Cumberland County, Pennsylvania.
2. Defendant, Emmanuel S. Shughart, is an adult individual
who currently resides at 531 Pleasant Hall Road, Carlisle,
Cumberland County, Pennsylvania.
3. In 1.995, Plaintiff and Defendant entered into an oral
partnership agreement for the purchase and resale of deer.
4. The arrangement involved the equal splitting of all costs
and profits from the partnership.
5. The partnership operated from 1995 through 1996, during
which time the partnership opened a series of joint accounts and
purchased a variety of deer..
6. In 1996, the partnership ended.
7. After dissolution of the partnership, Plaintiff, upon
review of the inventory and joint financial accounts, has
determined that a significant portion of the partnership's capital
and inventory has been taken by Defendant in violation of the oral
partnership agreement entered into between the parties,
WHEREFORE, Plaintiff, Robert C. Lott, Jr., respectively
requests that the Honorable Court enter judgment against Defendant
in an amount above $25,000, said amount being the jurisdictional
limit for mandatory arbitration,

Emmanuel Shughart, and files this Petition for Court Approval to Withdraw Representation as
Counsel, and in Support thereof, moves as follows;
I. Defendant is Emmanuel S. Shughart, an adult individual whose last known
address is 531 Pleasant Ball Road, Carlisle, Pennsylvania 17013,
2, Plaintiff is Robert C, Lott, Jr., an adult individual residing at 760 Wenksville
Road, Higle'ville, Pennsylvania 17307.
3. On or about June 16, 1999, Plaintiff, by and through his attorneys, Killian &
Clephttrt, I AT, filed it Complaint in Law against Defendant regarding the ownership of certain
capital and inventory pu suarnt to an oral partnership ag°oonnetl.
4. On or about December 13, 1999, Defendant, by and through his attorneys, Irwin,
McKnight and Hughes, filed an Answer to Plaintift's Complaint with Now Matter and a
Counterclaim.
S. On or about December 20, 1999, Plaintiff filed an Answer to New Matter kind
COnnturclahn of Defendant.
6, Since January 2000, Defendant has been uncooperative with his counsel, such that
Defendant has failed substantially to fulfill his obligation to counsel.
7, Since January 2000, [Mendant's counsel has sent numerous letter's to Defendant
requesting that Defendant contact Counsel to discuss the case and Defendant has not responded to
those letters. Copies ol'the letters are attached as Exhibit "A."
S, Defendant's phone has been disconnected and Defendant has tailed to give
counsel his new mother drspite written requests fin' the skims=.
9, On March 16, 2000 kind April 21, 2000, counsel sent letters indicating that
counsel would withdraw representation it' Defendant tailed to respond to counsels requests for
cooperation,
10. The above relerenced letters of March and April were returned to counsel as
undeliverable with no forwarding address. Copies of the letters are attached at Exhibit "B."
11. Defendant has tailed to make payment for services rendered by undersigned
counsel.
12. Defendant has been given reasonable warning that counsel will withdraw if
Defendant continues to hall to Cooperate.
13, Counsel for Defendant cannot oontinuc to cl'fuctively represent Defendant without

I did get your most recent telephone message on my voice mail, However, I have not
been able to return your call because I do not have a current telephone number where 1 can reach
you. As I stated in my prior correspondence, it is important that I speak with you as soon as
possible regarding the Lott v. Shughart matter. Mr. Lott has responded to our Answer and
Counterclaim and it is their intention to schedule this matter for arbitration, If we are to resolve
this matter the time is now,
In addition, I received a call from a Mr, Ron Robinson late last week. He indicated that
you had informed him that I was representing you and that you would be using me to send
money to him directly. I do not believe we have spoken regarding this matter but certainly it

Enclosed please find my firm's most recent statement regarding services rendered on
your behalf. I was disappointed to note that you have still made no effort toward payment of this
outstanding balance since last month's statement. As I stated I do need to see regular monthly
payments from you toward this amount which is owed. I would certainly like to have the
opportunity to continue to represent you on legal matters both now and in the future, but I cannot
do so until I have received some payment from you.
Regarding the current status of legal matters, I am being contacted by another firm in the

PRETRIAL MEMORANDUM
1. Facts
Plaintiff entered into an oral partnership agreement with the Defendant for the
purchase and resale of deer. The arrangement called for the equal splitting of all costs
and profits from the partnership. Several joint accounts were established and a variety
of deer were purchased during the partnership. Following its dissolution, Plaintiff
discovered that a significant portion of the partnership's capital and inventory had
been taken by the Defendant, contrary and in violation to the oral partnership
agreement the parties had previously entered into.
2. Damages
The partnership's capital and inventory improperly taken by the Defendant
totals over $25,000.00 plus interest.
11 3. Principle Issues or Liability and Damages
It is not contested that the parties entered into an oral partnership agreement
and that within that agreement the arrangement called for the equal splitting of all
costs and profits from the partnership. It is alleged that Defendant breached said
agreement by retaining profits beyond his share and failed in his obligation to his
share of the costs. As such, Defendant is liable for the portion of profits retained
beyond his share and for the portion of costs he failed to provide.
4. Legal Issues Regarding Admissibility of Testimony, Exhibits, Etc.
The bulk of the evidence shall be derived from the partnership records, which
are admissible under Pa. R.E. 303(6).

PETITION FOR SPECIAL RELIEF
AND NOW, this 15th day of December, 2004 comes the Plaintiff, Robert C. Lott,
Jr„ by and through his counsel, Wendy Weikal-licauchat, and states the following:
1, Plaintiff is Robert C, Lott, Jr., with an address of 760 Wensksville Road,
Biglerville, PA 17307,
2, Respondent is the Sheriffs Office of Cumberland County, with an address of One
Courthouse Square, Carlisle, I'A 17013,
3. On October 22nd, 2001, Plaintiff obtained a,judgment in the amount of
$54,819.38 against the Defendant, Emmanuel S. Shughart resulting from a Breach of
Contract claim.
4. At present, Mr. Shughart has no property upon which the plaintiff can execute
this Judgment.
5. The Sheriff's Office of Cumberland County is currently holding approximately
$5,000,00 in excess funds that Mr. Shughart has not claimed following a Sheriffs sale of
Mr, Shughart's real estate on December 8, 1999 for property located on Gap Road in
Carlisle.
6, The Plaintifl'wishes to claim these funds to satisfy a portion of his existing
Judgment.
7. The Plaintiff seeks a court Order stating that said funds will be released by the
Sheriff's Office to the Plaintiff,
8. The Sheriff's Office of Cumberland County consents to the entrance of said
Order so long as the applicable poundage is paid.
WHEREFORE', the Plaintiff respectfully requests that this I lonorable Court enter an
Order stating that the funds held by the Sheriffs Office should be released to Plaintiff for
the partial satisfaction of Plaintiffsjudgment,
