AND NOW, this day of June, 1998, upon presentation and consideration of the
within Petition, and upon nding that the plaintiff, Tracy Leigh McMichael, now residing at 18
East Green Street, Mechanicsburg, Cumberland County, Pennsylvania, is in immediate and
present danger of abuse from the defendant, William Carter McMichael, the following Temporary
Order is entered,
The defendant, William Carter McMichael (SSN: 199-50-3623)(DOB: 04/03/56), an adult
individual residing at 118 North Market Street, Mechanicsburg, Cumberland County,
Pennsylyania, is hereby enjoined tram physically abusing the plaintiff, Tracy Leigh McMichael, or
tram placing her in fear of abuse,
The defendant is ordered to stay away from the plaintiff's residence located at 20 East
Green Street, Mechanicsburg, Cumberland County, Pennsylyania, a residence which is leased by
Sherry Hurd, the plaintiff's mend, to which she and the minor children moved to ayoid abuse, and
is ordered to stay away from any residence the plaintiff may in the future establish for herself.
The defendant is ordered to refrain from having any direct or indirect contact with the
plaintiff or the parties' minor children including, but not limited to, telephone, written, third party,
or electronic communications,
The defendant is enjoined from harassing and stalking the plaintiff and trom harassing her
relatives, or the parties' minor children,
The defendant is enjoined from going to the plaintiO's place of employment or the schools
and day carc facilitics ofthc parties' minor childrcn,
Thc dcfcndant is cnjoined from damaging or destroying any propcrty owned jointly by the
partics or owned by the plaintiff.
A violation of this Ordcr may subject the defendant to: i) arrest under 23 Pa.C.S.
~6113; ii) a private criminal complaint under 23 Pa.C.S. ~6\13.1; Hi) a charge of indirect
criminal contempt under 23 Pa.e.S. ~6114, punishable by imprisonment up to six months
and a fine of $100.00-$1,000.00; and iv) civil contempt under 23 Pa.C.S. ~6114.1.
Resumption of co-residence on the part of the plaintiff and defendant shall not nullifY the
proyisions of the court order,
This Order shall remain in effect until modified or terminated by the Court and can be
extended beyond its original expiration date if the Court finds that the defendant has committed an
act of abuse or has engaged in a pattern or practice that indicates risk of harm to the plaintiff.
Temporary custody of the parties' children, Jesse Park McMichael, Aaron Jackson
McMichael, and Emily Hope McMichael, is hereby awarded to the plaintiff, Tracy Leigh
McMichael.
The defendant is ordered to relinquish to the sheriff's department any weapons which he
owns or possesses, including, but not limited to a shotgun and/or rifle, used or threatened to use
in an incident of abuse against the plaintiff, The defendant is prohibited from acquiring or
possessing any other weapons for the duration of the Order and is required to relinquish to the
sheriff any fireanm license the defendant may possess, The defendant's weapons and fireanm
license may be returned at the expiration of the Protection Order after the defendant has
submitted a written request to the Court for the return of the weapons and the Court has notified
the plaintiff of the request and given the plaintiff an opportunity to respond, A copy of this Order
shall be transmitted to the chief or head of the police departmcnt of the Pennsylvania State Police
(Carlisle Barracks), and any other appropriate police departmcnts,

The plaintiff may proceed without pre.payment of fees pending a further order after the
hearing.
The Cumberland County Sheriff's Department shall attempt to make service at the
plaintiff's request and without pre-payment of fees, but service may be accomplished under any
applicable rule of Civil Procedure.
This Order shall be docketed in the office of the Prothonotary and forwarded to the Sheriff
for service, The Prothonotary shall not send a copy of this Order to the defendant by mail.
The Mechanicsburg Police Department shall be provided with a certified copy of this
Order by the plaintiff's attorney, This Order shall be enforced by any law enforcement agency
where a violation occurs by arrest for indirect criminal contempt without warrant upon probable
cause that this Order has been violated, whether or not the violation is committed in the presence
of the police officer. In the event that an arrest is made, under this section, the defendant shall be
taken without unnecessary delay before the court that issued the order, When that court is

b) On or about May 29. 1998, shortly after midnight, the plaintiff saw the
defendant in the backyard of the residence where she was staying, Fearing for hcr
safety, the plaintiff telephoned the Mechanicsburg Police,
c) Between approximately May 26 and May 28, ] 998, the plaintifl's son,
Aaron, saw the defendant walking in and around the garage behind his house,
which is locatcd in the Borough of Mechanicsburg, carrying a shotgun or riflc,
The defendant does not hunt. The incidents were reported to the Mechanicsburg
Police,
d) On or about May 22, 1998, the defendant cornered the plaintiff twice,
refused to let her leave, grabbed her by the arm, and shoved her about causing her
to fall backward onto equipment stored in the garage, The plaintiff's father pulled
the defendant away from the plaintiff to protect her !Tom further abuse, The
plaintiff sustained bruising and soreness about her arm and legs as a result of this
incident.
e) In or about 1997, the defendant threatened to make a bomb with propane
canisters to kill his former co-workers in Bradford, Pennsylvania, The defendant
has seyeral small propane gas canisters stored in his garage, The plaintiff reported
this information to Mechanicsburg Police,
5, On or about May 23, 1998, the plaintiff and the parties' three minor children left
their residence at 118 North Market Street, Mechanicsburg, Cumberland County, Pennsylvania, in
order to avoid further abuse,
6, The plaintiff believes and therefore avers that she is in immediate and present
danger of abuse from the defendant and that she is in need of protection !Tom such abuse,
7, The plaintiff desires that the defendant be prohibited from haying any direct or
indirect contact with the plaintiff or the minor childrcn including, but not limited to, telephone,
written, third party, or electronic communications,
8, The plaintiff desires that the defendant be enjoined from harassing and stalking the
plaintiff, and from harassing her relatives, or the minor children,
9, The plaintiff desires that the defcndant be restrained from going to her place of
employment, or the schools and day care facilities of the minor children,
10. The plaintiff desires that the defendant be enjoined from damaging or destroying
any property owned jointly by the parties or owned by the plaintiff,

but not limited to, a shotgun and/or rifle, be confiscated by the Sheriff's Department and that the

12. The home located at 18 East Green Street, Mechanicsburg, Cumberland County,
Pennsylyania, from which the plaintiff is asking the Court to order the defendant to stay away is
rented in the name of Sherry Hurd, and the defendant has never resided there,
C. REIMBURSEMENT FOR COST OF CASE
13, The plaintiff asks that the defendant be ordered to pay $250,00 to Cumberland
County, one of Legal Services, Inc, 's funding sources as reimbursement for the cost of litigating
this case, and that the defendant be assessed the $25,00 surcharge and any court costs if the case

custody is temporarily granted to the plaintiff pending a hearing in this matter for reasons
including:
a, The plaintiff has provided for the emotional and physical needs of
the children since their births and is a responsible parent who can best care
for the minor children,
b, The defendant has shown by his abuse of the plaintiff that he is not
an appropriate role model for the minor children,
c, The defendant's behavior has adversely affected the children,
WHEREFORE. pursuant to the provisions of the "Protection from Abuse Act" of October

following relief:
A. Grant a Temporary Order pursuant to the "Protection from Abuse
Act:"
I, Ordering the defendant to refrain from abusing the plaintiff or from

5, Prohibiting the defendant from damaging or destroying any
property jointly owned by the parties or owned by the plaintiff;
6, Ordering the defendant to stay away from the plaintiff's current
residence located at IS East Green Street, Mechanicsburg, Cumberland
County, Pennsylyania, and any residence the plaintiff may in the future
establish for herself;
7, Granting temporary custody of the parties' minor children to the
plaintiff; and
S, Ordering the defendant to relinquish to the sheriff's department any
weapons which he owns or possesses including, but not limited to, a
shotgun and/or rifle, and prohibiting the defendant from acquiring or
posscssmg any wcapons for thc duration of thc Tcmporary Protcction

B. Schedule a hearing in accordance with the provisions of the
"Protection from Abuse Act," and, after such hearing, enter an order to be
in elTect for a period of one year:
1. Ordering the defendant to refrain from abusing the plaintiff or from
placing her in fear of abuse;
2. Ordering the defendant to refrain from having any direct or indirect
contact with the plaintiff including, but not limited to, telephone, written,
third party, or electronic communications;
3, Ordering the defendant to refrain from harassing and stalking the
plaintiff and ITom harassing her relatives and the minor children;
4, Pronibiting the defendant from going to the plaintiff's place of
employment, or the schools or day care facilities of the minor children;
5, Prohibiting the defendant ITom damaging or destroying property
jointly owned by the parties or owned by the plaintiff;
6, Ordering the defendant to stay away ITom the plaintiff's current
residence located at 18 East Green Street, Mechanicsburg, Cumberland

The Def. did violate the Temporary Protection From Abuse Order number 98~3361 civil term.
The order was signed by the Honorable Judge George E. Hoffer and dated June 16, 1998.
The Dp.f. violated the above mentioned order by;
appearing at the plaintiff's residence on June 17, 1998 at approx. 2145 hours. While at
the Plaintiff's residence the Def. stood in the back yard behind a tree and watched the
rear of said dwelling. When the plaintiff learned of the Def.'s actions she became alarmed
and in fear for her safety.

AFFIDAVIT RIDER CONTAIHIHG PROBABLE CAUSE FOR THE ISSUAIICE OF A WARRANT OF ARREST
FOR William HcMichael DOB. 1,/3/56 SS# 199-50-3623 wm'I1 years old
On 6/18/98 I was contacted by Tracy McMichael in reference to a PFA violation
committed by her husband, William ~lc1~ichael, on 6/17/98 at approx. 2116 hours. "It
should be noted that Tracy has been seperated from her husband for several weeks. Tracy
and the couples children live in a seperate dwelling, 6ut near William McMichael's
residence. Tracy reported that a friend, Alan Gheen, told her on 6/18/98 that he had
observed William McMichael standing in the back yard of her residence on the evening of
6/17/98. Tracy reports that when she received this information she was alarmed and
concerned' for her safety.
I spoke with Alan Gheen in reference to the above incident he had observed.
Gheen reported that he was visiting a friend in the area of Tracy's residence on 6/17/98.
At approx. 2145 hours that date he observed William McMichael walking two dogs in the
area of Tracy's back yard. Gheen reports that he eventually lost sight of HcMichael, and
walked up the alley that runs behind Tracy's residence. Gheen reports that when he
approacOCd Tracy's back yard, McMichael came walking out from the rear of Tracy's home.
Gheen further reported that he had observed McMichael standing behind a tree in Tracy's
back yard, and it appeared that McMichael was w~tching the house. When Gheen asked
McMichael what he ,laS doing in Tracy's back yard, and he stated "I was just walking my
dogs". Glieen reports that McMichael was standing to the rear of Tracy's residence for
approx. 10 minutes.
"It shov1d be noted that William McMichael was served with the aforementioned
Temporary PFA on 6/17/98, the same day this violation occurred. The PFA order does
stipulate that McMichael must "stay away from the plaintiff's residence located at 20
E. G,reen St. in Mechanicsburg Borough".

The order was signed by the Honorable Judge George E. Hoffer and dated June 16, 1998.
The Dp.f. violated the above mentioned order by;
appearing at the plaintiff's residence on June 17, 1998 at approx. 2145 hours. While at
the Plaintiff's residence the Del'. stood in the back yard behind a tree and watched the

The plaintiff, Tracy Leigh McMichael, by and through her attorneys, Joan Carey and
Philip C, Briganti of Legal Services, Inc" moyes the Court for an Order rescheduling the hearing
in the above-captioned case on the grounds that:
1. A Temporary Protection Order was issued by this Court on June 16, 1998,
scheduling a hearing for Tuesday, June 23, 1998, at 3 :45 p,m,
2, The Cumberland County Sherifl's Department served the defendant with a certified
copy of the Temporary Protection Order and Petition for Protection Order on June 17, 1998, at
his residence located at 118 North Main Street, Mechanicsburg,
3, The defendant indicated to Legal Services, Inc, on June 19, 1998, that he desired
legal representation in this matter,
4, The parties agree that the hearing be rescheduled to afford the defendant time to
retain counsel in this matter,
5, The plaintiff requests that the Temporary Protection Order remain in effect for a
period of one year or until further Order of Court, whichever comes first.
6, A certified copy of the Order for Continuance will be delivered to the
Mechanicsburg Police Department by the attorney for the plaintiff.
WHEREFORE, the plaintiff requests that the Court grant this Motion and reschedule this
matter for hearing, and that the Temporary Protection Order remain in effect for a period of one

including third partics, except for the limited purpose of facilitating custody arrangements..
(8) 5. Custody of the minor children, Jesse Park McMichael, Aaron Jackson
McMichael, and Emily Hope McMichael, shall be as follows: see attached Custody Order.
o 6. Defendant shall immediately tum ovcr to the Sheriff's Office, or to a local law
enforcement agency for delivery to the Sheriff's Office, the following weapons used or threatened
to be used by Defendant in an act of abuse against Plaintiff and/or the minor children: a shotgun.
o 7. Defendant is prohibited from possessing, transferring or acquiring any other
weapons for the duration of this Order. Any weapons delivered to the sheriff under Paragraph 6
of this Order or undcr Paragraph 6 of the Temporary Order shall not be returned until furthcr
Order of Court.

The following additional reliefis granted as authorized by ~6108 of this Act:
Law enforcement agencies, human service agencies and school districts shall not
disclose the presence of the Plaintiff and/or address, telephone number, or any other
demographic information about the Plaintiff and/or child/ren except by further Order of
Court.
This Order shall remain in effect until modified or terminated by the Court and can
be extended beyond its original expiration date if the Court finds that the Defendant has
committed another act of abuse or has engaged in a pattern or practice that indicates
continued risk of harm to the Plaintiff.
The Defendant is required to relinquish to the sheriff any firearm license the
Defendant may possess. The Defendant's weapons and firearm license may be returned at
the expiration of the Protection Order after the Defendant has submitted a written request
to the Court for the return of the weapons and the Court has notified the Plaintiff of the
request and given the Plaintiff an opportunity to respond. A copy of this Order shall be
transmitted to the chief or head of the police department of Mechanicsburg and the sheriff
of Cumberland County.
The Dcfcndant is enjoincd from damaging or destroying any property owncd
jointly by the parties or owned solely by thc Plaintiff.
Thc Dcfendant is to refrain from harassing thc Plaintiff's relatives or the minor
children. t
The Defendant~OOrdered to reimbursc Cumberland County, a Legal Services
funding source, for the value of the legal services providcd to Plaintiff for the
cost oflitigating this casc.
