5. The carelessness, recklessness and negligence of
the Defendant, SCOTT MORRISON, consisted of the following:
f.\. fail ing to maintain proper and adequate
control over said automobile;
b. failing to use due care for the rights, safety
and position of others;
c. failing to use reasonable care under the
circumstances;
d. failing to keep a proper lookout;
e. operating said motor vehicle at an excessive
rate speed under the existing circumstances;
f. failing to obey and observe properly the
statutes of the Commonweal th of Pennsylvania regulating the proper
use of motor vehicles on the public streets and highways;
g. failing to observe the vehicle of the
Plaintiff, GORDON, on the highway so as to avoid a collision;
h. operating the vehicle in a manner disregarding
the rights and safety of others so as to endanger any person then
and there lawfully travelling upon the roadway;
i. failing to have the vehicle under proper
control so that it could be readily stopped, turned aside or the
speed thereof slackened upon the appearance of danger.
6. As a result of the aforementioned collision, which
was directly and proximately caused by the negligence and

c~relessness of Defendant, Plaintiff's automobile su~tained
extensive damage in the amount of F,leven 1'hotlsand 8ighty-two
Dollars and Sixty-Seven Cents, ($11,082.67).
7. Despite demand, Defendant has paid no part of any
of the aforesaId damages suffered by plaintiff, GORDON.
WHEREFORE, plaintiffs demands :iudgment agaInst Defendant
SCOT'I' MORRISON In the amount of Eleven Thousand EIghty-two Dollars
and SIxty-Seven Cents ($11,082.67)/ together with interest and all
costs of this action as may be allowed by law and stich other and
further relief as may be just and appropriate.

I, Defendant, Scott Morrison, hereby ProSe that after reasonable investigation, is unable
to determine the truth or falsity of these averments and therefore specific proof is demanded,
2, Defendant has asked for specific proof on numerous occasions and has recej1/ed
nothing upon his request in the last two years,
3. As d result of Plaintiff's negligence, letters were issued to the Plaintifl'regarding
Defendant's willingness to pay if shown proof of amount asked for,
4, Despite demand, Plaintitl'proceeded to call a Collection Agency to harass Defendant
over a period of six months, in which nothing W\l.S lIccomplished,
5, At the same time, Defendant would also like to know why he should pay for the
vehicle of Gregg W, Gordon to be fixed, when in fact; the vehicle was sold to a Salvage Yard
and not ordered fixed by Mr, Gordon,
6, Finally, Defendant demands proof of amount paid to Gregg W. Gordon by Plaintiff
and the total amount paid to olle Wendy Arnold,
Wherefore, Defendant prays the Court drop all charges due to Plaintiff' s neglig~nce to
provide proof of amount asked and for negligence of corroborating payment with Defepdant.
