1. A Complaint in Divorce under 9 3301(c) of the Divorce Code was filed on June 12, 1998.
2. The marriage of plaintiff and defendant is irretrievably broken and ninety days have elapsed from
the date of filing and service of the Complaint.
3. I consent to the entry of a final Dec'ee in Divorce after service of notice of intention to request
entry of the Decree.
I verify that the statements made in this Affidavit are true and correct to the best of my knowledge,
information and belief. I understand that false statements herein are made subject to the penalties of 18
Pa.C.S. 4904 relating to unsworn falsification to authorities.

1. I consent to the entry of a final Decree of Divorce without notice.
2. I understand that I may lose rights concerning alimony, division of property, lawyer's fees or
expenses if I do not claim them before a divorce is granted.
3. I understand that I will not be divorced until a Divorce Decree is entered by the Court and that
a copy of the Decree will be sent to me immediately after it is filed with the Prothonotary.

Three Hundred Thirty and 22/100 Dollars ($330.22) per month is

Furthermore, Husband seeks payment of counsel fees.
The basis for the receipt of alimony and payment of counsel
fees is due to the disparity in incomes of the parties and
Wife's superior educational background and employment
opportunities. Based on these factors and the other factors
of Section 3701 of the Divorce Code, Husband believes that he
is entitled to alimony and payment of his counsel fees.
B. Equitable Distribution - Husband proposes that he receive any
and all personal property that is currently in his possession.
Husband also seeks distribution to him of the following
assets:
1. Husband would receive 55 per cent of the marital assets,
to include the marital residence.
Husband would
refinance the home equity loan, but would receive credit
for that portion of the home equity loan which pertains
to the remaining amount allocated for that amount
.borrowed for the automobile to be retained by Wife and
Wife's personal loan (the amounts of which would need to
be confirmed).
With a 55 per cent distribution of
marital assets to Husband, this will necessitate a QDRO

ENGAGEMENT AGREEMENT

RE: Engagement Agreement
Dear Mr. Fickett:
We appreciate your decision to engage our firm as your legal
counsel to represent you.
SCOPE - The scope of the representation for which you have engaged
us will include representation in matters pertaining to the divorce
action filed in cumberland County.
COMPLETION OF WORK - We assume that the legal matters that you
entrust to us are important to you and require our prompt
attention. No project is ever intentionally delayed. As in any
firm, however, we do not have complete control over all client
matters that we are asked to handle at any given moment. For
example, we cannot predict whether the other firms or parties
i.nvolved in a particular project or negotiation will also give the
matter their prompt attention. Therefore, we ask that you contact
us if you are concerned about the status of a particular project.
We in turn will use our best efforts to complete your work timely
and will inform you if we expect that your legal matters will not
be completed within the originally projected time frame.
BASIS OF FEES AND EXPENSES - TYPICAL SERVICES - Initially, our fees
and expenses, discussed below, will applied against an initial
retainer of $750. Please forward this retainer to us along with a
signed copy of this Engagement Agreement. We may request from time
to time, for the amount of the retainer to be increased or, if
expended, to be replenished. I provide my service at an hourly

rate of $125 per hour. For my services, I charge for all time
spent on matters, which will include such items as phone calls or
the preparation of letters. Your invoices will reflect the actual
time devoted to your legal matters. You may be concerned about
accumulating legal fees for minimum charges for phone calls related
to your matters. Accordingly, to keep costs down, we recommend
that you consider maximizing the value of those calls by
coordinating, when possible, the various activities for which you
engage us, and discussing several matters during a single telephone
conference.
You will also be billed for our out-of-pocket expenses, such as
filing fees, process serving fees, production of transcripts,
travel mileage, investigators, appraisers, accountants, and
photocopies. These out-of-pocked expenses will also be itemized on
your invoices. In many instances, you will be required to advance
certain out-of-pocket expenses, upon request.
It is impossible to determine in advance the amount of time that
will be needed to complete your case; therefore, it is not possible
for us to indicate, in advance, the attorney's fees and costs that
will be incurred in representation of you. We will keep you fully
informed of all time used and expenses incurred.
PAYMENT FOR FEES AND EXPEN~ - We will bill you periodically on a
time and expenses expended basis. We request that you treat your
timely payment for our services with the same level of concern that
you expect us to give you attention to your legal needs. We
reserve the right to terminate our attorney/client relationship for
non-payment of fees and costs. We will charge a finance charge of
one per cent (1%) per month (annual rate of 12%) to any account
balance which remains outstanding for more than thirty (30) days
from the date such balance is invoiced.
PROGRESS OF CASE AND OTHER OUESTIONS - We shall keep you informed
as to the progress of your case. When necessary, we shall send
copies of all papers coming in and going out of our offices
including correspondence, pleadings and other documents. If I am
unavailable when you telephone, your call will be returned with.

at meetings, or otherwise unavailable to answer your call. At such

times, please feel confident to talk with my secretary. Please
keep in mind, however, that my secretary is not an attorney, and
cannot give you legal advice. If you are passing on information,
my secretary can deliver it to me without the necessity of you
waiting to have me return the call. If you have questions that
require an answer from me, it is far easier for my secretary to
obtain the background from you, bring the matter to my attention
when I am free, and then have me respond to you. If it is
necessary that you speak with me directly, I will attempt to return
your call as soon as possible. I have also found, however, that in
many instances, that if you have a particularly detailed questions
or concern that it is best to schedule an appointment to review
that matter. If you are calling to set up an appointment only, you
need not ask for me personally. Please ask to speak to my
secretary who will be able to set up an appointment at a time
convenient to you.
While we anticipate that you will be satisfied with our
representation, we encourage you to inform us if any time our
professional services do not meet with your expectations for any
reason. Please call us immediately if this ever occurs.
Frequently, courts will send documents directly to you, as a party
to the litigation, and they will not send copies to us, as your
attorney of record. For this reason, it is very important that you
forward to us any documents, papers, or correspondence which have
been sent directly to you from the court or from any other source
which may have any bearing on this matter.
TERMINATION - We shall at all times reserve the right to terminate
our services upon written notice to that effect in the event that
you either fail to cooperate with us in any reasonable request, to
timely pay the monthly statements in full as submitted, or if we
determine in our reasonable discretion that to continue our
services to you would be unethical. We will give you reasonable
notice of our termination of our services, and we will endeavor
before any such termination to assist you in retaining alternate
counsel without a lapse in representation.
By signing below, you acknowledge that you have received a copy of
this Engagement Agreement, you have had an opportunity to discuss

advise that it is your intention to present testimony at the hearing scheduled for January
5, 2000. At the pre-hearing conference, we determined that the evidence to be presented

that Mr. Fickett has refused promotions and is underemployed and testimony on the value

I have not received any notice from the Divorce Master that the scope of the January 5th
hearing has been extended, my client has never seen Dr. Anderson, nor have we received.

appraisal you provided to me today.
Absent an Agreement or an Order of Court, I am going to assume that the scope

THE MASTER: Today is Tuesday, June 27, 2000.
This is the date we had set to continue the testimony in the
above captioned divorce proceedings to take the testimony of
the parties and any witnesses that they wished to present.
We previously had a hearing on January 5, 2000, to take the
testimony of husband's employer.
Present in the hearing room are the
Plaintiff, Joyce E. Fickett, and her counsel Barbara
Sumple-Sullivan, and the Defendant, Larry G. Fickett, and his
counsel Carol J. Lindsay.
The action was commenced by the filing of a
divorce complaint on June 12, 1998, raising grounds for
divorce of irretrievable breakdown of the marriage and
indignities. The complaint also raised the economic claim of
equitable distribution.
In response to the complaint, the Defendant
filed an answer and counterclaim on July 13, 1998. The
Defendant, in his counterclaim, raised a count for divorce of
indignities and claims for alimony, alimony pendente lite, and
counsel fees and expenses.
Counsel have indicated that the parties are
going to conclude the divorce under Section 3301(c) of the
Domestic Relations Code and will provide the Master with
signed affidavits of consent and waivers of notice of
intention to request entry of divorce decree. Those
affidavits will be filed by the Master with the Prothonotary's
office.
The parties have had continuing negotiations
and appeared this morning and advised the Master that they
reached a final resolution of all of the economic issues. An
agreement is going to be placed on the record in the presence
of the parties. The agreement as placed on the record will be
considered the substantive agreement of the parties not
subject to any changes or modifications except for correction
of typographical errors which may be made during the
transcription. Counsel and the parties are going to return
later this morning to review the draft for typographical
errors, make any corrections as required, and then affix their
signatures affirming the terms of settlement as stated on the
record at this time.
Upon receipt by the Master of the signed
document affirming the terms of settlement, the Master will
prepare an order vacating his appointment and counsel will
then be able to file a praecipe transmitting the record to the
Court requesting a final decree in divorce.
The parties were married on April 4, 1970,
and separated June 10, 1998. They are the natural parents of
one child who is emancipated. Ms. Sump1e-Su11ivan.
MS. SUMPLE-SULLIVAN: The property is to be
distributed pursuant to the agreement of the parties as
follows:
1. There are two interests in real estate. The one
interest is designated as 1411 Kuhn Road. That property is
jointly titled between the parties. Husband shall be the
sole owner of that real estate and wife will agree to execute
a special warranty deed transferring and relinqUishing any
interest she may have in that property. However, husband
shall be under an obligation to refinance the existing home
equity loan with Member's 1st within 45 days of this
agreement. Said deed shall be held in escrow by husband's
counsel pending husband's sUccessful refinancing of the home
equity loan obligation. Effective July 1, 2000, Mr. Fickett
shall make all necessary payments on the home equity line and
any other expenses due relative to the home pending his
refinance of the debt.
2. The second parcel is known as Rt. 44 Coudersport
Pike. Husband shall have all interest in that property. Wife
shall execute a quitclaim deed as may be requested relative to
the Coudersport property. All deeds shall be prepared by
counsel for husband and transmitted to counsel for wife.
3. Regarding vehicles, husband shall be the owner of
a 1995 Chevy truck 150. Wife shall be the owner of the 1998
Honda Accord EX. Neither of the vehicles are encumbered and
both parties shall cooperate to transfer any interest or title
in regards to said property.
4. There are additional recreational vehicles and
specific pieces of lawn equipment which shall be transferred
and be the sole property of husband. These shall include a
1993 Honda four-wheeler with winch and plow, a 1989 Yamaha
four-wheeler, a 1996 trailer double, a 1975 Wheelhorse lawn
mower, and a leaf vac. Those additional vehicles and
equipment shall be the sole and separate property of husband.
5. In regards to division of accounts, husband shall
maintain the following accounts which have been in his
possession since the time of separation and these accounts
shall be his sole and separate property. Member's 1st,
Account No. 14151, which included both a certificate of
deposit in the approximate sum of $8,400.00 and a savings
account in the approximate sum of $2,400.00. Additionally
husband shall have as his sole and separate property the
proceeds of the F&M Trust account, savings Account No.
000-800060 with an approximate balance of $2,000.00 and a
certificate of deposit with an approximate balance of
$1,300.00. Husband shall additionally retain all savings
bonds in his name and in his possession, which had an
approximate value of $30.00.
6. Wife shall also maintain all accounts that have
been in her possession since the date of separation and said
accounts shall be her sole and separate property. This shall
include Member's 1st, Account No. 12725, which consists of a
savings account with an approximate balance of $373.00; a
Christmas club in the amount of $637.00; and IRA savings
account in the amount of $322.00; checking account with an
approximate value of $1,321.00; and an IRA five-year
certificate with the approximate value of $10,177.12. Wife
shall also be the sole and separate owner of an individual
account at Member's 1st designated as 135422 which consisted
of a savings account in the amount of $234.00 and a savings
account in the amount of $6.48. Wife shall also be the sole
and separate owner of savings bonds that are in her possession
and have been ~ince the time of separation with an approximate
value of $64.68.
7. Wife shall also be the sole owner of her Thrift
Savings Plan through her employer which had an approximate
value at the time of separation of $15,758.26.
8. The parties agree that wife shall retain all
retirement benefits payable through her employer as provided
for through the Civil Service Retirement System (CSRS) with
the exception that husband shall be granted a portion of the
annuity, the equivalent of $24,000.00. The portion to be paid
to husband shall be effectuated by virtue of a QDRO which
shall be drafted by Harry Leister and which shall provide for
a monthly annuity of approximately $203.12 upon wife's
retirement. The cost of drafting the QDRO shall be shared
equally between the parties. All other retirement benefits in
that CSRS pension shall be wife's sole and separate property.
The portion of the pension being paid to husband
is in fact the result of a compromise valuation of the pension
which consisted of the average pension value between the
present actual value of the retirement benefit at age 55 and
the present actual value of retirement at the age of 62, being
reduced for the applicable social security benefit for
Mrs. Fickett as defined by Mr. Leister and which constituted a
net value for purposes of our valuation of approximately of
$169,000.00. Based on consultation with Mr. Leister, it was
determined that by averaging the percentage of blended pension
against the total monthly annuity provided by the CSRS for the
marital portion of Mrs. Fickett's monthly sum, the approximate
monthly benefit payable to Mr. Fickett will be $203.12 on a
monthly basis payable on Mrs. Fickett's retirement.
In addition, said QDRO shall provide that Mr.
Fickett can, at his cost, bear a survivor annuity benefit for
his portion of the pension and said cost for the survivor
annuity benefit shall be reduced directly from his monthly
payment. Mrs. Fickett shall be under no obligation for the
remainder of the pension to designate a survivor annuity value
or election.
9. Additionally, husband shall be entitled to
maintain health insurance through Mrs. Fickett's employer as
is available through that employer. All health care costs for
Mr. Fickett shall be paid directly by Mr. Fickett effective
upon the entry of a divorce decree and Mrs. Fickett shall be
under no obligation to bear health care costs for Mr. Fickett.
10. There are miscellaneous items of personal property
that had been in dispute between the parties including an
Alaskan stove, tools, guns, and old money in a lock box.
Those items shall become the sole and separate property of Mr.
Fickett.
11. The parties are the owner of two cemetery lots.
Those lots shall be sold and the proceeds distributed between
the parties on an equal value. With regard to the cemetery
lots, wife will attempt to sell the lots. The parties will
equally share the costs of that attempt and wife has the
discretion to the sell the lots at a price she deems
reasonable.
12. Mr. Fickett is an owner of a life insurance
policy designated as Prudential Rl 028 779. Mr. Fickett shall
retain sole ownership of that life insurance policy and Mrs.
Fickett waives any claims relative to that life insurance
policy.
13. Effective July 1, 2000, Mrs. Fickett agrees to pay
to Mr. Fickett the sum of $200.00 per month as alimony. That
sum shall be non-modifiable and shall continue due and payable
until the occurrence of the earlier of the following events:
a) The death of either party;
b)
The retirement of Mrs. Fickett;
c)
Fickett.
Cohabitation of Mr. Fickett or remarriage of Mr.
The $200.00 per month in alimony shall be wage
attached through the office of the Office of Domestic
Relations in Cumberland County.
14. Both parties waive any claims against the other on
account of counsel fees and expenses and any credits they were
claiming on or against the other.
15. Wife will return to husband any personalty of his
which she has her in her possession, including instruction
booklets and warranties for any personal property which
husband is retaining.
16. Husband will return to wife any personal items of
wife, including yearbooks in the attic.
17. The parties will execute any documents required by
the other in order to release bank accounts or credit union
accounts in which he or she has no further interest.
18. Except as herein otherwise provided, each party
may dispose of his or her property in any way and each party
hereby waives and relinquishes any and all rights he or she
may now have or hereafter acquire under the present or future
laws of any jurisdiction to share in the property or the
estate of the other as a result of the marital relationship
including without limitation, statutory allowance, widow's
allowance, right of intestacy, right to take against the will
of the other, and right to act as administrator or executor in
the other's estate. Each will at the request of the other
execute, acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect this
mutual waiver and relinquishment of all such interest, rights,
and claims.

MR. FICKETT: Yes.

6. The Alternate Payee is entitled to a portion of the Participant's Gross Monthly Annuity
under the Plan as set forth below. The OPM is hereby directed to pay Alternate Payee's share
directly to Alternate Payee.
7. This DRO assigns to Alternate Payee an amount equal to $203.12 of the Participant's

In addition to the above, when COLA's are applied to Participant's retirement benefits,
the same COLA shall apply to the Alternate Payee's share.
8. Payments to Alternate Payee shall commence the date the payments commence to the
Participant. Payments shall continue to Alternate Payee for the remainder of Participant's
lifetime. If the Alternate Payee dies before the Participant, the Alternate Payee's share of the
Participant's pension shall revert to the Participant.
Participant agrees to arrange or to execute all forms necessary for the OPM to
commence payments to the Alternate Payee in accordance with the terms of the DRO.
9. The Alternate Payee is awarded a former spouse survivor annuity of $203.12 per month
if the Participant dies before her benefits co=ence.
Participant agrees to take all necessary steps to elect Alternate Payee as the designated
beneficiary for purposes of establishing and sustaining such surviving spouse coverage for
Alternate Payee.
10. The Alternate Payee may elect a former spouse survivor annuity of up to $203.12 per
month ifthe Participant dies after her benefits commence. Any costs associated with providing
this surviving spouse annuity coverage shall be paid by the Alternate Payee.
11. If Participant leaves Federal service before retirement and applies for a refund of
employee contributions under the Plan, the Alternate Payee shall be entitled to a pro rata share of

such employee contributions. The marriage occurred on April 4, 1970, and the separation
occurred on June 10, 1998.
12. In no event shall the Alternate Payee have greater benefits or rights other than those
which are available to the Participant. The Alternate Payee is not entitled to any benefit not

otherwise provided by the Plan. The AItllrnate Payee is only entitled to the specific benefits
offered by the Plan as provided in this Order. All other rights, privileges and options offered by
the Plan not granted to Alternate Payee are preserved for the Participant.
13. The Plan shall issue individual tax forms to the Participant and Alternate Payee for
amounts paid to each such person.
14. In the event that the Plan inadvertently pays to the Participant any benefits that are
assigned to the Alternate Payee pursuant to the terms of this ORO, the Participant shall
immediately reimburse the Alternate Payee to the extent that she has received such benefit
payments, and shall forthwith pay such amounts so received directly to the Alternate Payee
within ten (10) days of receipt. In the event the Plan inadvertently pays to the Alternate Payee
any benefits that are not assigned to him pursuant to the terms of this ORO, the Alternate Payee
shall immediately reimburse the Participant to the extent she has received such benefit payments
and shall forthwith pay such amounts so received directly to the Participant within ten (10) days
ofreceipt.
15. In the event the Participant makes a one-time irrevocable election to transfer into the
Federal Employees Retirement System ("FERS") before his retirement, then Alternate Payee shall
be entitled to a portion of the Participant's Basic Annuity and/or a Refund of employee
contributions under FERS calculated in a manner similar to that which is enumerated. in Sections
7,8,9, 10 and 11 above for the annuity and refund, respectively, and payable directly from FERS.
Additionally, Alternate Payee shall be entitled to a former spouse survivor annuity payable under
FERS and determined in a similar manner to the survivor benefits set forth under Sections 9 and
10 above. Further, such former Spouse survivor annuity shall be payable directly from FERS.
