BRENEMAN, Defendants CIVIL ACTION - LAW COMPLAINT AND NOW, comes Harris Savings Bank by and through its counsel, Richard C. Ruben, Esquire and states the following in support of its Complaint: 1. The Plaintiff is Harris Savings Bank, a Corporation organized and existing under the laws of the Commonwealth of Pennsylvania and having its principal place of business at Second and Pine Streets, Harrisburg, Pennsylvania 17101. 2. The Defendants are Benjamin L. Breneman and Michelle C. Breneman, husband and wife, adult individuals whose current addresses are 5001 Carlisle Pike, Mechanicsburg, Pennsylvania 17055 (business) and 816 Flintlock Ridge Road, Mechanicsburg, Pennsylvania 17055 (home). 3. Defendants on September 7, 1989, entered into an Adjustable Rate Note transaction with Harris Savings Association, now Harris Savings Bank, in the principal amount of Six Hundred Thousand ($600,000.00) Dollars the terms of which loan are more specifically evidenced and set forth in the Adjustable Rate Note dated September 7, 1989, a true and correct copy of which is attached hereto and incorporated herein by reference as Exhibit "A". 4.. Plaintiff, in consideration of the said Note advanced to Benjamin L. Breneman and Michelle C. Breneman Six Hundred Thousand ($600,000.00) Dollars. 6. No judgment has previously been entered on said Note in any jurisdiction. 7. That said Note is in default because Defendants jointly and severally have defaulted on the Note in that they have failed and refused to make regular payments on said Note since October, 1997 in the amount of $5,671.92 monthly through December, 1997; $5,682.71 for January through May, 1998; plus late charges in the amount of $2,089.04. 8. The Plaintiff has given to the Defendants written notice as required by law under Act 6 dated December 18, 1997, a copy of which is attached hereto and incorporated herein as Exhibit "C", 9. The Plaintiff is not required to give written notice of default under Act 91 in this case as the premises are not o.wner occupied. 10. That due to Defendants' default the entire principal amount of Six Hundred Thousand ($600,000.00) Dollars has become due and payable, together with interest at the current rate of 10.5% per annum, reasonable legal fees for collection of said sums in accordance with the terms of said Note less such sums as have been paid on account. 11. Plaintiff believes that during the term of this Suit casualty insurance protecting the premises securing this Note will become due and payable in the amount of $5,347.68 and that it will be required to pay such amount. 12. The Plaintiff believes and therefore avers that reasonable attorney's fees for collection of the debts are $28,639.75 and that it will incur such amount. . ADJUSTABLE RATP. The principal and interest shall be payable at the narris Savings Association, Second and pine Streets, lIarrisburg, Pennsylvania, or such other place as the holder hereof may designate in writing, in consecutive monthly insta llments in the amount of Pive 1'housand six Hundred Sixty-Pive and 10/100 ___~_____________________________________ ($ 5,665.10 ) DOLLARS, on the first day of each month beginning November 1, 19 89 , (herein first payment date), until the entire indebtedness evidenced hereby is fully paid, except that any remaining indebtedness, if not sooner paid, shall be due and payable on the first day of October I , 2014 The interest rate shall not increase to a rate greater. than l';.50 % regardless of any movement of the index. It i~ the intention that thirty (30 days' advance notice of interest rate and payment adjustments will be given Obligor. Failure to give notice will not affect the right of the narris Savings Association to adjust interest rates as above. If any installment under this Note is not paid when due, the unpaid principal balance of this Note shall bear interest during the period of de 1 i nquency a tara te 0 f Teo and One-ha If--------------------------------------- (10.50 %) per cent per annum (the initial interest rate), or any adjustment thereto as stated above, or, if such increased rate of interest, if any, which may be collected from the undersigned under applicable law, then, at the maximum increased rate of interest, if any, which may be collected from the undersigned under applicable law; and, at the option of the holder hereof, the entire principal amount outstanding hereunder and accrued interest thereon shall at once become due and payable. Failure to exercise such option shall not constitute a waiver of the right to exercise such option if the undersigned is in default hereunder. In the event of any default in the payment of this Note, and if the same is referred to any attorney-In-fact for collection or suit is brought hereon, the undersigned shall pay the holder hereof, in either case, all expenses and costs of collection, inclUding, but not limited to, attorney's fees of five (5%) per cent of the unpaid principal balance hereof, but not less than One lIundred Dollars ($100.00). . The undersigned shall pay to the holder hereof on demand a late charge of five per cent (5%) of any installment not received by the holder hereof within fifteen (15) calendar days after the day the installment is due; said additional charge shall be added to the principal debts in the event it is not paid. Prepayment will be permitted with, surrender charge of 3.00% of the amount prepaid during the first five years of the loan with no prepayment penalty after five years from the date hereof. No prepayment penalty shall be assessed in the event the property is' sold or refinanced and the financing is provided by Harris _ Savings Association. If refinancing is necessary due to capital improvements or ~ additions to the buildin", the prepayment pena l ty will be waived if lIarris Savings . AND PROVIDED I'URTIIER, anything herein provided to the contrary notwithstanding, it is expressly understood and agreed that the obligation of this Note shall cover, as well, any other additional advances that may be made by Obligee to Obligor at any time or times hereafter, provided that at no time may the total balance due b~ Obligor to Obligee hereunder, whether the same represents, in whole or in part, the initial advance or any future advance or advances exceed the original amount of this obligation. AND FURTHER, the Obligor agrees that if at any time the total arrearages in said monthly installments are equal to at least two contracted monthly payments or if default is made in the payment of taxes, water rent or insurance premiums when due, or if the buildings on the mortgaged premises are not maintained in good and sufficient repair after notice from the Obligee, or title to said mortgaged premises is transferred to anyone other than the survivor of the Obligor without written consent of the Obligee and the execution of a collateral bond by the transferee, or in case of any default under the terms hereof or of the accompanying mortgage whereby the security of the Obligee is or shall be impaired, then in any such case, the said principal sum, and additional advances, or so much thereof as shall remain unpaid, shall, at the option of Obligee, its successors or assigns, become due, and payment of the same and all accrued interest and charges, taxes, water rents and costs of insurance as aforesaid, together with an attorney's commission as above mentioned, besides costs of suit, may be enforced and recovered at once, anything herein contained to the contrary notwithstanding. FROM time to time, without affecting the obligation of the undersigned or the successors or assigns of the undersigned to pay the outstanding principal balance of this Note and observe the covenants of the undersigned contained herein, without affecting the guaranty of any person, corporation, partnership or other entity for payment of the outstanding principal balance of this Note, without giving notice to or obtaining the consent of the undersigned, the successors or assigns of the undersigned or guarantors and without liability on the part of the holder hereof, the holder hereof may, at the option of the holder hereof, extend the time for payment of said outstanding principal balance or any part thereof, reduce the payments thereof, release anyone liable on any of said outstanding principal balance, accept a renewal of this Note, modify the terms and time of payment of said outstanding principal balance or join in any extension or subordination agreement, and agree in writing with the undersigned to modify the rate of interest or period of amortization of this Note or change the amount of the monthly installments payable hereunder. Presentment, notice of dishonor, and protest are hereby waived by all makers, sureties, guarantors and endorSers hereof.
