GASTON and PATRICIA A. GASTON, his wife, of 501 DarIa Road, Mechanicsburg, Pennsylvania, hereinafter referred to as Olmer, whereby the former undertook and agreed to ereot and construct a single-family residential dwelling on that certain lot of grollOd situate in Upper Allen 'l'oWl1ship, Cumberland county, Pennsylvania, being Lot No. 51, Phase VIII - ~'inal Subdivision Plan of Meadowview Estates, said Plan being recorded in the Cumberland County Recorder of Deeds Office in Plan Book 74, Page 108. BEING part of the same premises which Merle L. Stambaugh, Executor of the Estate of Mary G. Stambaugh, et al. by deed dated December 12, 1986 and recorded in the Cumberland County Reoorder of Deeds Office in Deed Boo): '(J", Volume 32, Page 256, granted ! i and conveyed unto John M. Kna~b and Janet D. Knaub, his wife. The said Janet D. Knaub died March 26, 1995, whereupon full and complete title to the wi thin described real estate became vested solely in John M. Knaub, surviving spouse. ALSO BEING the same premises which John M. Knaub, by Deed dated May 22, 199B and recorded June 1, 1998 in the Cumberland County Recorder of Deeds Office in Deed dook 178 , Page 391 granted and conveyed unto Darwin A, Gaston and patricia A. Gast.on. NOW THEREFORE, THIS AGREEMENT WITNESSETH I That the said Contractor, for and in consideration of the sum of One ($1. 00) Dollar to it in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned ,in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the Lot of ground appurtenant "theret.o for or on account. of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of t.he said buildings on the lot above described, and the said contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them and agree that this instrument, waiving the right of lien, shall be an independent covenant..
