WIT N E SSE 'r II: That ONners hereby agree to lease to Tenant and Tenant hereby agrees to rent fran OWners the hereinafter descrlbed pranises subject to the following teDllS, conditions and covenants: 1. Iru\SED PREMISFS. The leased premises (hereinafter referred to as "Premises") shall consist of a first floor retail store (consisting of 2,000 square feet rrore or less) and basement storage area in Owners' building known and numbered as 855 Market Street in the Borough of Lemoyne, Cumberland County, Pennsylvania. 'l'enant shall have the right to use the currently existing side and rear parking areas in conjunction with the operation of his business. 2. INITIAL 'l'ERM. The initial teDll shall be for a period of two ( 2 ) years beginning on the 1st day of May, 1991Yand ending on the 30th day of April, 199.z-; S \ 3. BASE RENr. The Tenant shall pay to OWners rent in equal monthly installments of One Thousand Six Hundred Sixty Dollars ($1,660.00) on the 1st day of each and every Jronth. 4. RENrAL ADJUS'nlENI'S. In addition to the rent specified in Paragraph 3, above, Tenant shall pay the following adjust.rrents to rental: A. 50% of any increase in insurance on the premises. B. 50% of any increase in real estate taxes levied upon the building and land. , . C. 50% of any increase in trash raroval or other municipal service fees. Said adjusbrents shall be due frcrn Tenant at such t.iJre as o..mers pay the charges giving rise to the adjusbrent, unless otherwise agreed in writing. 5. USE. Tenant shall use the pranises only as a retail store for the sale of records, gifts and related items and shall not assign this lease or sublet the pranises without the prior written consent of o..mers, which shall not be unreasonably withheld. Tenant shall not do or pennit any act or practice injurious to the pranises, or which may affect the insurance on the pranises. 'l'enant shall not comnit or pennit any unlawful act upon the pranises. 6. urILrl'lES l\ND SERVICE. Tenant shall pay the cost of electric service to the pranises. Tenant agrees that o..mers shall have the right to tanporarily stop the service of any utility in the event of an arergency effecting the sarre or to facilitate repairs or alterations to the prenises. OWners will be responsible for pranpt removal of snow on the leased premises and parking area. 7. AIJ.l'ERM'ICI'lS. Tenant shall not make major additions to or alterations of the pranises without CMners prior written consent. 8. LIABILITY CLI\IMS. CMners shall not be liable for property damage or personal injury occurring on or about the pranises. Tenant shall bear, pay and discharge, as the same becare due and payable, all judgments, claims or denands against Tenant or against o..mers arising fran .Tenant' s possession and use of the premises. Tenant shall assune the burden and expense of defending all such claims or suits. Tenant shall indannify and save CMners haDnless fran and against any claim or expense arising by reason of the possession, use or misuse of the pranises on the part of Tenant or his invitees. In the event that such a claim is asserted against Owners, o..mers may in their sole discretion settle such claim, and, for the purpose of Tenant's obligation to indannify CMners, such settlanent shall be conclusively presumed to be a claim for which CMners are liable and the settlarent reasonable in amount. 9. ClISUALTY DlIM1\GE. If casualty damage renders the pramses untenantable or uninhabitable, this lease Rhall teIJUinate and Tenant, upon payrrent of all rent due to the date that the pranises is surrendered to CMners, shall not be liable for any . , .. After the tennination, whether at the end of the tenn, by forfeiture, or otherwise, any such property of Tenant remaining on the premises shall be the property of CMners, and (),.mers may dispose of such property as they deem appropriate without any further responsibility to Tenant. 11. lUGlll' OF ~l'I00. CMners, or any person acting on their behalf, shall have the right to enter the pranises at reasonable tirres upon reasonable notice to inspect the premises, enforce this lease or to discharge or to secure the discharge of any obligation arising by reason of ownership of the premises. 12.
