COMPLAINT
AND NOW, come Plaintiffs, Robert E. Tibbens, Jr., and Dorene
M. Tibbens, by and through their attorneys, Law Offices of Craig A.
Diehl, and file this Complaint, respectfully stating in support
thereof the following:
l. Plaintiffs are Robert E. Tibbens, Jr., and Dorene M.
Tibbens,
husband and wife,
(hereinafter referred to as
"Plaintiffs"), adult individuals who reside at 110 Flamingo Drive,
Mechanicsburg, Cumberland County, Pennsylvania 17055.
2. Defendant is Robert H. Appleby, (hereinafter referred to
as "Defendant"), adult individual who resides at RD # 1, Box 206,
Hesston, Huntington County, Pennsylvania 16647-9208.
3, During the fall of 1995, Defendant listed for sale his
residence situated at 110 Flamingo Drive, Mechanicsburg, Cumberland
County, Pennsylvania 17055, with Jack Gaughen Realty. The property
shall hereinafter be referred to as the "Subject Property".
4. Prior to the sale of the Subject Property, Defendant had
difficulties with the private, on-site sewage system including
problems with the drain field.
5, Defendant hired Dillsburg Septic & Excavating to correct
the problems with the sewage system on the Subject Property.

6, Dillsburg Septic & Excavating extended the drainage field
line of the sewage system on the Subject Property.
7, On or about October 4, 1995, Defendant fully completed
and signed the "Seller's Property Disclosure Statement" attached as
Exhibit "A" and incorporated herein by reference.
8. Question 9 (f) of the "Seller's Property Disclosure

9. Defendant answered question 9 (f) as follows: 1992 to
the first part of the question, three (3) years to the second part
of the question, and "mand by Monroe Township" for the third part
of the question.
10. Question 9 (h) of the "Seller's Property Disclosure
the fOllowing:
Statement" specifically required Defendant to answer, in writing,
9. WATER AND SEWAGE: .
(h) Are you aware of any leaks, backups,
Occasional surface water or other problems relating
to any of the plumbing, water and sewage related
items? _ Yes No."
11. Defendant answered Question 9 (h) in the negative,
12, Under Pennsylvania law, Defendant, as the Seller, had an
obligation to complete the Seller's Property Disclosure Statement
in a truthful and accurate manner, to complete all applicable items
in the Property Disclosure Statement, and disclose to the

that Defendant had of any problems with the on-site sewage system.
19. Defendant failed to respond to the inquiry of Section
1(8) of the "Private Water/On-Site Sewage Addendum to Agreement of
Sale", entitled "Private On-Site Sewage System", thereby indicating
that he had no knowledge of problems of any nature involving the
on-site sewage system.
20. During April, 1996, Plaintiffs performed a "walk-through"
of the Subject Property. The defects of the private on-site sewage
system were not readily apparent to the Plaintiffs and they had no
knowledge of the existence of such latent defects at that time,
21, During April, 1996, Plaintiffs and Defendant held the
real estate settlement for the purchase and sale of the Subject
Property. Defendant failed to mention at settlement and/or prior
thereto the problems he had experienced with the private on-site
sewage system on the Subject Property,
22, During the summer of 1996, Plaintiffs began experiencing
water problems and leakage at the exterior of the basement of the
residence on the Subject Property. On or about September 15, 1996,
Plaintiffs employed C & S Custom Builders, a sewage and
construction repair and installation company, to examine the
Subject Property to determine the source of the water problem, and
to suggest the repairs necessary to correct the water problems on
the Subject Property,
23, Plaintiffs hired C & S Custom Builders to correct the
water problems on the Subj ect Property, C & S at tempted to correct
the water problems including leakage into the basement of the
residence of the Subject Property by installing a new sump pump and

performing other related excavating services. (A true and correct
copy of the proposal for those services is attached hereto as
Exhibit "C" and is incorporated herein by reference as if fully set
forth, )
24, The total cost of the repair services provided by C & S
Builders in their attempts to remedy the water problems of the
Subject Property was Seven Hundred Eighcy Nine and 00/100 Dollars
($789.00). This was paid by Plaintiffs.
25. Thereafter,
Plaintiffs experienced more extensi ve
drainage problems.
As a result, they were forced to consult a
septic and excavating service, namely, Dillsburg Septic and
Excavating.
26. In its repeated attempts to correct the water problem on
the Subject Property, Di1lsburg Septic and Excavating provided
services to Plaintiffs as follows:

services are attached hereto as Exhibit "D" and are incorporated
herein by reference.)
27. On or about November 4, 1997, Plaintiffs hired septic
planner, John Madden, to examine the septic tank to determine any
possible solutions to the drainage problem on the Subject Property.
Mr. Madden recommended installation of a Pressure Dosed Sand Filter
- Replacement System for the septic tank. Thereafter, Plaintiffs
had Mr. Madden install such a filter at a cost of Two Hundred and
00/100 Dollars ($200.00), which was paid by Plaintiffs.
28. In addition to the services of Dillsburg Excavating &
Septic and John Madden, noted above, Plaintiffs incurred the costs
of further inspections and tests performed by the Monroe Township
Authorities including soil and perk tests and an inspection of the
on-site sewage system of the Subject Property.
29. The total cost incurred by Plaintiffs for the tests and
inspections of the Township total Two Hundred Fifteen and 00/100
Dollars ($215.00).
30. Despite the diligent efforts of Plaintiffs to correct the
water problems of the Subject Property by repairing the defective
existing septic system, the water problems could not be resolved
and Plaintiffs were forced to purchase and have installed a new
septic system at a total cost of Six Thousand Eight Hundred Eighty-
six and 00/100 Dollars ($6,886.00), (A true and correct copy of a
proposed invoice for the costs is attached hereto as Exhibit "E"
and is incorporated herein as if fully set forth.)
31. The aforementioned repairs, services, and installations

required to remedy the latent defects of the sewage system on the
Subject Property caused damage to the yard and landscaping on the
Subject Property.
32. As a direct result of Defendant's conduct and the latent
defect on the Subj ect Property, Plaintiffs were damaged to the
extent that they were forced to drastically limit their water usage
for over a year including but not limited to taking showers at
friends' homes, refraining from running the dishwasher or washing
machine, limiting flushing of toilet to only those times when
needed, turning off the soft-water tank, digging perk holes,
covering the septic tank to prevent rain water from getting inside,
and washing dishes by hand in buckets of reused water.
33, Pursuant to the terms of the Agreement for the Sale and
Purchase of Real Estate, Paragraph 22, Plaintiffs submitted the
dispute to Mediation before the Greater Harrisburg Association of
Realtors on December 16, 1997. Because Defendant declined to
participate in Mediation, Plaintiffs have filed this Complaint.
WHEREFORE, Plaintiffs, Robert E, Tibbens, Jr. and Dorene M.
Tibbens request that this Honorable Court enter an Order in favor
of Plaintiffs and against Defendant for the damages suffered by
Plaintiffs, costs and attorney's fees, and for such other relief as
this Court deems just and proper.
COUNT I - FRAUDULENT MISREPRESENTATION
34, Plaintiffs incorporate herein paragraphs 1 through 33,
above, as if fully set forth herein,

35. The condition of the sewage system of the
Property and the latent defects thereof are material
transaction that is the subject of this legal action.
36. By his conduct more specifically described above,
Defendant, with the intent to deceive Plaintiffs, intentionally
misrepresented to Plaintiffs the condition of sewage system of the
Subj ect Property, which is a material fact to the transaction
between the parties.
37. Defendant, under Pennsylvania law, had an affirmative
duty to inform Plaintiffs of the latent defects of the sewage
system of the Subject Property of which he had knowledge, and his
failure to do so is the equivalent of an assertion of a falsehood.
38. Defendant's failure to inform Plaintiffs of the problems
with the sewage system of the Subject Property of which he had
knowledge at the time of the completion and execution of the
Seller's Property Disclosure Statement, constitutes an intentional,
material misrepresentation.
39. Plaintiffs justifiably relied to their detriment, upon
the misrepresentations of Defendant in the transaction that is the
subject of this action.
40. As a proximate result of Defendant's intentional and
material misrepresentations, Plaintiffs suffered actual damages for
inspections, repairs, replacements of the sewage system of the
Subject Property as well as damage to the landscaping of the
property and the inconvenience of limitations of water use as more
specifically described, above,
41, Plaintiffs now seek to recover any and all damages they

WHEREFORE, Plaintiffs, Robert E. Tibbens, Jr, and Dorene M.
Tibbens request that this Honorable Court enter an Order in favor
of Plaintiffs and against Defendant for the damages suffered by
Plaintiffs, costs and attorney's fees, and for such other relief as
this Court deems just and proper.
COUNT II - NEGLIGENT MISREPRESENTATION
42. Plaintiffs incorporate herein paragraphs 1 through 41,
above, as if fully set forth herein.
43. Defendant, under Pennsylvania law, had an affirmative
duty to Plaintiffs to exercise reasonable care and competence in
obtaining and/or communicating information regarding the Subject
Property. Therefore, Defendant had a duty to inform Plaintiffs of
the latent defects of the sewage system of the Subject Property of
which he had knowledge, and his failure to do so is the equivalent
of a misrepresentation.
44. Defendant failed to exercise reasonable care in supplying
accurate and detailed information regarding the Subject Property
and more specifically, the condition of the on-site sewage system
of the Subject Property.
45. Defendant's failure to provide accurate and detailed
information regarding the condition of the sewage system and
failure to disclose latent defects of the Subject Property
constitutes a breach of his duty to exercise reasonable care under
the circumstances of this case, as more specifically alleged,
above.
46. Defendant's failure to disclose the problems with the
sewage system of the Subject Property is material to the
transaction that is the subject of this action.
47. Plaintiffs justifiably relied upon Defendant's
misrepresentations as more specifically described, above.
48. Defendant's breach of his duty to exercise reasonable
care proximately caused Plaintiffs to suffer damages as more
specifically described, above,
49. Plaintiffs now seek to recover any and all damages they
have suffered as a result of Defendant's negligent
misrepresentation.
WHEREFORE, Plaintiffs, Robert E. Tibbens, Jr. and Dorene M.
Tibbens request that this Honorable Court enter an Order in favor
of Plaintiffs and against Defendant for the damages suffered by
Plaintiffs, costs and attorney's fees, and for such other relief as
this Court deems just and proper.
COUNT III - INNOCENT MISREPRESENTATION
50. Plaintiffs incorporate herein paragraphs 1 through 49,
above, as if fully set forth herein.
51. Defendant, under Pennsylvania law, had an affirmative
duty to Plaintiffs to inform them of any and all defects of the
sewage system of the Subject Property of which he had knowledge,
and his failure to do so is the equivalent of a misrepresentation.

53. Defendant's failure to disclose the problems with the
sewage system of the Subject Property is material to the
transaction that is the subject of this action,

justifiably
relied
upon
Defendant's
misrepresentations as more specifically described, above.
55. Defendant's failure to provide accurate and detailed
information and failure to disclose latent defects of which he had
knowledge proximately caused Plaintiffs to suffer damages as more
specifically described, above.

COUNT IV - VIOLATION OF UNFAIR TRADE PRACTICES
AND CONSUMER PROTECTION LAW
57. Plaintiffs incorporate herein paragraphs 1 through 56,
above, as if fully set forth herein.
58. The Pennsylvania Unfair Trade Practices and Consumer
Protection Law applies to a seller of real estate even though he or

she is not in the business of selling goods and services.
59. In the transaction that is the subject of this action,
Defendant is the seller of real estate.
60. The conduct of Defendant, which is more specifically
described above, created a likelihood of confusion and/or
misunderstanding pursuant to 73 P.S. till 201-2 (4) (ii), 201-2 (4) (v),
201-2 (4) (vi), 201-2 (4) (vii), and 201-2 (4) (xvii),
61. Defendant's failure to provide accurate and detailed
information regarding the condition of the sewage system and
failure to disclose latent defects of the Subject Property
including the problems with the sewage system of which Defendant
had knowledge, constitutes a violation of Pennsylvania Unfair Trade
Practices and Consumer Protection Law.
62. The transaction that is the subject of this action is a
private action pursuant to 73 P,S, ~ 201-9.2. Therefore, the court
may award up to three times the actual damages sustained by
Plaintiffs and such additional relief as it deems necessary or
proper.
63. Plaintiffs, however, agree to submit this proceeding for
arbitration pursuant to Local Rule 1301-1, which permits
arbitration for civil cases in which the total amount in
controversy is Twenty Five Thousand and 00/100 Dollars ($25,000.00)
or less, exclusive of interest and costs.
WHEREFORE, Plaintiffs, Robert E. Tibbens, Jr. and Dorene M.
Tibbens request that this Honorable Court enter an Order in favor
of Plaintiffs and against Defendant for the damages suffered by
Plaintiffs, including treble damages, costs and attorney's fees,
