At the time thut the poodle WIIS transferred to the PllIintifls, Ddendant Alice R, Mountz
indicated to the Pluintiffs that she had tuken the poodle to u veterinarian for a check up and its
initial vaccinations, At that time, Defendunt Alkc R, Mountz did not indiclltc that dog was
unhealthy in any way,

On or about August 17, 1998, Plaintifls noticed that the poodle would not eat and that the
dog had a rash or fungus at severalloclltions on its body,

Plaintiffs immediately contacted the Defendants to inquire as to the reason for the fungus
and to ask for assistance in treating the dog,

Defendant Alice R. Mountz advised the Plaintiffs to purchase an over-the-counter cream
to treat the fungus, but gave no further indication of the source of the illness.

After nearly a week of treatment with no improvement, the Plain'ills again eontaeted the
Defendants and requested assistance in dealing with the poodle's illness, No help was
forthcoming.

set of teeth and spry was One Hundred Eight and 00/100 ($1 NO.OO) Dollars. A copy of the
veterinury invoice is attached hereto as Exhibit "D" and ineorporutcd herein by this reference.

Recently, the poodle has been diagnosed with medial patella luxation on the leg opposite
the areu of her previous surgery, which agnin hus been diagnosed liS II genetic defect. The cost of

The Defendants hreaehed the oml eontmet with the defendant hy HIlling to deliver to the
Plalntifts the merchandise till' which they originally eontruetcd, namely a healthy toy poodle.
Instead, Defendants delivered II poodle which was plagued with genetic defects which were not
disclosed to the Plaintifts and which were unknowllat the time of purchase.

As a result of Defendants' hreach of contract, Plaintitls have and expect to suffer
damages in the treatment and rcp?!r of the various genetic detects of the toy poodle in the
amount of One Thousand Nine Hundred Ninety-Five and 58/100 ($1,995.58) Dollars.

At the time of purchase of the poodle, Defendants failed to indicate that the poodle
suffered from any ailments or defects, of which the Defendant knew or should have known.

At the time of purchase of the poodle, Defendants implied that the dog was ill good health
by indicating to the Pluintitls that the dog had heen examined hy u veterinurian and received its
initial vaccinations.

AND NOW, comes Defendant Alice Mountz and Jack Sunderland
t/d/b/a A&J Poodles, by and through their attorney, Gregory J.
Xatshir, Esquire, with the following Answer and New Matter as
follows:
ANSWER
1. Paragraph 1 is admit.ted.
2. Paragraph 2 is admitted.
3. Paragraph 3 is admitted.
4. Paragraph 4 is admitted.
5. Paragraph 5 is denied. By way of further answer,
Plaintiffs did not enter into an oral contraot with Defendants.
Any contr.act for the sale of a toy poodle was made between
Defendants and Plaintiff's son, Rooco Ciavarella. The Plainti,ffs
were in no way parties to any oontract with Defendants.
6. Paragraph 6 is admitted in part and denied in part. It
is admitted that the sum of Two Hundred Fifty ($250.00) dollars
Was deposited on or about August 2, 1997. However, it is denied
that the money was deposited by Plaintiffs. The money was
dlllpoeited by Plaintiffs' SOI1.
7. Paragraph 7 is admitted in part and denied in part. ~t
is admitted that Plaintiffs came to Defendants' place of business
on or about August 16, 1997. However, it is denied that any
contraot existed between Plaintiffs and Defendants for the sale
of the poodle and therefore the Pldntiffs were not picking up
their new poodle.
8. Paragraph 8 is admitted in part and denied in part. It
is admitted that Defendants presented the toy poodle to
Plaintiff, however only after directed to by the purchaser, Rocco
ciavarella. It is denied that Plaintiffs remitted payment of the
remaining balance to Defendants. Payment was made by Rooco
ciavarella.
9. Paragraph 9 is admitted.
10. Paragraph 10 is denied. After reasonable investigation
the Defendants are without knowledge or information sufficient to
form a belief as to the truth of the averment and strict proof
thereof is demanded at the time of trial.
11. Paragraph 11 is admitted in part and denied in part. It
ill! admitted 'that, Plaintiff oontlicted Defendants to inquire about
the fungus. However it is denied that Plaintiffs immediately
contacted Defendants for the reason that after reasonable
investigation Defendants are without knowledge or information
sufficient to form a belief as to the truth of the averment and
strict proof is demanded at the time of trial.
12. Paragraph 12 is admitted. By way of further answer,
Defendant also instructed Plaintiffs to immediately take the
poodle to a veterinarian.
13. Pftragraph 13 is denied. It is denied that there was no
improvement in the poodle's condition after a week's treatment
b40ause after reasonable investigation Defendants are without
k~owledqe or information sufficient to for a belief as to the
truth of the averment and strict proof thereof is demanded at the
time ot trial. It is denied that there was no help forthooming
becsuee Plaintiffs did not specifically contact Defendants but
in faot left a message on an answering machine indioating that
they were taking the poodle to the veterinarian. Plaintiffs did
not seek assistance from Defendants pursuant to the phone
message.
14. Paragraph 14 is denied. After reasonable investigation,
Defendants ar.e without knowledge or information sufficient to
form a belief as to the truth of the averments and strict proof
the roof is demanded at the time of trial.
15. Paragraph 15 is denied. Af.ter reasonable investigation,
Defendants are without knowledge or information sufficient to

Oefendants are without knowledge or information sufficient to
form a belief as to the truth of the averments and striot proof

Defendants are without knowledge or information sufficient to
form a belief as to the truth of the averments and strict proof
thereof is demanded at the time of trial.
19. Paragraph 19 is denied. After reasonable investigation,
Defendants are without knowledge or information suffioient to
form a belief as to the truth of the averments and strict proof
thereof is demanded at the time of trial.
20. Paragraph 20 is denied. After reasonable investigation,
Defendants are without knowledge or information sufficient to
form a belief as to the truth of the averments And strict proof
thereof is demanded at the time of trial. By way of further
answer, Plaintiffs have not incurred the expenses and damages
claimed herein.
BREACH OF CONTRACT
21. Paragraphs 1 through 20 of Defendants' Answer are
incorporated by referenoe and made a part hereof as if the same
were set forth in detail.
22. Paragraph 22 is denied. Paragraph 22 attempts to set
forth a legal conclusion to which no responsive pleading is
necessary. To the extent that a response is necessary,
Defendants deny the existence of an oral oontract with
Plaintiffs. Additionally, it is denied that the poodle delivered
was plagued with genetic defects or that Defendants knew or
should have known of any defeots and strict proof thereof is
demanded at the time of trial.
23. Paragraph 23 is denied. Paragraph 23 attempts to set
forth a legal conclusion to which no responsive pleading is
required.
WIIEREFORE, Detendants requestl!l that Plaintiffs' claim b(3
denied.
NEGLIGENT MISREPRESENTATION
24. Paragraphs 1 through 23 of Defendants' answer are
inoorporated by reference and made a part hereof as if the same
were set forth in detail.
25. Paragraph 24 is denied. Paragraph 23 attempts to set
forth a legal conclus1on to whlch no responsive pleading is
required. To the extent that a response is necessary, Defendants
deny that they knew or should have known of any ailments or
defects suffered by the poodle and strict proof thereof is
demanded at the time of trial.
26. Paragraph 25 is admitted. By way of further answer,
Defendants had the pOOdle examined by a competent veterinarian
and had the poodle vaccinated prior to the sale to Rocco
Ciavarella. Defendants had no knowledge or reason to believe
that the poodle was not in good health. Further, any implication
made as to the health of the poodle was not made to induce a
sale.
27. Paragraph 26 is admitted. Defendants did not know, or
have reason to know, that the poodle Buffered from any present
illness or genetio defect. Defendants took reasonable measures
to examine the poodle prior to the sale to Rocco Ciavarella and
found no illness or defects.
28. Paragraph 27 is denied. Paragraph 27 sets forth a legal
oonolusion to which no responsive pleading is required.
WHEREFORE, Defendants requests that Plaintiffs' claim be
denied.
UNFAIR TRADE PRACTIC&S
29. Paragraph 28 is denipd. Paragraph 28 sets forth a legal
conclusion to which no responsive pleading is required. To the
extent that a further answer may be required, Plaintiffs were no
parties to the contraot, and Defendants had no knowledge or
reason to beli.eve that the poodle suffered from any illness or
genetic defect.
WHEREFORE, Defendants requests that Plaintiffs' claim be
denied.
NEW MATTER
30. The representation set forth in Paragraphs 1 through 29,
constituting the Answer of Defendants, are incorporated herein by
reference and made a part hereof as if the same were set forth in
detail .
31. Rocco Ciavarella, Plaintiffs' son, entered into an oral
contract for the purchase of a toy poodle. Rocco Ciavarella
requested that all bills, contract and/or agreements be sent to
him. He did not want his parents to know the cost of the poodle.
Plaintiffs were not a party to the contract for the sale of the
poodle.
32. Def~ndants offered no guarantees as to the health of the
poodle, but for, indicating that the poodle had been examined by
a competent veterinarian and that to the best of their knowledge,
