be entered in favor of the Plaintiff and against the Defendant in the full amount
of $1,446.12, including interest, reasonable attorney fees and Court costs i
giving credit for any payment made.
3. Plaintiff agrees not to enter Judgment so long as the Defendant
causes to be delivered into the hands of the Plaintiff's counsel the following
payment in full by 4: 30 P. M. the close of business, on the following dates,
$570.49 on July 31, 1998
$570.49 on August 31, 1998
4. Time is of the essence in this agreement and the failure to make the
above payments to Plaintiff's cO'lnsel on or before the dates and time due ehall
allow plaintiff to immediately enter Judgment by Default in accordance with the
Pelmsylvania Rules of civil Procedure and to issue Execution thereon, and to
pursue all other remedies in law or equity to collect the full balance of the
Judgment entered hereunder plus appropriate additional interest at 18\ per annum,
reasonable attorney costs and collection fees and costs,
5. No act or omission of the Plaintiff, nor of anyone alleged to be
acting on its behalf, shall constitute a waiver, estoppel, or any other excuse
for nonperformance of any duty undertaken by the Defendant in this stipulation,
which the parties agree is final and complete.
