Mortgage on the home and agrees to indemnify and hold husband
harmless from any obligations related to that mortgage. It is
further agreed that in the event that that loan obligation Or
mortgage obligation would become 90 days or more in arrears
that wife shall have the obligation to list the mobile home
for sale so as to satisfy that obligation and/or to achieve
husband's release, or refinance that debt in her name alone so
that the debt: will be immedIately satIsfied, Husband agrees
to execute the tItle to the mobile home, If in the event one
exists, transferring his interest to wife or to execute any
and all other documentation necessary to effectuate the
transfer, The mobile home is currently located on a rented
lot, Wife shall be responsible for all lot rent payments that
may exist for that property and indemnify and hold husband
harmless for any claims for that lot rent and additionally to
pay any and all taxes associated wIth the location of the
mobile home and Indemnify and hold husband harmless from any
claim for those taxes,
2. The parties also own a parcel of property known as 207
Burns Avenue, New Hope, Tennessee. This property is under a
sales agreement or deed of trust and was transferred to
individuals by the name of Charles T, Wilson and Debra J,
Wilson, The partIes have a second mortgage due to them based
on the transfer of that property. The Wilson's have filed
bankruptcy in an attempt to discharge the obligation owed to
the Stonesifer's, In the event that any money is realized out
of the bankruptcy process or in any way related to that
property, said sum shall be divided equally between the
parties, and in the event that any liability would be
generated out of that property, said liability shall be
divided equally between the parties.
3, The parties stipulate that at the time of separation
wife received accounts valued at $1,473.00 and that husband
received accounts valued at $800.00,
4, The parties have a 1961 Impala automobile. That 1961
Impala shall become the sole and exclusive property of wife.
Husband agrees to cooperate by executing any title necessary
to transfer that vehicle to wife or any other document
necessary to transfer his interest therein,
5. The parties have as marital property an IRA account
that was existing at York Bank and Trust, That IRA is now
being held by Allfirst due to a transfer of the banking
.interest. The current value of that IRA .is $]5,267.00, The
partIes agree that the Allfirst IRA shall be cashed and the
processing fee of $45,00 shall be remitted to the banking
.instItution. The parties further agree that 28% of the IRA
proceeds shall be paid to Mr, Stonesifer to satisfy the tax
obligation which will be generated upon cashing the IRJ\, The
parties then agree that the balance, which is approximately
$11,000.00 shall be paid to Mr. Williams, to be held in his
escrow for satisfaction of the following outstanding marital
debts.
These debts include an obligation owing to
Montgomery Wards in the amount of $1,812.77, to Boscov's in
the amount of $862.48, as well as u truck judgment deficit of
$5,478,46 which is due and owing to PNC Bank. The truck
deficit judgment and the Montgomery Ward and Boscov's shall be
paid in full unless Mr. Williams is able to negotiate a
compromise with any of the creditors, The obligation at that
point would be to fully release Mr, Stonesifer from any
obligation from those debts. Any bal.ance on any compromised
figure shall be tha sole and separate property of Mrs,
Stonesifer.
Therefore, for example, in the event that Mr.
Williams is able to negotiate an $1,100,00 settlement for the
Montgomery Wards payment, the remaining $700.00 shall be paid
to Mrs, Stonesifer. After satisfaction of these debts, the
remaining balance of the IRA proceeds, if in fact every amount
has to be paid in full, should be approximately $2,800.00,
That balance shall be the sole and separate property of Mrs.
Stonesifer, Attorney Williams will provide documentation to
counsel for Mr. Stonesifer of satisfaction of those debts,
6. Husband has a pension plan through Raytheon with an
estimated marital value of $14,340.77. Said Raytheon company
pension shall be the sole and exclusive property of husband
and wife waives any interest or claim in regards to that
pension plan.
7. Husband additionally has an interest in the Harsco
Corporation savings plan which has a stipulated value of
$8,546.48. Husband agrees to rollover from that savings plan
to wife the sum of $3,500,00, This rollover shall be into a
qualified plan so as not to cause any tax consequence for
husband. Should wife choose to withdraw monies from the
amount rolled over, she shall be solely responsibl.e for any
tax consequence with that withdrawal,
8. The parties have various items of personalty which
include the Franklin Mint car collection, computer, and
household furnishings. The parties agree that all items shall
become the sole and separate property of wife and any items of
marital property that are in wife's possession shall be her
sole and separate property and any marital items of personal
property in husband's possession shall be his sole and
separate property. The tools that may be in the hands of the
son shall be the son's property,
9. The parties also had certain additional marital debt
that was not provided for and not being paid through the
proceeds of the York Bank/Allfirst IRA. At the time of
separation there was a Conunercial Credit debt of appr'oximately
$3,580.00. Husband warrants that he has paid that debt in
full and will indemnify wife against any claims for that debt.
There was also a marital Visa with a date of
separation balance of $1,940.30, Husband is paying and shall
continue to payoff the debt and indemnify and hold wife
harmless for that obligation, That debt has been transferred
from a joint card to an individual card and is solely in
husband's name so as to avoid any liability for wife.
The parties also had a joint Home Depot debt of
$2,981. 56, a GPU Electric debt of $234.36, and a Commonwealth
telephone debt of $154.67. Husband shall agree to pay the
Home Depot, the electric, and the telephone bill and hold wife
harmless against any of those obligations or debts.

The remaining marital debts are, again, the
Montgomery Wards, Boscov's, and the PNC truck deficiency and
those will be satisfied out of the York Bank/Allfirst IRA
proceeds,

10, The parties agree that there shall be no support and
wife agrees to withdraw her claims for Bupport, alimony
pendente lite, and alimony.
11, The parties also agree to withdraw any claims that
they may have relative to claims for counsel fees, costs and
expenses.
12. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or future
laws of any jurisdiction to share 1n the property or the
estate of the other as d result of the marital relationship
including without limitation, statutory allowance, widow's
allowance, right of intestacy, right to take against the will
of the other, and right to act as administrator or executor in
the other's estate, Each will at the request of the other
execute, acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect this
mutual waiver and relinquishment of all such interest, rights,
'and claims.

Present: for the Plaintiff, Joseph E.
Stonesifer, III, is attorney Barbara Sumple-Sullivan, and
present for the Defendant, Shirley M, Stonesifer, is attorney
Marrison B, Williams.
This action was commenced by the fIHng of a
divorce complaint on June 9, 1998, raising grounds for divor'ce
of irretrievable breakdown of the marriage. Counsel have
indicated that the parties will sign and file affidavits of
consent and waivers of notice of intention to request entry of
divorce decree before the hearing to be scheduled so that the
divorce can be concluded under Section 33011c) of the Domestic
Relations Code. The complaint did not raise any economic
claims.
On September 14, 1998, the Defendant wife
filed a counterclaim r.aising the economic issues of equitable
distribution, alimony, alimony pendente ~ite, and counsel fees
and costs. ,

Counsel have indicated that no testimony will
be offered on the factor of marital misconduct as that factor
may affect wi fe's alimony claim, F'urther, after di scussion,
it is likely that wife will withdraw her alimony claim based
o~ her living arrangements at the present time with a male
friend.

Husband is 50 years of age and resides at
1136 Evening Trail Drive, Wesley Chapel, Florida 33542, where
he may live with a female friend. He is a high school
graduate and currently works in the maintenance department at
Bausch & Lomb. His net monthly income, based on a sllppor:t
order entered in 1998, is $2,287,00. The Master notes that
the monthly income in 1998 was probably computed from a
different employer than the employer where husband is
currently working but the income figure is the figure used for
computing the support hllsband is paying currently to wife.
Husband has not raised any health issues. He is paying wife
$140.00 per month in spousal sllpport. Wife is not covered by
any medical insurance plan provided by husband; she is
currently paying for medical and vision coverage in the amount
of $9.15 every two weeks.
Wife is 48 years of age and resides at 76
Wilson Road, York Haven, Pennsylvania 17370 where she lives
with a male friend. She is a high school graduate and
currently works as a hotel maid where she makes $7.50 an hour.
Her net monthly income as computed by the Domestic Relations
Office in 1998 was $715.00. Wife has not raised any health
issues.

against the mobile home, is $13,440.00. Attorney
Sumple-Sullivan has indicated that her client believes the
mobile home is worth $20,000.00; Mr. Stonesifer shollld
immediately proceed to have an appraisal done on the mobile
home if he intends to dispute the value placed on the mobile
home by Mr. Brown, the appraiser.

Husband is vested in a pension with Raytheon
Company and counsel have agreed that the value of that pension
is $14,340.77.
Wife has advanced $425.00 to have the
appraisal of the mobile home and the pension valued.
The 1996 S-10 Chevorlet truck was repossessed
and there is currently a deficiency judgment on that
transaction in the amclInt of $5,478.46.
Wife is in possession of a 1961 Chevrolet
Impala ....'hich Mr. Williams stated is inoperable but does have a
value of $4,500.00. Counsel have stipulated to that figure.
There is a dispute as to what shollld be
included in the value of the household tangible personal
property which husband claims is all in wife's possession.
Included in the property that husband claims is in wife's
possession is a gun collection and a Franklin Mint car
collection. Wife states that she does not have the gun
collebtion and does not want the Franklin Mint car collection.
She has suggested a value for the remaining property in her
possession at $1,700.00. Husband suggests a vallie for all of
the property at $3,929.00, Included in hllsband's value is the
gun collection, the Frdnklin Mint car collection, tool
collectIon, and a computer. Mr. Williams indicated that the
computer was Pll.rchased for the parties' son. Also wife
contends that the tool collection Is with the SOil.
In addition to the value of the Raytheon
pension, there is a York Bank IRA worth $l5,6B5.70 and a
Harsco Corporation savings plan with a value of $9,907.97.
There were also hecking and savings accounts
which were cashed out, husband receiving $800.00 and wife
receiving $l,473.00.
The parties are the second lien holders on a
property in Tennessee and are owed money on a mortgage. Mr,
Williams indicated that it is unlikely that they will recover
any funds from that mortgage but we can probably resolve that
issue by keeping that asset separate and indicating or
recommending that whatever is realized should be distributed
to the parties based on whatever percentage of distribution
each receives with respect to the other marital assets.
The parties have listed a number of items of
marital debt. According to attcrney Sumple-Sullivan, the date
of separation debt was $16,325.23. She claims that Mr.
Stonesifer gave money to wife over a period of approximately a
year assuming wife was going to pay down the debt. The amount
of money that hllsband claims that he gave wife is in excess of
$14,000.00. Mr. Stonesifer is entitled to some credit for
payment?f debt but an accounting will have to be done to
detennine what the extent of that credi t should be Inasmuch as
some of the money paid to wife would have been allocated to
her for her support.
Mr. Williams has noted that his position is
that all of the debt should be liquidated prior to the final
resolution of this case by divorce. His concern is that he
does not want wife to be left with an indemnification from
husband, who is living in Florida, and exposing the mobile
home, which wife owns, for repossession or sale by creditors.
Mr. Williams indicated that he is going to
prepare a comprehensive settlement proposal to husband's
attorney to see if they can perhaps bring this matter to final
resolution in the next month or so. Absent a final
settlement by counsel, the Master is going to proceed with the

1, The Plaintiff and Defendant are husband and wife, having been Joined in
marriage on June 30,1973.
2, Defendart admits the averments off Plaintiff's Divorce Complaint, flied
on June 9,1998 to the eobove captioned action, as they appear In Paragraphs 1, 2, 3,
4,5,6,7,8, and 9.
3. The parties have been living separate and apart since February 8, 1998.
4. Neither the Plaintiff or Defendant are in the military or naval forces of the
United States.
WHEREFORE, Defendant requests the Honorable Court to enter a decree of
divorce.

5. Paragraphs One through Four are Incorporated herein by reference as If

6. Plaintiff and Defendant have legally and beneficially acquired property,
both real and personal, during the course of their marriage until the date of their
separation, all of which property is "marital property",
7, The PI(\lntlff and/or DElfendant have acquired, prior to the marriage or
subsequent thereto, "non-marital property" which has Increased In value since the
date of the marriage and/or subsequent to its acquisition during the marriage, which
said increase in value is "marital property",
8, Plaintiff and Defendant have been unable to agree as to an equitable
I division of said property to the date of the filing of this complaint.
WHEREFORE, Defendant requests this Honorable Court to equitably divide all
marital property and to enjoin it from being removed, disposed of, alienated, sold, or
otherwise encumbered pending final hearing and settlement of all claims.

THE MASTER:
Today is Thursday, october 19,
2000. This is the date set for a Master's hearing in the
above captioned divorce proceedings.
Present in the hearing room are the J.
Plaintiff, Joseph E. stonesifer, III, and his counsel Barbara
surnp1e-Sullivan, and the Defendant, Shirley M. stonesifer, and
her counsel Morrison B. Williams.
This action was commenced by the filing of a
. divorce complaint on June 9, 1998, raisi.ng grounds for divorce
of irretrievable breakdown of the marriage. Counsel have
provided the Master with affidavits of consent and waivers of
notice of intention to request entry of divorce decree signed
by both parties so that the divorce can be concluded under
Section 3301(c) of the Domestic Relations Code.
The Master's
office will file the affidavits and waivers with the
Prothonotary.
On September 14, 1998, wife filed a
counterclaim raising the economic claims of equitable
distribution, alimony, alimony pendente lite, and counsel fees
and expenses.
Mortgage on the home and agrees to indomnify and hold husband
harmless from any obligations related to that mortgage. It is
further agreed that in the event that that loan obligation or
mortgage ob1:lgation would become 90 days or more 1n arrears
that wife shall have the obligation to list the mobile home
for sale so as to satisfy that obligation and/or to achieve
husband's release, or refinance that debt in her name alone so
that the debt will be immediately satisfied. Husband agrees
to execute the title to the mobile home, if in the event one
exists, transferring his interest to wife or to execute any
and all other documentation necessary to effectuate the
transfer. The mobile home is currently located on a rented
lot. Wife shall be responsible for all lot rent payments that
may exist for that property and indemnify and hold husband
harmless for any claims for that lot rent and additionally to
pay any and all taxes associated with the location of the
mobile home~' and indemni fy and hold husband harmless fr;am any
claim for those taxes.
2, The parties also own a parcel of property known as 207
Burns }\,venue, New Hope, Tennessee_ This property is under a,
sales agreement or deed of trust and was transferred to
individuals by the name of Charles T. Wilson and Debra J.
Wilson. The parties have a second mortgage due to them based
on the transfer of that property. The Wilson's have filed
bankruptcy in an attempt to discharge the obligation owed to
the StonesIfer's. In the event that any money is realized out
of the bankruptcy process or in any way related to that
property, said sum shall be divided equally between the
parties, and in the event that any liability would be
generated out of that property, said liability shall be
divided equally between the parties.
3. The parties stipulate that at the time of separation
wife received accounts valued at $1,473.00 and that husband
received accounts valued at $800.00.
4. The parties have a 1961 Impala automobile. That 1961
Impala shall become the sole and exclusive property of wife.
Husband agrees to cooperate by executing any title necessary
to transfer that vehicle to wife or any other document
necessary to transfer his interest therein.
5. The parties have as marital property an IRA account
that was existing at York Bank and Trust. That IRA is now
being held by Allfirst due to a transfer of the banking
interest. The current value of that IRA is $15,267.00. The
parties agree that the AIHirst IRA shall be cashed and the
processing fee of $45.00 shall be remitted to the banking
institution. The parties further agree that 28% of the IRA
. .
proceeds shall be paid to Mr. Stonesifer to satisfy the tax
obligation which will be generated upon cashing the IRA. The
parties then agree that the balance, which is approximately
$11,000.00 shall be paid to Mr. Williams, to be held in his
escrow for satisfaction of the following outstanding marital
debts.
These debts include an obligation owing to-
Montgomery Wards in the amount of $1,812.77, to Boscov's in
the amount of $862.48, as well as a truck judgment deficit of
$5,478.46 which is due end owing to PNC Bank. The truck
deficit judgment and the Montgomery Ward and Boscov' 5 shall be
paid in full unless Mr. Williams is able to negotiate a
compromise with any of the creditors. The obligation at that
point would be to fully release Mr. stonesifer from any
obligation from those debts. Any balance on any compromised
figure shal~ be the sole and separate property of Mrs~
Stonesifer.
Therefore, for example, in the E'vent that Mr.
Williams is able to negotiate an $1,100.00 settlement for the
Montgomery Wards payment, the remaining $700.00 shall be paid
to Mrs. Stonesifer. After satisfaction of these debts, the
remaining balance of the IRA proceeds, if in fact every amount
has to be paid in full, should be approximately $2,800.00.
That balance shall be the sole and separate property of Mrs.
Stonesifer. Attorney Williams will provide documentation to
counsel for Mr. Stonesifer of satisfaction of those debts.
6. Husband has a pension plan through Raytheon with an
estimated marital value of $14,340.77. Said Raytheon company
pensi.on shall be the sole and exclusive property of husband
and wife waives any interest or claim in regards to that
pension plan.
7. Husband additionally has an interest in the Harsco
Corporation savings plan which has a stipulated value of
$8,546.48. Husband agrees to rollover from that savings plan
to wife the sum of $3/500.00. This rollover shall be into a
qualified plan so as not to cause any tax consequence for
husband. Should wife choose to withdraw monies from the
amount rolled over, she shall be solely responsible for any
tax consequence with that withdrawal.
8. The parties have various items of personalty which
include the Franklin Mint car collection, computer, and
household furnishings. The parties agree that all items shall
become the sole and separate property of wife and any items of
marital property that are in wife's possession shall be her
sole and separate property and any marital it.ems of personal

property in husband's possession shall be his sole and
separate property. The tools that may be in the hands of the
son shall be the son's property.
9. The parties also had certain additional marital debt
that was not provided for and not being paid through the
proceeds of_ the York Bank/Allfirst. IRA. At the time of
separation there was a COl1unercial Credit debt of approximately
$3,580.00. . Husband warrants that he has paid that debt in
full and will indemnify wife against any claims for that debt.
There was also a marital Visa with a date of
separation balance of $1,940.30. Husband is paying and shall
continue to payoff the debt and indemnify and hold wife
harmless for that obligation. That debt has been transferred
from a joint card to an individual card and is solely in
husband' 5 name so as to avoid any liabi 11 ty for wife. J.
The parties also had a joint Home Depot debt of
$2,981. 56, a GPU Electric debt of $234.36, and a Commonwealth
telephone debt of $154.67. Husband shall agree to pay the
Home Depot, the electric, and the telephone bill and hold wife
harmless against any of those obligations or debts.
The remaining marital debts are, again, the
Montgomery Wards, Boscov's, and the PNC truck deficiency and
those will be satisfied out of the York Bank/Allfirst IRA
proceeds.
10. The parties agree thilt there shall be no support and
wife agrees to withdraw her c~aims for support, alimony
pendente lite, and alimony. !
11. The_parties also agre~ to withdraw any claims that
they may have relative to claims for counsel fees, costs and
expenses.
12. Except as herein otherwise provided, each party may
dispose of his or her property in any way and each party
hereby waives and r'elinquishes any and all rights he or she
may now have or hereafter acquire under the present or future
laws of any jurisdiction to share in the property or the
estate of t~e other as a result of the marital relationship
including without limitation, statutory allowance, widow's
allowance, right of intestacy, right to take against the will
of the other, and right to act as administrator or executor in
the other's estate. Each will at the request of the other
execute, acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect this
mutual waiver and relinquishment of all such interest, rights,

and claims.

Independent Interests for Plaintiff and Defendant In said benefits. The amount of each
Interest shall be as follows:
A. Defendant, Shirley M. Stonesifer, Is awarded $3,500.00 of Plaintiff's, Joseph
E. Stonesifer, III, Interest In the Harsco Corporation Savings Plan as of October 19, 2000.
Said Plan being valued as of October 19, 2000 and as of that date being divided
$3,500.00 for the Defendant and the remainder for Plaintiff. Defendant shall receive any
Increase or decrease In value attributable to this award that has accrued since October 19,
2000. Defendant shall receive her Interest pursuant to this Quallfled Domestic Relations
Order. Defendant Is awarded a ~eparate ownership Interest In her share of the account
together with a separate responsibility for the tax liability attributable thereto. Alternate
Payee shall be ~olely responSible for any and all tax consequences of the funds being
transferred to her pursuant to this Quallfled Domestic Relations Order. Alternate Payee
shall Indemnify and hold Participant harmless for any tax liability that may arise as a result
of this transfer.
B. Plaintiff, Joseph E. Stonesifer, III, Is awarded the remaining balance of his
Interest In the Harsco Corporation Savings Plan as of October 19, 2000, said Plan being
valued as of October 19, 2000, and as of that date being divided $3,500.00 to
Defendant and the balance to Plaintiff. Plaintiff shall receive any Interest or Increase In
value attributable to his remaining Interest In the Plan that has occurred since October 19,
2000. Plaintiff shall receive his Interest pursuant to this Qualified Domestic Relations
Order. Plaintiff Is awarded a separate ownership Interest In his share of the account
together with a separate responsibility for the tax liability attributable thereto. Participant

shall be solely responsible for any and all tax consequences of the funds remaining under his
separate ownership pursuant to thIs Qualified Domestic Relations Order.
NOW, THEREFORE, /T /S HEREBY ORDERED:
A portion of Participant's Interest In the Plan Is hereby assIgned and distributed to
the Alternate Payee In accordance with paragraph "A" above, relating to award to
Alternate Payee,
I . AuJinme.nt. From the benefits which would otherwise be allocated to Participant,
the Plan shall Irrevocably a,lslgn to Alternate Payee Defendant $3,500.00 of
Plaintiff's Interest In the Harsco Corporation Savings Plan as of October 19, 2000.
After thIs assignment, Participant shall have no remaining right! to the distribution
of the Assigned Portion. After this assIgnment, Alternate Payee shall for all
purposes be treated as a beneflclalY to whom payment of the Assigned Portion and
any Interest accruing on the Assigned Portion must be made. Alternate Payee shall
have no rights In the portion of Participant's accrued benefits not assigned to
Alternate Payee and shall have no rights In any contributions to or earnings on
Participant's portion of the Plan after the date of the entry of the Ndgment and
Decree herein.
2. ~Istrlbutlon to Alternate Pay~ The form of distribution of the Assigned Portion
shall be In the form determined In accordance with the rules of the Plan. The time
of distribution of the Assigned PortIon shall be the earliest time for distribution
permItted by the Plan and shall be no later than the time when distribution Is made
to Participant, or, If earlier, when Participant reached the earliest retirement age
permitted under the Plan whether or not Participant retires.

(c) Payments shall be made to Alternate Payee 111 the form of monthly lifetime
payments for the life of Alternate Payee.
5. Seoarate Ownenh1Q.. Each party shall have a separate ownership In the dIvided
Interest, together with the separate responsibility for the tax liability attributable
thereto. It Is Intended that the tax consequences of the receipt of these payments
be borne accordIng to the proportionate share of the total Interest received by each
party. This dlvl~lon shall be made In all events, and shall not be modified by any
change of circumstances of either party.
6. The Alternate Payee shall be solely responsible for making application to the Plan
for the Plan's benefits hereby assigned to her and any such applications shall be In
accordance with the Plan'$ customary procedures.
7. To the extent this Order Is determined not to be a Qualified Domestic Relations
Order, either by the Plan Administrator or a Court of competent Jurisdiction, the
Participant and the Alternate Payee shall cooperate fully and execute any and all
document~ necessary to obtain an amended Order meeting all the requirements of
a Qualified Domestic Relations Order which Is consistent with the Intent of the
parties as stated herein, and the Court shall reserve Jurisdiction over the Alternate
P.1Yee's Interest and the Partlc1pant's plan benefits as of the date of the Judgment
and Decree of Dissolution In order to effectuate the asslll11ment and payment of the
pension fund.
